Ellis Airport Deemed Permitted Stormwater Project/Session Law 2012-200 Onslow County Dear Mr. White: The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Albert J. Ellis Airport on October 11, 2016. The applicant has certified that the project's built-upon areas and stormwater treatment have been designed to meet the requirements of Session Law 2012-200. The applicant has indicated that all existing and proposed parking areas, roads, taxiways, terminal buildings, runways, aprons, etc., provide for overland flow and that infiltration and treatment of the stormwater in grassed buffers, shoulders and grass swales is promoted. As such, the project is deemed permitted pursuant to the State post-construction stormwater requirements. We are forwarding modified Permit No. SW8 931005 dated October 17, 2016, for the construction of the deemed permitted built-upon areas associated with the subject project. The modifications covered by this permit include the construction of 0.50 acres of additional built-upon area for a storage hangar and apron expansion. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supercede any other agency permit that may be required. This modification covers the construction of the General Aviation Terminal and Apron. The approved plans for this modification are added to the previously approved plans. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes. Per NCGS 143-215(e) the petition must be filed with the OAH within thirty (30) days of receipt of this permit. STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY DIVISION OF ENERGY, MINERAL AND LAND RESOURCES STATE STORMWATER MANAGEMENT PERMIT LOW DENSITY DEVELOPMENT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules and Regulations PERMISSION IS HEREBY GRANTED TO Albert J. Ellis Airport Director Albert J. Ellis Airport 264 Albert J. Ellis Airport Road, Richlands, Onslow County FOR THE construction, operation and maintenance of a 30% low density development in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwaterrules`) and the "deemed permitted" requirements of Session Law 2012-200 for Airports. The approved stormwater management plans and specifications, and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources, are considered a part of this permit. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. This permit covers the construction of a total of 129.40 acres of proposed built- upon area within a 676.88 acre project area. Prior to this modification, there was 99.01 acres of BUA permitted for the Airport. This modification adds 0.50 acres of built-upon area, resulting in a new permitted BUA amount of 99.51 acres equivalent to 14.7% of the total site area. This leaves 29.89 acres available for future development. 2. The overall tract built-upon area percentage for the project must be maintained at 30% or less, as required by Section .1005 of the stormwater rules. The tract is limited to a maximum of 203.06 acres of built-upon area. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. Per Session Law 2012-200, runoff from built-upon areas of the project must be maintained via overland flow that promotes infiltration and treatment of stormwater runoff into grassed buffers, shoulders, and grassed swales. Maximum side slopes shall be 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except that as shown on the approved plans. Projects covered by this permit will maintain a minimum 30-foot wide vegetative buffer between all impervious areas and surface waters. 2. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area under this permit. 3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4. The permittee shall not subdivide and/or sell any portion of the 676.88 acre project area, in whole or in part, unless and until the Division is notified of the sale and approval is granted. The new property owner shall be required to submit for and receive a permit to cover the development of that subdivided property. 5. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the permitted development, except.for average driveway crossings, is strictly prohibited by any persons. 6. Prior to the development of any future BUA or additional built-upon area in excess of the currently proposed 129.40 acres, a permit modification must be submitted to and approved by the Division. The modification must demonstrate that the built-upon area does not exceed the maximum amount permitted under this permit and that it meets the requirements of Session Law 2012-200. 7. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built-upon surface. 8. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 9. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size or scope. b. Redesign of the project's built-upon area or treatment. c. Further development, subdivision, or sale of any, all or part of the project area. d. Filling in, altering or piping any vegetative conveyance shown on the approved plan. e. Development of the designated future development areas. f. Additional built-upon area over and above 129.40 acres. g. Any changes that affect compliance with Session Law 2012-200. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and re-vegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 12. The permittee shall submit all information requested by the Director or his representative within the time frame specified in any written information request. III. GENERAL CONDITIONS 1. Any person or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules, is subject to enforcement action as set forth in NCGS 143, Article 21. 2. The permit issued shall continue in force and effect until modified, revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re-issuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Director at least 60 days prior to any one or more of the following events: a. An ownership change including the sale, subdivision, and/or conveyance of the project area in whole or in part, b. Bankruptcy, c. Foreclosure; d. Dissolution of the partnership or corporate entity; e. A name change of the current permittee; f. A name change of the project; g. A mailing address change of the permittee; 6. The permittee is responsible for compliance with all permit conditions until the Director approves a transfer of ownership. 7. The permittee grants permission to DEQ Staff to enter the property during normal business hours, for the purpose of inspecting all components of the stormwater management facility. 8. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state and federal), which have jurisdiction. I understand your concerns and hopefully, the explanation of my thought process will assist in making a decision. Storage Hangar Area Albert Ellis Airport wants to build additional hangar space, as clients make thems-elves available. In doing so, the buildings are usually encompassed by an impervious surface around the building. As in this case, the hangar apron is located on one side with parking facilities on two of the remaining sides; however, it is anticipated that future permit modifications will include parking facilities for future hangar expansions. Based on site constraints, surrounding grades, and impervious area, the roof drains cannot utilize overland flow. Based on the Session Law 2012-200, Senate Bill 229, the design should provide overland flow that promotes infiltration and treatment of stormwater runoff from the built upon areas into grassed buffers, shoulders, and grassed swales. The civil Engineers are proposing the collection of roof drains, into perforated pipe, before discharging to a grassed open conveyance. We are only piping the amount required to get to the open conveyance. From there, the water flows south then due west, within a grassed open conveyance, to a pipe crossing under the taxiway and runway, before the final discharge point that is within an open conveyance. Even though the roof drainage does not collect directly into an open conveyance, once discharged from the perforated pipe into the open conveyance, the water will flow for approximately 1,230 LF prior to discharging off of airport property. In this case, we are trying to also infiltrate by introducing the water straight into the subgrade. This was an approved method for the previous permit modification, the adjacent General Aviation Terminal Building roof drain system. I am including the soils map, as submitted within the original permit. I am also including the excerpt from the geotechnical report, summarizing the groundwater elevations. soils The U.S. Department of Agriculture, Natural Resources Conservation Service (NRCS) maps for Onslow County, North Carolina (see Soils Map, Figure 4) indicate that Goldsboro-Urban land complex mapping unit underlies the development area. Goldsboro-Urban land complex consists of 50% moderately well-drained Goldsboro i soil, about 30% Urban land, and soil that has been disturbed during urban development. Slopes range from 0 to 5 percent. Goldsboro-Urban land complex is hydrologic soil type "B". This soil type has high infiltration properties. Groundwater Geotechnicai reports show groundwater measurements of 0.1 to 7 feet below existing ground and an estimated seasonal high groundwater table of 1 to 2 feet below existing ground. In the area of the storage hangar, the site had structural fill brought in to a depth of five to six feet above the existing ground. Therefore, the perforated pipe location is approximately three to four feet above seasonal high groundwater elevation. Apron Expansion Area As mentioned below, an additional perforated pipe and catch basin was added to assist in the 48 hour draw down, as required by the FAA. Prior to the apron expansion, the water had a shortest flow path of approximately 150 LF of overland flow, prior to reaching the drainage inlet. As proposed, the shortest flow path will be approximately 50 LF of overland flow at 1.5-5% slope, prior to reaching the drainage inlet. According to Chapter 13 Public Airports BMP Toolbox of the NCDENR Stormwater BMP Manual, this width and slope exceed the minimum requirements for filter strips in North Carolina. The additional pipe and inlet are additional to the required pipe needed to cross under the roadway. Once out falling from the roadway pipe crossing, the water will flow in a grassed swale for approximately 2,096 LF prior to discharging off of airport property. The overland flow and grassed swale provide a treatment train that will both infiltrate and treat stormwater before discharging off airport property. See the sketches embedded in the email below. We had previously approved some BUA additions to the Albert Ellis Airport under the Session Law, but apparently the contractor decided that the area wasn't draining within the 48 hours as required by the FAA and added some additional catch basins and perforated piping without any Division approval. I don't think this qualifies as meeting the sheet flow requirement. My take on this is that the "sheet flow" referred to in the SL is intended to be that the runoff from the runways and taxiways will sheet flow off tand then go over vegetated areas and into vegetated ditches. It was not intended to allow sheet flow over a paved area and then to dump that sheet flow across a few feet of grassed slope and then into a proposed or an existing piped collection system. This appears to be the way Albert Ellis' design consultants have approached meeting the SL for all of their construction at Albert Ellis, not just runways and taxiways. I feel powerless to stop them because of the ambiguous wording about "other areas" covered by the SL and because there is no set amount of grassed area to sheet flow over specified in the SL At Albert Ellis, they keep adding more BUA for hangar builders, not runways or taxiways, clustered into areas that are already high density that have a bunch of existing piped collection systems that they just keep extending as they add more BUA. They insist it is in keeping with the SL because they use perforated piping and they allow for a little bit of overland sheet-flow and/or conveyance in a short grassed swale before the runoff is picked up by a drop inlet and extended piped collection system. I'm leaning toward requiring them to design and permit the perforated piping as an infiltration trench. The reason for the additional pipe was the "flat/minimal grades" located to the right of the utility corridor (blue line). The utility corridor was located shallower than anticipated due to the minimal required slopes, utility separation, and minimal cover required. This did not allow for this area to drain within the required 48 hour period, as required by the FAA. The contractor installed the perforated pipe, as per the approved BMP items for this project. As you can see, the piping is only to collect from the drainage basin and cross under the road to the existing open conveyance system. It does not enter a closed system after the discharge. I apologize that this is the first you have seen of it. For the permit revision just submitted, no new revisions will be made to the perforated pipe or inlet. 4 For Item #2, as stated in the NCDENR State Stormwater Permit Modification for Permit No. SW8 931005 dated January 29, 2015,4.45 acres were approved for the new permitted BUA amount. As mentioned during yesterday's meeting, both the narrative and the area calculations do not clearly identify the BUA breakdown. SW8 931005 issued on May 2, 2013. Per Section 11.10.e of permit No. SW8 931005, this project is development of the designated future development areas. Refer to Figure 2 Albert J. Ellis Airport Proposed& Future Development Phases as submitted with the permit modification approved on May 2, 2013. The apron expansion and storage hangar locations are shown in Figure 2. All runoff from the apron expansion built-upon area flows over grassed buffers/shoulders and into existing grassed swales. Existing swale side slopes are maintained at 3:1 or flatter. All runoff surrounding the storage hangar will sheet flow away from the hangar. Due to site constraints, roof drains from the building cannot utilize overland flow. Instead, the design utilizes a perforated underdrain system to allow exfiltration into the existing soils and treatment of the roof drainage. This is very similar to the system permitted for the General Aviation Terminal building roof drainage. There are no other underground piping systems. The proposed project meets the requirements of Session Law 2012-200, Senate Bill 229. The design provides overland flow that promotes infiltration and treatment of stormwater runoff from the built upon areas into grassed buffers, shoulders, and grassed swales. No built upon areas are directly connected to a pipe system without first utilizing overland flow or underdrain exfiltration. The natural flow paths and outfalls of the project are preserved in the proposed design. The proposed projoct utilizes Best Management Practices (BMPs) identified in Chapter 13 for Airports in the DENR BMP manual. Those BMPs are: • Disconnected Impervious Area/Overland flow Disconnected Impervious Area/Overland Flow — The proposed site was graded to match existing grades and slopes as much as possible. Most slopes are less than 3%. This BMP is utilized for stormwater runoff from the BUA associated with all surfaces. Research has shown that the majority of the pollutant removal occurs in the first 8 feet of overland flow. For all surfaces, at least 20 feet of overland flow has been provided between the BUA and the existing open conveyance. Maintenance of this area consists of routine maintenance and preservation of the stand of grass. Conclusion The proposed Apron Expansion and Storage Hangar project is revising State Stormwater Management Permit No. SW8 931005 by adding 0.50 acres of BUA. The proposed project complies with the requirements of Session Law 2012-200, Senate Bill 229, which allows for the proposed activities to be deemed permitted. 2 ALBERT J. Soil amendments typically increase infiltration rates by introducing coarse-grained, washed sand amendments into the in-situ soil. Soil amendments will improve infiltration by increasing soil pore spacd near the surface. Soil amendments are typically installed by tilling sand-size particles into the existing soil up to a depth of 12 to 18 inches. A backhoe (or similar shovel-based machine)may be utilized.An under drain can be included in the design to allow the soil to drain between storm events. Soil amendments can be sized to provide volume control, depending on the ratio of impervious area to the area that receives the stormwater runoff. If soil amendments are incorporated,they should be considered as a supplement to, or performance enhancer for, filter strips and swales. 13.8 Low Density Projects (T15A: 02H .1003 (d)(1)) Projects permitted as low density projects must be designed to meet and maintain the applicable low density requirements specified in T15A: 02H .1005 through .1007. Under the current Phase II and Coastal Rules (Session Law 2008-211 and Session Law 2006-246), a project with an overall density at or below the low density thresholds, but containing areas with a density greater than the overall project density,may be considered low density as long as the project meets or exceeds the following post-construction model practices for low density projects mandated in Session Law 2006-246 and 2008-211: • Use vegetated conveyances to the maximum extent practicable to transport stormwater runoff. Pipe conveyance is minimized. • Locates the higher density areas are located away from surface waters and drainage ways to the maximum extent practicable, i.e., disconnects surfaces,promotes infiltration, sheet flow, and overland flow, and lengthening flow paths to the maximum extent practicable. • Stormwater runoff from built upon areas that is directed to flow through any wetlands shall flow into and through these wetlands at a non-erosive velocity Development designed to meet the low density requirements must demonstrate that no areas within the project site are of such high density that stormwater runoff threatens water quality. 13.9 High Density Projects (T15A: 02H.1003 (d)(2)) Projects permitted as high density projects must be designed to meet the applicable high density requirements specified in 02H .1005 through 02H .1008. Paragraph (c)(5) does allow for other designs if these designs are shown by the applicant,to the satisfaction of the Director,to provide equivalent protection. Also, under 02H .1008 (h) stormwater management systems consisting of other control options or.series of control options may be approved by the Director on a case-by-case basis where the applicant can demonstrate that the Alternative Design Criteria provides equal or better stormwater control, equal or better protection of waters of the state, and result in no increased potential for nuisance conditions. Ellis Airport, a hangar associated with the General Aviation (GA) Terminal and Apron plans and permit is moving forward (see attached PDF). For the GA Terminal,we did a plan revision to the State Stormwater Management Permit No. SW8 931005, which included anticipated BUA for the proposed hangar (see attached PDF). The actual design of the new hangar has resulted in -0.1 acre more than we had included in the BUA for the GA Terminal plan revision. All stormwater runoff surrounding the hangar will sheet flow away from the hangar. Due to site constraints, roof drains from the building cannot utilize overland flow. Instead, the design utilizes a perforated underdrain system to allow exfiltration into the existing soils and treatment of the roof drainage.
