This permit correction is to clarify that this project is owned by Onslow County,the property owner for the duration of this permit. Minor Modification On November 4,2021,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources received a complete minor modification application for changes to the approved plans for Stormwater Management Permit Number SW8 931005. It has been determined that the nature of the proposed change meets the definition of a minor modification in that it does not result in an increase hi the size of stormwater control measure(SCM)and does not increase the amount of built-upon area. Please refer to Attachment C for a detailed desc,4 iption of the current proposed minor modification and a list of all the past modifications approved during the effective period of the permit We are forwarding you an approved copy of the modified plans for your files. Please add the attached plans to the previously approved plan set Please replace the previously issued permit with the revised permit,dated November 5,2021,attached. Ellis Airport, Onslow County Albert J. Ellis Airport 264 Albert J. Ellis Airport Road, Richlands, Onslow County FOR THE construction, operation and maintenance of a 30% low density development in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the "deemed permitted" requirements of Session Law 2012-200 for Airports as outlined in the application, approved stormwater management plans, supplement, calculations, operation and maintenance agreement, recorded documents, specifications, and other supporting data (the "approved plans and specifications") as attached and/or on file with and approved by the Division of Energy, Mineral and Land Resources (the "Division" or"DEMLR"). The project shall be constructed, operated and maintained in accordance with these approved plans and specifications. The approved plans and specifications are incorporated by reference and are enforceable part of this permit. This permit shall be effective from the date of issuance until rescinded and shall be subject to the following specified conditions and limitations. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission; however, these actions do not stay any condition. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the laws, rules, and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143-215.1 et.al. I. DESIGN STANDARDS 1. This permit covers the construction of a total of 129.50 acres of proposed built-upon area within a 676.88-acre project area, which includes 26.5 acres of BUA available for future development. 2. The overall tract built-upon area percentage for the project must be maintained at 30% or less, as required by Section .1005 of the stormwater rules. 3. Per Session Law 2012-200, runways, taxiways and any other areas that provide for overland stormwater flow that promotes infiltration and treatment of stormwater into grassed buffers, shoulders and grass swales, are deemed permitted. All built-upon areas of the project must be maintained to meet the requirements of SL 2012-200. 4. Maximum side slopes for all grassed swales shall be 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 5. No piping is allowed except that amount as shown on the approved plans. Page 1 of 5 State Stormwater Management Systems Permit No. SW8 931005 II. SCHEDULE OF COMPLIANCE 1. Projects covered by this permit will maintain a minimum 30-foot wide vegetative buffer between all impervious areas and surface waters. 2. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area under this permit. 3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the permitted development, except for average driveway crossings, is strictly prohibited by any persons. 5. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built- upon surface. 6. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. A modification may be required for those deviations. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 8. No person or entity, including the permittee, shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications, and calculations including, but not limited to, those listed below. For changes to the project or SCM that impact the certifications, a new or updated certification(s), as applicable, will be required and a copy must be submitted to the appropriate DEQ regional office upon completion of the modification. a. Any modification to the approved plans and specifications, regardless of size including the SCM(s), BUA, details, etc. b. Redesign or addition to the approved amount of BUA or to the drainage area. c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project and/or property area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any component of the approved SCM(s), the stormwater collection system and/or vegetative conveyance shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement, #57 stone area, public trails, or landscaping material to be considered a permeable surface that were not included in the approved plans and specifications. g. Additional built-upon area over and above 129.40 acres. h. Any changes that affect compliance with Session Law 2012-200. i. Other modifications as determined by the Director. 9. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at the design condition to include: a. Inspections b Sediment removal. c. Mowing, and re-vegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. Page 2 of 5 State Stormwater Management Systems Permit No. SW8 931005 10. The permittee shall submit all information requested by the Director or his representative within the time frame specified in any written information request. 11. ANNUAL CERTIFICATION. The permittee shall electronically submit to the Division an annual certification completed by either the permittee or their designee confirming the projects conformance with permit conditions. III. GENERAL CONDITIONS 1. CORRECTIVE ACTIONS REQUIRED. If the facilities fail to perform satisfactorily, the permittee shall take immediate corrective actions. This includes actions required by this Division and the stormwater rules such as the construction of additional or replacement on-site stormwater systems. These additional or replacement measures shall receive a permit from the Division prior to construction. 2. CURRENT PERMITTEE NAME OR ADDRESS CHANGES. The permittee shall submit a completed Permit Information Update Application Form to the Division within 30 days to making any one or more of the following changes: a. A name change of the current permittee; b. A name change of the project; c. A mailing address change of the permittee; 3. TRANSFER. This permit is not transferable to any person or entity except after notice to and approval by the Director. Neither the sale of the project and/or property, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. a. TRANSFER REQUEST. The transfer request must include the appropriate application, documentation and the processing fee as outlined in 15A NCAC 02H.1045(2). This request must be submitted within 90 days of the permit holder meeting one or more of the following: i. A natural person who is deceased; ii. A partnership, limited liability corporation, corporation, or any other business association that has been dissolved; iii. A person or entity who has been lawfully and finally divested of title to the property on which the permitted activity is occurring or will occur through foreclosure, bankruptcy, or other legal proceeding. iv. A person or entity who has sold the property, in whole or in part, on which the permitted activity is occurring or will occur; b. TRANSFER INSPECTION. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on-site stormwater system complies with the permit conditions. Records of maintenance activities performed to date may be requested. Projects not in compliance with the permit will not be transferred until all permit and/or general statute conditions are met. 4. COMPLIANCE. The permittee is responsible for compliance with the terms and conditions of this permit until the Division approves the transfer request. a. APPROVED PLANS AND SPECIFICATIONS. A copy of this permit, approved plans, application, supplement, operation and maintenance agreement, all applicable recorded documents, and specifications shall be maintained on file by the permittee at all times. b. DIVISION ACCESS. The permittee grants Division Staff permission to enter the property during normal business hours to inspect all components of the permitted project. c. ENFORCEMENT. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the Page 3 of 5 State Stormwater Management Systems Permit No. SW8 931005 stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. d. OBTAINING COMPLIANCE. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of modified plans and certification in writing to the Director that the changes have been made. e. OTHER PERMITS. The issuance of this permit does not preclude the permittee from complying with and obtaining any other permits or approvals that are required for this development to take place, as required by any statutes, rules, regulations, or ordinances, which may be imposed by any other Local, State or Federal government agency having jurisdiction. Any activities undertaken at this site that cause a water quality violation or undertaken prior to receipt of the necessary permits or approvals to do so are considered violations of NCGS 143- 215.1, and subject to enforcement procedures pursuant to NCGS 143-215.6. Ellis Airport RSI1 Taxiway A Rehabilitation Erosion and Sedimentation Control Permit EXECUTIVE SUMMARY Project Description Albert J. Ellis Airport is located is located 6 miles southwest of Richlands, NC in Onslow County. The main entrance for the airport is Albert J. Ellis Airport Road,which serves as a loop road for the airport and ties into North Carolina Route 111. See Figure 1 —Site Vicinity Map. Figure 1 —Site Vicinity Map til 9 N,J1 lM1rx,n Albert J. Eitiz Airport [ e tr t t M-' X Onslow County, owner and operator of the Albert J. Ellis Airport (OAJ) has retained RS&H Architects-Engineers-Planners, Inc.(RS&H)to provide civil engineering and design services for the rehabilitation of Taxiway Alpha (A). The overall program includes milling and overlaying asphalt pavement and the construction of a new hold bay. Refer to Figure 2 in Appendix A for the Overall Project Map. The project is ten phases to be completed in 120 days. Herein, the rehabilitation of Taxiway A will be referred to as either"Taxiway A", "taxiway rehab", or"the project" (See Figure 2 in Appendix A). The project location is at 34.82835 degrees N and 77.594478 degrees W. Site Description Taxiway A is of fairly level grade throughout the site.The only area disturbed during this project will be the construction of the new hold bay and contractor staging and parking areas. The area on which the hold bay will be constructed is of minimal grade and its final grade will be 1%. The entire project limits are owned by Onslow County, and the project area is surrounded by land owned by the County. 1 Albert J. Ellis Airport Taxiway A Rehabilitation Erosion and Sedimentation Control Permit EXISTING CONDITIONS The airport property is located within the Cape Fear River Basin and White Oak River Basin. The majority of the drainage for the project flows to existing open conveyance ditches which then flow into existing culverts undermining pavement which then daylight into more existing ditches, eventually flowing off airport property. The hydrologic parameters of the existing basins within the project area are summarized below in Table 1. Refer to Figure 3 in Appendix A for the Existing Drainage Basin Conditions. Existing Conditions Discharge Based on the existing pervious and impervious areas for drainage areas within the project site,the Rational Method was used to calculate the peak discharge for the 2-year and the 10-year design storms. Refer to Appendix A for Supporting Calculations for additional information. CONSTRUCTION CONDITIONS Basin Description The existing basin conditions for the project area consists of 23.83% BUA. The open conveyances for the project area lead to piped conveyance systems that exit the airport property. Current surface water discharge causes no noticeable erosion or sedimentation problems in the area,and the main drainage patterns will be maintained throughout the construction process and remain in place after construction. 2 Albert J. Ellis Airport Rsasi Taxiway A Rehabilitation Erosion and Sedimentation Control Permit Construction Runoff Conditions The runoff calculations for the site during construction have taken the following assumptions into consideration: 1. All proposed grading and paving complete 2. All pervious areas denuded and awaiting cover 3. Peak runoff rates do not consider flow losses due to erosion control devices Considering that there are few major drainage changes during the project and considering the assumptions above, the construction run off condition will mirror that of the post-construction conditions. See Appendix A for runoff calculations. Prescribed Construction Approach The limits of disturbance are completely confined within the project limits with the exception of the staging area, intermediate equipment storage area, and contractor employee parking area. All areas are included in the limits of disturbance.The staging area will primarily serve as staging and storage for contractor equipment and is currently an established permeable area.This area will not disturb more than 0.5 acres of land. As a precautionary measure,silt fencing will be placed around the staging area for the duration of the project to prevent any erosion.All prescribed erosion control devices shall be installed prior to the start of land disturbing activity following the details and methods in the Contract Documents as well as the NC DEQ Erosion and Sedimentation Design Manual. Haul routes used during the project are established impervious private airport roads.Since no disturbance is expected on the hauling and access routes since they are well established and paved, silt fencing will not be initially placed. However, silt fence will be on site and available as needed to be placed along the access and hauling roads if disturbance and erosion does occur. The Contractor is required to immediately control all erosion on access roads if disturbance occurs. For the project area, given the sensitive nature of an active airfield and strict FAA requirements for active runway and taxiway operations and since overland flow is the primary source of infiltration, large groups of inlets have been defined as the project drainage basins. Erosion control methods requiring ponding of water act as wildlife attractants and create hazardous conditions for active aircraft operations.The FAA has strict regulations prohibiting this practice where possible per FAA Advisory Circular (AC) 150/5200-33B Hazardous Wildlife Attractants on or Near Airports. Due to the proximity to an active taxiway and runway during this project,sediment traps, basins, and other surface dewatering devices are not practical or safe to implement. This decision is allowed and supported by N.C.G.S 143-214.7(c3) which states, "In accordance with the Federal Aviation Administration August 28, 2007, Advisory Circular No. 150/5200-33B (Hazardous Wildlife Attractants on or Near Airports), neither the Department nor any local government shall require the use of stormwater retention ponds, stormwater detention ponds, or any other stormwater control measure that promotes standing water in order to comply with this section, or in order to comply with any local ordinance adopted under G.S. 143-214.5, at public airports that support commercial air carriers or general aviation services." The project,totaling just over 3.56 acres of disturbed area which includes the staging, storage, and contractor parking areas, has been phased in ten phases. 3 Albert J. Ellis Airport r?S6H Taxiway A Rehabilitation Erosion and Sedimentation Control Permit See Attachment No. 1 — Phasing Plan for the project phasing. See Appendix A for drainage basin maps and a drainage basin summary. The drainage basins will not be changing once construction is completed.All infield inlets are to have well-established turf prior to entering the inlet which serves as erosion control. The contractor is also required to limit the amount of disturbed area to less than one acre per the attached erosion control plans at any given time. Regular maintenance and sediment removal is required each week and after storm events of all erosion control devices at a minimum. The Contractor is also required to place compacted aggregate immediately after soil disturbance in areas where new pavement is being placed. The majority of the disturbed area that is not paved of the project is land grading and will be sodded. Upon completion of the project and once all disturbed areas are permanently stabilized, the Contractor shall remove the erosion control devices along with all accumulated sediment. No dewatering is needed given the nature of the erosion control devices being utilized. Areas disturbed by the erosion control devices shall be permanently seeded and restored to their original state. SUPPORTING CALCULATIONS Refer to Appendix A for all runoff calculations and results. PLANNED EROSION AND SEDIMENTATION CONTROL PRACTICES 1. Land Grading — Practice 6.02 Grading will be required for 2.64 acres of the disturbed area. See Attachment No. 3 — Erosion and Sedimentation Control Plans and Details. There are strict FAA requirements in place requiring flatter slopes for aircraft operational safety. All cut slopes will be 25% or flatter to avoid instability due to wetness, provide fill material, and allow vegetated slopes to be mowed. 2. Permanent Seeding — Practice 6.11 The contractor staging and parking areas will be seeded upon completion the project. A centipedegrass seed will be spread into place in the entirety of the staging and parking areas. See Attachment No.3—Erosion and Sedimentation Control Plans and Details for exact locations. 3. Sodding — Practice 6.12 Ditch bottoms and pervious areas around the new hold bay will be sodded upon completion of final grade and project. A NC State Certified centipedegrass shall be utilized. See Attachment No. 3 — Erosion and Sedimentation Control Plans and Details for exact locations. 4 Albert J. Ellis Airport RSa1 Taxiway A Rehabilitation Erosion and Sedimentation Control Permit 4. Rolled Erosion Control Products — Practice 6.17 Rolled Erosion Control Products will be installed on ditch bottoms and the steepest slope grading to protect and facilitate the growth of seed and sod. See Attachment No. 3 — Erosion and Sedimentation Control Plans and Details for exact locations. 5. Temporary Silt Fence — Practice 6.62 Sediment/silt fence shall be installed to retain sediment from small disturbed areas by reducing the velocity of sheet flows to allow sediment deposition. Temporary Silt Fence will be installed as an around all grading and staging and parking locations. Silt fencing will have collected sediment removed as needed. 6. Check Dam — Practice 6.83 Check dams will be used as a temporary measure to limit erosion by reducing the velocity of flow in the airport's open conveyance ditches. The contractor shall be required to clean the dams of collected sediment regularly. See Attachment No. 3 — Erosion and Sedimentation Control Plans and Details for exact locations. 7. Dust Control — Practice 6.84 Dust control could be a possible problem due to the large project site and the sensitivity to pilots.The contractor shall be required to control the site by the use of sprinkling. The site will be sprinkled as required or at the owner's or engineer's request. MAINTENANCE PLAN The following notes are for the maintenance and control of the temporary erosion and sedimentation devices: 1. All erosion and sediment control practices will be checked for stability and operation following every runoff-producing rainfall; however, at a minimum of once a week should there be no run-off producing rainfall.Any repairs will be made immediately to maintain all practices as designed. 2. Sediment will be removed from the check dams and the gravel will be replaced when storage capacity has been approximately fifty percent (50%)filled. Gravel will be cleaned or replaced when the dam no longer drains properly. All check dams will be inspected weekly, at a minimum, and after each storm event. 3. Sediment will be removed from behind the sediment fence if it becomes about six inches (6") deep at the fence. The sediment fence will be repaired as necessary to maintain a 5 Albert J. Ellis Airport RS6H Taxiway A Rehabilitation Erosion and Sedimentation Control Permit barrier. The following notes describe the maintenance plan for the completed surface water management system (post construction erosion and sedimentation control) 1. All vegetated channels will be mowed to a level of two to three inches in height. All necessary yearly maintenance including fertilizer will be conducted on a regular basis to keep a healthy and vibrant vegetative channel. 2. Any erosion observed during regular maintenance will be immediately corrected to match proposed design. Proposed Construction Commencement: September 2021 Proposed Construction Duration:4 months Contact for Erosion and Sediment Control: Chris White, Onslow County VEGETATIVE PLAN General Millet grass is expressly prohibited from use anywhere on the project. Fertilizer The quality of all fertilizer and all operations in connection with the furnishing of this material must comply with the requirements set forth by the FAA in effect at the time of sampling.All fertilizer will be subject to sampling and testing by the Engineer. Dry fertilizer shall be manufactured from cured stock. Care for the fertilizer during handling and storing in such a manner that it will be protected against hardening, caking, or loss of plant food values. Pulverize any hardened or caked fertilizer to its original condition before being used. Store and care for liquid fertilizer after manufacture in a manner that will prevent loss of plant food values and maintain or reblend a homogeneous blend of plant food elements to the original condition immediately before use. Catalogue data and certification showing that the guaranteed analysis of the fertilizer meets FAA requirements is to be submitted by the Contractor. Limestone The quality of all limestone and all operations in connection with the furnishing of this material must comply with the requirements set forth by the FAA in effect at the time of sampling. All limestone will be subject to sampling and testing by the Engineer. 6 Albert J. Ellis Airport nal Taxiway A Rehabilitation Erosion and Sedimentation Control Permit All limestone shall contain not less than 85 percent calcium carbonate equivalents. Grade limestone so that at least 90 percent will pass through a U.S. Standard 20 mesh (0.850 mm) screen and at least 50 percent will pass through a U.S. Standard 100 mesh (0.15 mm) screen. During handling and storing, care for the limestone in such manner that it will be protected against hardening or caking. Pulverize any hardened or caked limestone to its original condition before being used. Seed The quality of all seed and all operations in connection with the furnishing of this material shall comply with the Federal Specification JJJ-S-181 and with the rules and regulations,adopted by the FAA in accordance with said law,in effect at the time of sampling,and with the quality requirements of the Standard Specifications.All seed will be subject to sampling by the Engineer.Supplementary testing for seed germination may be performed by the Engineer. Water Water used in the planting or care of vegetation must be obtained from a fresh water source and shall be free from injurious chemicals and other toxic substances harmful to plant life. The Contractor shall identify to the Engineer all sources of water for approval. Repairing When the surface has become bullied or otherwise damaged during the period covered by this contract,the affected areas shall be repaired to re-establish the grade and the condition of the soil, as directed by the Engineer or owner. POST CONSTRUCTION CONDITIONS Basin Delineation and Drainage Patterns The proposed design increases the amount of impervious area by 2.75% and uses the existing ouffalls for drainage. Currently, there are 57.83 acres of impervious area contained in the delineated basins that contain the project site.The proposed design increases the total impervious area to 59.42 acres. See Figure 3 in Appendix A for the Proposed Drainage Basins Exhibit. NRCS Soils and Runoff Coefficients The majority of the proposed soil strata for this site will be composed of the re-graded existing soil material or soil of like characteristics. Therefore, proposed soils will be taken as equivalent with the existing. Because the proposed, re-graded soil material will be the re-graded existing material or soil of like characteristics, similar runoff coefficients were used for basin runoff calculations. 7 Albert J. Ellis Airport RSII Taxiway A Rehabilitation Erosion and Sedimentation Control Permit Treatment Requirement Summary The proposed project has been designed to meet the requirements of Session Law 2012-200.This permit covers the construction of 1.46 acres of paved upon area within the airport property. This results in a net increase of impervious area of 1.46 acres. Using the design criteria established for the site and the current BMP toolbox for airport developments, some BMP's were identified as suitable for use at OAJ. Those BMP's are: • Open Conveyances • Disconnected Impervious Area/Overland flow Open Conveyances—This BMP has been utilized to the maximum extent possible on the airfield. The existing swales on the site have proven to me suitable and maintainable by the Airport. They have also been shown to be effective at removing pollutants and suspended solids from average storm events. Maintenance of these features consists of routine mowing and removal of trash and other debris. Disconnected Impervious Area/Overland Flow — FAA grading criteria governs the width and slope of the areas immediately adjacent to runways,taxiways and aprons. These areas, known as shoulders and safety areas, are relatively flat(less than 5%)and in most cases wider than the area flowing to them.All impervious area within the project limits flows over a turf area of varying widths prior to entering the storm drain system. Proposed Conditions Discharge Based on the proposed pervious and impervious areas for drainage areas within the project site, the Rational Method was used to calculate the peak discharge for the 2-year and the 10-year design storms.Refer to Supporting Calculations for additional information.The proposed conditions do not change the existing basin configurations. CONCLUSION The rehabilitation of Taxiway A at Albert J. Ellis Airport will enhance the ability for the airport to serve current and future patrons, creating a better and safer environment for all travelers. This program will be an important step in maintaining the status as a premier airport for commercial and general aviation traffic. 8 1.1 PROJECT DESCRIPTION Albert J. Ellis Airport(OAJ) is located in Onslow County, North Carolina, approximately 12 miles northwest of the City of Jacksonville, North Carolina, at the intersection of North Carolina State Route 111 and Albert Ellis Airport Road.
