Dear Mr. Nichols,
Division of Water Resources’ Central and Regional staff have reviewed the application package
received on April 29, 2024. However, the Division requires additional information before completing our
review. Please address the items on the attached pages no later than the close of business on August 9,
2024.
Please be aware that the Applicant is responsible for meeting all requirements set forth in North
Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the
review of the subject application package. The Division may return the application as incomplete pursuant
to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in
Sections A through P or the Applicant fails to provide the additional information on or before the above-
requested date.
Please reference the subject application number when providing the requested information. The
Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and
submit an electronic response to my attention via the Non-Discharge online portal.

A. Overall:
1. Condition III.24 of the Final Permit issued on August 27, 2019, requires the Permittee to maintain
a Reuse Water Agreement (Agreement) with Chinaway Corporate Development, LLC, for the
continued operation of the dedicated utilization system located on three golf courses at Sea Trail
Plantation (Maples Course, Byrd Course, and Jones Course) to ensure that the subject facility has
a permanent disposal capacity. Additionally, the Permittee shall send any modification or renewal
of the Agreement to the Wilmington Regional Office (WiRO). The Brunswick County GIS portal
shows that property ownership of these three golf courses was transferred in 2024 from Chinaway
Corporate Development, LLC, to Sea Trail Golf Resort Holdings, LLC. However, the
documentation provided in the application package is not consistent with this change and lists
Chinaway Corporate Development, LLC, as the current owner except for the revised Site Map.
Please provide the appropriate property ownership documentation for Sea Trail Golf Resort
Holdings, LLC, pursuant to Condition III.24 and ensure that any supplemental documentation
meets the requirements of 15A NCAC 02L .0107(k) (pursuant to Condition II.13 of the Final Permit
issued on August 27, 2019), 15A NCAC 02U .0201(e), and is filed with the Brunswick County
Register of Deeds.
2. Mr. Jordan M. Cocanower and Mr. Bryan K. Lievre of the WiRO conducted a site visit on May 24,
2024, and noted that the two (2) manual bar screens, static screen, and grit removal system for both
treatment trains listed in the Facility Description of the Final Permit issued on August 27, 2019,
have been removed and are no longer being utilized. Previous permit issuances do not document
a modification for the permanent abandonment of these facilities. How are the treatment trains
removing solids and grit prior to flow leaving the aerated flow equalization basins? Please provide
a revised plan sheet and/or Engineering Certification from a North Carolina licensed Professional
Engineer (PE) pursuant to 15A NCAC 02U .0116 along with a revised Cover Letter detailing the
permanent abandonment of these facilities.
