12, issued 11/05/2015 (SAW -2015-01676). Please note that since the proposed project does not
result in permanent wetland impacts, written authorization from NCDWR is not required, and this
PCN is being provided as a courtesy. Since this is a municipal project, we are requesting an email
from NCDWR confirming that written authorization is not required so that we have written
documentation for our files.
The proposed project is located in Sanford, Lee County, North Carolina. The proposed sewer
alignment crosses Persimmon Creek and its associated tributaries, which are located within the
Cape Fear Basin (HUC 03030003). The Water Quality Classification for Persimmon Creek is Class
C and the Stream Index number is 17-40-2.
Proposed Project
The proposed project consists of the construction of ±7,750 If of 8" gravity sewer. The proposed
sewer line will be located within a 30' easement with a 10' permanent access/maintenance corridor
through wetlands. The proposed sewer line will begin at an existing sewer line west of Chownings
Drive in the Carthage Colony Subdivision (Latitude: 35.452789°N; Longitude: -79.197266°W) and
will cross Persimmon Branch and flow in a southwest direction to an existing sewer line at 2255
Tramway Road (Latitude: 35.438042°N; Longitude: -79.217304°W) in Sanford, Lee County, North
Carolina.

for construction of the sewer line. The NWP 12 also authorized 0.524 acres of permanent wetland
conversion impacts associated with the permanent access/maintenance corridor for the easement.
A Preliminary JD was issued in conjunction with issuance of the NWP 12, which approved the
wetland delineation specific to the impact areas only.
After lengthy negotiations with property owners to obtain utility easements on private property,
certain property owners refused to grant an easement to the City of Sanford, resulting in the
relocation of the sewer alignment. The relocation of the sewer alignment pushed the alignment
further uphill, resulting in a significant decrease in the overall impacts to streams and wetlands,
resulting in a need for modification of the NWP 12 to reflect the currently proposed impacts.
The delineation for the southernmost portion of the alignment (Tramway One, LLC property) was
conducted by John Davis of (Soil Horizons, LLC) and approved by Andy Williams with the USACE
on September 3, 2015. The impacts depicted on Exhibits 5 and 6 (Temporary Impacts 9, 10, and 11)
are within this portion of the alignment.
Proposed Impacts
The proposed impacts resulting from the realignment of the sewer line consists of ±0.159 acres of
temporary wetland impacts and 177 If of temporary stream impacts for construction of the sewer
line. All proposed impacts will occur within a 30' construction corridor.
Contained entirely within the 30' construction corridor is a 10' permanent access/maintenance
corridor. The proposed 10' permanent access/maintenance corridor will result in the permanent
conversion of forested wetlands to herbaceous wetlands as a result of regular
mowing/maintenance of the corridor, resulting in ±0.041 acres of permanent conversion impacts.
The previous NWP 12 authorized the permanent conversion of the entire 30' easement for the
permanent maintenance/access corridor, and the proposed permanent maintenance corridor has
been reduced to 10'.
Avoidance and Minimization - Modified Impacts
Due to realignment of the proposed sewer corridor, the temporary wetland impacts have been
reduced from ±1.2 acres of temporary wetland impacts to ±0.159 acres, and temporary stream
impacts have been reduced from ±182 If to ±177 If.
Several impacts previously permitted have been eliminated or reduced. Original Impacts 4-6 and
7-8 have been eliminated, avoiding five wetland impacts totaling0.079 acres and one stream impact
of 59 If. Original impacts 9 - 10 have been eliminated, avoiding 0.488 of wetland impact. Original
impacts 12 & 13 have been eliminated, avoiding 0.816 acres of wetlands. Original impacts 17-19
have been eliminated, avoiding 0.068 acres. Proposed modified impacts 9-11 are in a new impact
area; however, these proposed impacts have been minimized to 0.007 acres.
Additionally, the modified 10' permanent access/maintenance corridor will result in a reduction
from ±0.524 acres of permanent conversion impacts to ±0.041 acres of permanent conversion
impacts.

Please note, as required in Section 13 of NWP 12, temporary fills will be removed in their entirety
and the affected areas returned to pre -construction elevations. The affected areas will be
revegetated with a wetland seed mix.
Mitigation
Because the proposed impacts for construction of the sewer line are temporary, no mitigation is
proposed for these impacts.
The USACE requires mitigation for permanent wetland conversion impacts exceeding 0.10 acres.
This modification reduces the permanent wetland conversion impacts from ±0.52 acres to ±0.041
acres, therefore no mitigation is required for the reduced impacts.
The current request is for modification of the existing NWP 12 (SAW -2015-01676), requesting
authorization for ±0.159 acres of temporary wetland impacts and 177 If of temporary stream
impacts (see the attached revised impact maps and Revised PCN for details).

The project alignment is located entirely within undeveloped woodlands. The general land use in the vicinity of the project
consists of a mixture of residential and commercial land uses, as well as agricultural and undeveloped woodlands.

The purpose of the proposed gravity sewer is to provide service to the new VA Clinic and the Liberty Health Care Facility.
The proposed 8-inch gravity sewer line will extend from the existing sewer at Carthage Colonies subdivision to a new VA
Clinic located on Tramway Road in the City of Sanford. The VA Clinic will house offices for 15 practitioners with a
projected flow of 3,750 gpd. The project will also eliminate a private pump station serving the Liberty Health Care Facility
that is currently permitted to pump 13,650 gpd to another sewer shed within the City of Sanford collection system.

The project consists of the installation of 7,750 If of 8" gravity sewer line, which will extend from the new VA Clinic on
Tramway Road to the existing sewer line at Carthage Colonies subdivision. The utility will be installed using traditional
excavation and installation techniques. Typical commercial clearing, grading, and excavation equipment will be used to
install the utility line within the alignment.

The Corps of Engineers issued a Preliminary JD for the previously permitted impact areas in conjunction with issuance of
the NWP 12 previously issued for this project. (SAW -2015-01676). The proposed impacts associated with the
realignment of the sewer line will result in elimination of certain impacts, and the currently proposed impacts are located
within the wetland areas previously approved in the Preliminary JD.
The delineation for the southernmost portion of the revised alignment (Tramway One, LLC property) was conducted by
John Davis of (Soil Horizons, LLC) and approved by Andy Williams with the USACE on September 3, 2015. The impacts

Due to realignment of the proposed utility corridor, several previously permitted impacts have been eliminated or reduced.
Original Impacts 4-6 and 7-8 have been eliminated, avoiding five wetland impacts totaling 0.079 acres and one stream impact of
59 If. Original impacts 9 — 10 have been eliminated, avoiding 0.488 of wetland impact. Original impacts 12 & 13 have been

Construction techniques used to avoid or minimize the proposed impacts include the installation of Erosion & Sedimentation
Control devices prior to construction of the utility line. Access to impact areas will be from high ground, and bridgemats will be
utilized as needed to minimize the extent of impacts within the construction corridor.

The proposed sewer line will provide service to the new VA Clinic and the existing Liberty Health Care Facility. The
proposed sewer line has been designed to provide additional capacity as future projects come online and require sewer
services. Additional development could potentially occur as a result of availability of sanitary sewer from the construction
of the proposed sewer line. However, any future developments will be required to meet federal, state and local
regulations which will prevent impacts to nearby downstream water quality.

PROJECT DESCRIPTION:
THE PROPOSED PROJECT CONSISTS OF THE CONSTRUCTION OF APPROXIMATELY 7,750 LF OF B—INCH
GRAVITY SEWER IN THE CITY OF SANFORD. NORTH CAROLINA WITH A TOTAL DISTURBANCE OF
APPROXIMATELY B ACRES. THE PROJECT BEGINS WITH A CONNECTION TO AN EXISTING MANHOLE ON
THE CITY OF SANFORD COLLECTION SYSTEM LOCATED IN THE CARTHAGE COLONIES SUBDIVISION NEAR
GLOUSCHESTER ROAD. THE PROPOSED LINE WILL HAVE AN AERIAL CROSSING OF PERSIMMONS CREEK
( CLASS C ) IN THE CAPE FEAR RIVER BASIN AND CONTINUE THROUGH HEAVILY WOODED PROPERTY
PARALLEL TO AN UN—NAMED TRIBUTARY TO PERSIMMONS CREEK UNTIL A CLEARED PROPERTY BEHIND
LIBERTY HEALTHCARE FACILITY AND THE PROPOSED VETERANS AFFAIRS CLINIC SITE. THE PROJECT
WILL CONNECT TO EXISTING SEWER FROM LIBERTY HEALTHCARE AND THE PROPOSED VETERANS
AFFAIRS CLINIC.
THE CONSTRUCTION CORRIDOR WILL INVOLVE THE CLEARING AND GRUBBING OF A TEMPORARY
CONSTRUCTION EASEMENT GENERALLY 40 LF WIDE ALONG THE LENGTH OF THE CORRIDOR UNLESS
OTHERWISE NOTED. FOLLOWING THE CONSTRUCTION THE SITE WILL BE RESTORED WITH SEEDING AND
MULCH PER THE SPECIFICATIONS FOR A 'PIEDMONT' AREA UNLESS WHERE WETLANDS ARE RESTORED
WITH THE WETLANDS SEEDING SPECIFICATION. A PERMENANT EASEMENT OF 20 LF WIDTH WILL BE
MAINTAINED BY THE CITY FOLLOWING COMPLETION OF THE PROJECT.
DURING CONSTRUCTION THE CONTRACTOR SHALL ESTABLISH CONSTRUCTION ENTRANCES AT ALL SITE
ACCESS POINTS. DUE TO THE LINEAR NATURE OF THE PROJECT EROSION CONTROL MEASURES WILL
