Staff review of the plans and specifications has determined that the project, as proposed,complies with the Stormwater Regulations set forth in Title 15A NCAC 02H.1000 amended on January 1, 2017 (2017 Rules). We are hereby forwarding Permit Number SW8221001 dated October 12,2022, for the construction of the built-upon areas (BUA)and stormwater control measures (SCMs)associated with the subject project. This permit shall be effective from the date of issuance until October 11 2030 and the project shall be subject to the conditions and limitations as specified therein and does not supersede any other agency permit that may be required. Failure to comply with these requirements will result in future compliance problems. Please note that this permit is not transferable except after notice to and approval by the Division. This cover letter, attachments, and all documents on file with DEMLR shall be considered part of this permit and is herein incorporated by reference. If any parts,requirements,or limitations contained in this permit are unacceptable,you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes and must be filed with the OAH within thirty(30) days of receipt of this permit. D E Washington Regional Office 1943 Washington Square Mad I Washington,North Carolina 2T889 rpinl ,�roa 252.946.6481 STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY DIVISION OF ENERGY,MINERAL AND LAND RESOURCES STATE STORMWATER MANAGEMENT PERMIT HIGH DENSITY DEVELOPMENT In compliance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules,and Regulations promulgated and adopted by the North Carolina Environmental Management Commission,including 15A NCAC 02H.1000 amended on January 1, 2017 (2017 Rules) (the"stormwater rules"), PERMISSION IS HEREBY GRANTED TO Evolve Holly Ridge, LLC Evolve Holly Ridge Mixed Use Drag Strip Road, Holly Ridge, Onslow County FOR THE construction,management, operation and maintenance of built-upon area draining to one wet pond ("stormwater control measures" or"SCMs") discharging to Class SA;HQW waters greater than one half mile as outlined in the application,approved stormwater management, supplement, calculations, operation and maintenance agreement,recorded documents, specifications,and other supporting data (the"approved plans and specifications") as attached and/or on file with and aproved by the Division of Energy, Mineral and Land Resources (the "Division" or"DEMLR"). The project shall be constructed, operated and maintained in accordance with these approved plans and specifications. The approved plans and specifications are incorporated by reference and are enforceable part of this permit. This permit shall be effective from the date of issuance until October 11, 2030 and shall be subject to the following specified conditions and limitations. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification,transfer,renewal, or rescission; however,these actions do not stay any condition.The issuance of this permit does not prohibit the Director from reopening and modifying the permit,revoking and reissuing the permit, or terminating the permit for cause as allowed by the laws, rules,and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143-215.1 et.al. 1. BUA REQUIREMENTS. The maximum amount of BUA allowed for the entire project is 1,061,171 square feet. The runoff from all BUA within the permitted high density drainage area of this project must be directed into the permitted SCM. The BUA requirements and allocations for this project are as follows: a. REDEVELOPMENT.The redevelopment portion of this project is exempt from State Stormwater permitting requirements under the following conditions: i. The project must be constructed as shown on the plans submitted to this Office. ii. The redevelopment area includes a total proposed BUA of 444,312 square feet,which does not exceed the existing BUA of 444,312 square feet. The 444,312 square feet of total allocated BUA includes Zero (0) square feet of proposed BUA and 444,312 square feet of BUA allocated for future development. iii. The proposed stormwater control provides equal protection of surface waters as the existing stormwater control. b. SCM BUA LIMITS. The SCM has been designed using the runoff treatment method to handle the runoff from 616,859 square feet of BUA within the delineated drainage area,which includes 205,925 square feet of future BUA. 2. PERVIOUS AREA IMPROVEMENTS. At this time,none of the pervious area improvements listed in G.S. 143-214.7(b2) or the Stormwater Design Manual have been proposed for this project. Pervious area improvements will be allowed in this project if'documentation is provided demonstrating those improvements meet the requirements of the stormwater rule. 3. SCM REQUIREMENTS. The SCM requirements for this project are as follows: a. SCM DESIGN. The SCM is permitted based on the design criteria presented in the sealed, signed and dated supplement and as shown in the approved plans and specifications. This SCM must be provided and maintained at the design condition. b. PLANTING PLAN. The SCM landscape planting plan shown in the approved plans shall be followed in its entirety during construction. After the plants are established,the operation and maintenance agreement must be followed. c. FOUNTAINS. At this time, a decorative spray fountain has not been proposed within the wet pond. Decorative spray fountains will be allowed in the wet pond if documentation is provided demonstrating that the proposed fountain will not cause resuspension of sediment within the pond or cause erosion of the pond side slopes. d. IRRIGATION. If the wet pond is to be used for irrigation, it is recommended that some water be maintained in the permanent pool,the vegetated shelf is planted with appropriate species that can handle fluctuating conditions, and human health issues are addressed. 4. NON-ENFORCEABLE SCMS. The wet pond labeled as Storage Pond shown on the plans is not required by the Division and has not been demonstrated to meet the Minimum Design Criteria and therefore is not considered a part of the approved stormwater treatment system. This additional measure is incorporated only by reference and is not enforceable parts of the permit. 5. STORMWATER OUTLETS. The peak flow from the 10-year storm event shall not cause erosion downslope of the discharge point 6. VEGETATED SETBACKS. A 50-foot wide vegetative setback must be provided and maintained in grass or other vegetation adjacent to all surface waters as shown on the approved plans. The setback is measured horizontally from the normal pool elevation of impounded structures,from the top of bank of each side of streams or rivers, and from the mean high waterline of tidal waters,perpendicular to the shoreline. 7. RECORDED DOCUMENT REQUIREMENTS. The stormwater rules require the following documents to be recorded with the Office of the Register of Deeds: a. EASEMENTS. All SCMs, stormwater collection systems,vegetated conveyances, and maintenance access located on property owned by other persons or entities must be located in permanent recorded easements or drainage easements as shown on the approved plans. b. OPERATION AND MAINTENANCE AGREEMENT. The operation and maintenance agreement must be recorded with the Office of the Register of Deeds. c. FINAL PLATS.The final recorded plats_must reference the operation and maintenance agreement and must also show all public rights-of-way,dedicated common areas,and/or permanent drainage easements,in accordance with the approved plans. • 8. CONSTRUCTION. During construction,erosion shall be kept to a minimum and any eroded areas of the on-site stormwater system will be repaired immediately. a. PROJECT CONSTRUCTION, OPERATION AND MAINTENANCE. During construction,all operation and maintenance for the project shall follow the Erosion Control Plan requirements until the Sediment-Erosion Control devices are converted to SCMs or no longer needed. Once the device is converted to a SCM,the permittee shall provide and perform the operation and maintenance as outlined in the applicable section below. b. SCM RESTORATION. If one or more of the SCMs are used as an Erosion Control device and/or removed or destroyed during construction,it must be restored to the approved state stormwater design condition prior to close-out of the erosion control plan and/or project completion and/or transfer of the state stormwater permit Upon restoration,a new or updated certification will be required for the SCM(s) and a copy must be submitted to the appropriate DEQ regional office. 9. MODIFICATIONS. No person or entity,including the permittee,shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans,the permittee shall submit to the Director, and shall have received approval for modified plans,specifications,and calculations including,but not limited to,those listed below. For changes to the project or SCM that impact the certifications,a new or updated certification(s), as applicable,will be required and a copy must be submitted to the appropriate DEQ regional office upon completion of the modification. a. Any modification to the approved plans and specifications, regardless of size including the SCM(s), BUA, details, etc. b. Redesign or addition to the approved amount of BUA or to the drainage area. c. Further development, subdivision,acquisition,lease or sale of any, all or part of the project and/or property area as reported in the approved plans and specifications. d. Altering,modifying,removing,relocating,redirecting, regrading, or resizing of any component of tie approved SCM(s), stormwater collection system and/or vegetative conveyance shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement, #57 stone area,public trails,or landscaping material within the common areas to be considered a permeable surface that were not included in the approved plans and specifications. g. Other modifications as determined by the Director. 10. DESIGNER'S CERTIFICATION. Upon completion of the project,the permittee shall determine if the project is in compliance with the approved plans and take the necessary following actions. a. If the permittee determines that the project is in compliance with the approved plans,then within 45 days of completion,the permittee shall submit to the Division one hard copy and one electronic copy of the following: i. The completed and signed Designer's Certification provided in Attachment A noting any deviations from the approved plans and specifications. Deviations may require approval from the Division; ii. A copy of the recorded operation and maintenance agreement; iii. Unless already provided, a copy of the recorded deed restrictions and protective covenants; iv. A copy of the recorded plat delineating the public rights-of-way, dedicated common areas and/or permanent recorded easements,when applicable. b. If the permittee determines that the project is not in compliance with the approved plans,the permittee shall submit an application to modify the permit within 30 days of completion of the project or provide a plan of action,with a timeline,to bring the site into compliance. 11. OPERATION AND MAINTENANCE. The permittee shall provide and perform the operation and maintenance necessary, as listed in the signed operation and maintenance agreement,to assure that all components of the permitted on-site stormwater system are maintained at the approved design condition. The approved operation and maintenance agreement must be followed in its entirety and maintenance must occur at the scheduled intervals. a. CORRECTIVE ACTIONS REQUIRED. If the facilities fail to perform satisfactorily, the permittee shall take immediate corrective actions. This includes actions required by the Division and the stormwater rules such as the construction of additional or replacement on-site stormwater systems.These additional or replacement measures shall receive a permit from the Division prior to construction. b. MAINTENANCE RECORDS. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity,name of person performing the work and what actions were taken. 12. PERMIT RENEWAL. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit The renewal request must include the appropriate application, documentation and the processing fee as outlined in 15A NCAC 02H.1045(3). 13. CHANGES TO THE PROJECT NAME, PERMITTEE NAME OR CONTACT INFORMATION. The permittee shall submit a completed Permit Information Update Application Form to the Division within 30 days to making any one of these changes. 14. TRANSFER. This permit is not transferable to any person or entity except after notice to and approval by the Director.Neither the sale of the project and/or property, in whole or in part,nor the conveyance of common area to a third party constitutes an approved transfer of the permit a. TRANSFER REQUEST. The transfer request must include the appropriate application, documentation and the processing fee as outlined in 15A NCAC 02H.1045(2) and must be submitted upon occurrence of any one or more of the following events: i. A natural person who is deceased; ii. A partnership,limited liability corporation, corporation, or any other business association that has been dissolved; iii. A person or entity who has been lawfully and finally divested of title to the property on which the permitted activity is occurring or will occur through foreclosure,bankruptcy, or other legal proceeding; iv. A person or entity who has sold the property,in whole or in part, on which the permitted activity is occurring or will occur; v. The assignment of declarant rights to another individual or entity; vi. The sale or conveyance of the common areas to a Homeowner's.or Property Owner's Association,subject to the requirements of NCGS 143- 214.7(c2). c. TRANSFER INSPECTION. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on-site stormwater system complies with the permit conditions. Records of maintenance activities performed to date may be requested. Projects not in compliance with the permit will not be transferred until all permit and/or general statute conditions are met. 15. COMPLIANCE. The permittee is responsible for complying with the terms and conditions of this permit and the approved plans and specifications until the Division approves the transfer request. a REVIEWING AND MONITORING FOR COMPLIANCE. The permittee is responsible for verifying that the proposed BUA within each drainage area and for the entire project does not exceed the maximum amount allowed by this permit The permittee shall review and routinely monitor the project to ensure continued compliance with the conditions of the permit,the approved plans and specifications. b. APPROVED PLANS AND SPECIFICATIONS. A copy of this permit, approved plans, application, supplement,operation and maintenance agreement, all applicable recorded documents, and specifications shall be maintained on file by the permittee at all times. c. MAINTENANCE ACCESS. SCMs,stormwater collection systems, and vegetated conveyances must be accessible for inspection,operation,maintenance and repair as shown on the approved plans. d. DIVISION ACCESS. The permittee grants Division Staff permission to enter the property during normal business hours to inspect all components of the permitted project. e. ENFORCEMENT. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. f. ANNUAL CERTIFICATION. The permittee shall electronically submit to the Division an annual certification completed by either the permittee or their designee confirming the projects conformance with permit conditions. g. OBTAINING COMPLIANCE. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit.Within the time frame specified in the notice,the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements.The permittee shall provide copies of modified plans and certification in writing to the Director that the changes have been made. h. OTHER PERMITS. The issuance of this permit does not preclude the permittee from obtaining and complying with any and all other permits or approvals that are required for this development to take place, as required by any statutes,rules, regulations, or ordinances,which are imposed by any other Local, State or Federal government agency having jurisdiction.Any activities undertaken at this site that cause a water quality violation or undertaken prior to receipt of the necessary permits or approvals to do so are considered violations of NCGS 143-215.1, and subject to enforcement procedures pursuant to NCGS 143-215.6. The site outside the wetlands has a majority of existing impervious, old parking lot and building concrete slabs, so we using a percentage of the existing impervious in our design. For good engineering practices, we have placed 20%of the site as existing impervious, the actual number is greater than 60%. Please find this design narrative, plan, and supporting calculations sufficient for meeting stormwater requirements according to NCDEQ and Brunswick County regulations. The property has an approximate latitude and longitude of 34° 29' 07" N, 78° 34' 03" W (Parcel ID# 009158,and 060395;Deed Book 5772 Pg 395). The existing property is being redeveloped as mentioned. The ground cover for the subject property is mostly existing asphalt and concrete. The topography for the site has a high point approximately 40% off of Hwy 17 with the main outfall of the site being the roadside ditch along US 17. According to the attached USGS map, the site drains to County Branch (SA, HQW) within the White Oak River Basin but we are greater than 1/2 mile as shown in the corresponding data. Soils on the project site consist of mainly Leon fine sand (LnA) [HSG-A/D], and a small patch of Murville muck(Mu) [HSG-A/D] according to the NRCS soil survey. PROPOSED IMPROVEMENTS Evolve at Holly Ridge, LLC proposes to construct a residential development that will consist of Phase 1 being 264 apartments, and amenity with associated roadways, sidewalks, and utilities. The pond is sized for future development,upon final site plan, a plan revision showing the unit layout will be provided to modify the permit. The future development will consist of commercial outparcels along US 17 and future residential (multi-family/cottage) in the rear. The developments stormwater is controlled through a County pre/post wet pond (Storage Pond) that connects all flow being treated and controlled by the State and County wet pond (Basin 1) with a discharge to the existing wetlands at the northwestern property line. The ponds are connected, but all treatment is handled in the wet pond. The treatment outfall is along US 17 with larger storms at the rear of the site. Temporary sediment basins/traps with temporary diversion ditches will control erosion during clearing and grading operations until the proposed conveyance system is constructed and operational. Perimeter measures, silt fence and construction entrances are also proposed. DESIGN METHOD Hydrologic Soil Group Classifications have been taken from the USDA Web Soil Survey as mentioned above. Storm conveyance calculations have been performed utilizing the Rational Method within Carlson Hydrology 2020 which employs the FHWA Method for HGL computations. The Brunswick County IDF curve has been implemented for the 10-year HGL calculations. Storm routing calculations have been performed utilizing the SCS Method within HydroCAD version 10.10. MAINTENANCE Contractors shall be responsible for periodic inspection and maintenance of all indicated erosion control devices.In addition, inspection and any necessary maintenance will be required immediately following any significant storm event. Any erosion control measure that fails to function as intended shall be repaired immediately. Upon completion of construction and the establishment of stabilized ground cover, the property owner shall be responsible for any ongoing site maintenance. All slopes steeper than 3:1 shall be planted or otherwise provided with either temporary or permanent ground cover,devices,or structures sufficient to restrain erosion within 7 calendar days. 3.3 REGULATORY REQUIREMENTS A. Whenever land disturbing activity is undertaken on a tract,a ground cover sufficient to restrain erosion must be planted or otherwise provided within 7 calendar days on that portion of the tract upon which further active construction is to being undertaken. B. If any earthwork is to be suspended for any reason whatsoever for longer than 7 calendar days, the areas involved shall be seeded with vegetative cover or otherwise protected against excessive erosion during the suspension period. Suspension of work in any area of operation does not relieve the Contractor of the responsibility for the control of erosion in that area. PART 4-CONSTRUCTION PHASE 4.1 PRACTICES A. Avoid dumping soil or sediment into any streambed or watercourse. Backfill for stream crossings shall be placed dry and compacted to minimize siltation of the watercourse, where applicable. B. Maintain an undisturbed vegetative buffer where possible between a natural watercourse and trenching and grading operations. C. Avoid equipment crossings of streams,creeks,and ditches where practicable. PART 5-SEDIMENT CONTROL FEATURES 5.1 GENERAL A. All devices (silt fences, retention areas, etc.), for sediment control shall be constructed at the locations indicated prior to beginning excavation on the site. All devices shall be properly maintained in place until a structure or paving makes the device unnecessary or until directed to permanently remove the device. 5.2 DESIGN APPLICATIONS A. Mulch shall be used for temporary stabilization of areas subject to excessive erosion, and for protection of seed beds after planting where required. 1. Jute,mesh,etc.should be installed as per manufacturer's instructions. B. Silt fences shall be used at the base of slopes to restrict movement of sediment from the site. C. Riprap shall be used at the proposed outfall pipes as indicated on plans. D. Establish vegetative cover on all unpaved areas disturbed by the work. 1. Preparation of Seedbed. Areas to be seeded shall be scarified a depth of 6 inches until a firm, well-pulverized, uniform seedbed is prepared. Lime, phosphorous, and fertilizer shall be applied during the scarification process in accordance with the following rates. a. Lime—2 ton per acre b. Nitrogen—100 pounds per acre c. P2O5—200 pounds per acre 2. Seeding.Disturbed areas along roads and ditches shall be permanently seeded with 10-20 pounds per acre of centipede during the period from March through September. Seeding performed during the period from April to August shall be temporarily seeded with 40 pounds per acre of German Millet. The permanent vegetative cover will be over seeded at the earliest possible time as specified above. 3. Mulch all areas immediately after seeding. Mulch shall be applied and anchored as specified hereinbefore. 5.3 MAINTENANCE A. The Contractor shall be responsible for maintaining all temporary and permanent erosion control measures in functioning order. Temporary structures shall be maintained until such time as vegetation is firmly established and grassed areas shall be maintained until completion of the project. Areas which fail to show a suitable stand of grass or which are damaged by erosion shall be immediately repaired. 5.4 REMOVAL OF SEDIMENT CONTROL DEVICES A. Near completion of the project, when directed by the Owner's agent, the Contractor shall dismantle and remove the temporary devices used for sediment control during construction. All erosion control devices in seeded areas shall be left in place until the grass is established. Seed areas around devices and mulch after removing or filling temporary control devices.
