Dear Mr. Sosne and Mr.Forte:
Effective August 1,2013,the State Stormwater program was transferred from the Division of Water Quality
(DWQ)to the Division of Energy,Mineral and Land Resources(DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1,2013 until they are modified. Please note that this
letter references DEMLR as the Division responsible for compliance with the permit.
On August 5.2009,the Governor signed Session Law 2009-406.This law impacted any development approval
issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes,which
was current and valid at any point between January 1,2008,and December 31,2010.The law extended the
effective period of any stormwater permit that was set to expire during this time frame to three(3)years from its
current expiration date. On August 2,2010,the Governor signed Session Law 2010-177,which granted an extra
year for a total of four(4)years extension. Accordingly,the Division is herewith notifying you that the subject
permit is now effective from the date of issuance until December 30,2021,which includes all available
extensions.
On August 19,2024,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources
(DEMLR)inspected the subject project,located at 4017 Wilshire Boulevard in New Hanover County to
determine the status of compliance with the State Stormwater Management Permit Number SW8 090110 issued
on January 30,2009. DEMLR file review and site inspection revealed that the site is not in compliance with the
terms and conditions of this permit. Please find a copy of the completed form entitled"Compliance Inspection
Report"attached to this letter,which summarizes the findings of the recent inspection.
As indicated in the attached inspection report,the following deficiencies must be resolved:
1. Section 11.8 of the permit: Please remember that upon completion of the project,a certification from an
appropriate designer of the system must be submitted certifying that the project has been built in
accordance with the approved plans and specifications
2. 15A NCAC 2H.1040(4)(b)and.1045(3): This permit expired on 12/30/2021. A permit renewal
application and processing fee is required to be submitted 180 days prior to this expiration date Please
submit a completed renewal application which is available on the Post-Construction Stormwater Program

section of the Division's website at deq.nc.gov/SW along with the required$505.00 processing fee and
other submittal requirements.
3. Section 11.3 of the permit: The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions as designed. Please ensure to maintain the
system per the approved maintenance agreement and the approved plans. The areas of permeable
pavement have been sealed with asphalt sealer and are no longer functioning in perpetuity as
permitted.The permeable pavement areas must be restored to their original design condition or
the permit must be modified to document the changed condition and demonstrate continued
compliance with the stormwater rules.
4. Section 11.10 of the permit County records show that Wilshire Landing LCP,LLC now owns this
property. The permittee,Wilshire Landing Apartments,LLC,was dissolved through the Secretary of
State on May 23,2013. As the current property owner,the permit can be transferred in accordance with
NC G.S. 143-214.7(c5). Please submit a completed and signed permit transfer application form which is
available on the Post-Construction Stormwater Program section of the Division's website at
deq.nc.gov/SW along with the necessary documentation and the required$505.00 processing fee in order
to transfer the permit to Wilshire Landing LCP,LLC. Upon receipt of the signed transfer application and
the required documentation,a site inspection will be scheduled.
5. Section II.13 of the permit: The permittee shall submit a written time schedule to address these concerns
within the time frame provided in the Notice of Inspection. Please provide a written plan of action listing
the specific steps that will be taken and a reasonable timeframe that will be required by October 1,2024.
Please be reminded that it is your responsibility as the permittee of record to submit a completed and signed
Permit Transfer Application Form to the Division of Energy,Mineral and Land Resources 30-60 calendar days
prior to making any of the below listed changes.This form is available on our website at:

a. An ownership change including the sale or conveyance of the permitted project area in whole or in part.
This does not include the conveyance of subdivided residential lots to individuals which are made
subject to a recorded declaration of covenants and restrictions which contain the statements required by
the stormwater permit,
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association,
subject to the requirements of Session Law 2011-256;
c. Foreclosure proceedings;
d. Filing for Bantruptcy;
e. Dissolution of the partnership,corporate entity or LLC.Per NCGS 57D-6-07,a dissolved LLC shall
wind up,which may include continuing the business of the LLC for a period of time.The person charged
with winding up the LLC shall collect the LLC's assets[which include the stormwater management
permit],and distribute the assets as provided in NCGS 57D-6-08(2). OR Per NCGS 55-14-05,a
dissolved corporation continues its corporate existence but may not carry on any business except
that appropriate to wind up and liquidate its business and affairs,which includes the stormwater
management permit.

g. A name change of the project;

Please be advised that until you submit the required Permit Transfer Application Form to the Division and receive
approval from the Division to transfer the permit,OR,as the permittee,you are required to comply with the terms,
conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative
Code 2H.1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the
permitted stormwater system and the requirement to submit any changes from the approved plans to the Division
for approval.
Failure to provide the requested information,or to respond to this letter with a plan of action,including a timeline
to resolve the identified deficiencies,by October 1,2024,are considered violations of the permit. If the
requested information is not submitted to this office by the due date,then DEMLR staff will re-inspect the site
and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance
with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action
as set forth in NCGS 143 Article 21,including the assessment of Civil penalties of up to$25,000 per day.

City Zoning had some notes on a resurfacing permit for the Wilshire Landing Apartments (4017 Wilshire Blvd).The
contractor sealed over the pervious pavement parking areas and tried to repair the damage by sandblasting.
This project does not have a City stormwater management permit, but it has an existing State stormwater permit,SW8
090110.
I just wanted to notify someone in your department of this issue so that it may be addressed upon permit renewal if
necessary.

Mr.Thacker,
We have discussed the Wilshire Landing pervious concrete issue with NCDEQ. If the owner chooses sand blasting and
vacuuming as the method of remediation,then a permeability test will also be required after completion.The sand
blasting and vacuuming may or may not restore the pervious concrete to an acceptable condition. Therefore, it may be
best to pursue the following options for remediation instead:
1. Contact the engineer of record to determine if the State stormwater permit can be revised to exclude the
pervious pavement entirely.This option may require adjustments to the infiltration basin in order to account for
the increase impervious area (pervious concrete spaces now sealed).
2. Remove and replace the pervious concrete entirely.

Kathryn—A routine inspection showed that Wrightsville Landing at 4017 Wilshire has paved over their pervious parking
spaces in back. The spaces were required to be pervious on the TRC approval (2009)—I believe because the project
exceeded their max parking. Because the State issued the water quality permit for this site, it is not enforceable by us
(in Eng or Stormwater). Don't know if this would be some sort of code enforcement violation.
Christine—The permit we have on file(SW8 090110)does assume credit for the pervious, but it was issued in 09,so
perhaps they permitted the change since then. If not,you might want to inspect. Thanks.

All proposed infiltration areas and existing, active utility lines located within the proposed
basin/trench must be marked and flagged. If these areas are not flagged, the Soils Scientist
reserves the right to decline to do the investigation. if the proposed infiltration system will be
located in an area of existing pavement and there is no open area nearby, equipment capable of
breaking through the impervious layer must be provided. The soils investigation does not take
the place of a soils report prepared by an appropriate professional. The Soils Scientist will only
verify the soil conditions that are reported in the Soils Report, and make a determination as to
the suitability of the site to meet the infiltration design requirements under NCAC 2H.1000, and
assumes no liability should the system fail.

ECS Carolinas, LLP (ECS) recently conducted an infiltration evaluation for the proposed
infiltration areas at the site located at 4017 Wilshire Boulevard in Wilmington,North Carolina.
This letter,with attachments,is the report of our evaluation.
Field Testing
On July 17, 2008 ECS conducted an exploration of the subsurface soil conditions at two
• requested locations shown on the attached Site Diagram. The test areas were located in the field
utiiliAng a boring location map provided by Withers & Ravenel. The purpose of this
exploration was to obtain subsurface information of the suitability of the in-place soils for the
proposed infiltration area. We explored the subsurface soil conditions by advancing one hand
auger boring into the existing ground surface at the two requested boring locations. We visually
classified the subsurface soils and obtained representative samples of each soil type
encomtered. We also recorded the seasonal high water level(SHWL) observed at the time of
each hand auger boring The : ® v, Infltration.Evaluation Form provides a summary of the
subsurface conditions encountered at each hand auger boring location.
The SHWL was estimated at each boring location below the existing grade elevation. Below is
a summary of each boxing location.

We have conducted two infiltration tests utilizing a compact constant head permeameter near
hand auger borings to estimate the infiltration rate for the subsurface soils. The infiltration tests
are typically conducted at two feat above the SHWL.
