I will forward you a copy of my original email response to Mike. It is probably in everyone's best interest that the revisions and comment periods be done properly. Also, please review the email from Charles below, and think about the statements he made and the impressions they would provide to both the regulated community and the public. Joe Section D, Monitoring and Records • #4 - ‘’Personnel conducting testing of field-certified parameters must hold the appropriate field parameter certifications." The wording of this statement makes it sound like each individual must be certified, which is not true. >»The statement refers to persons testing, not all personnel involved in sample collection. Consult staff in the Raleigh Regional Office if you're uncertain about which personnel should have certification for field parameter testing. I re­ checked this wording today with Cindy Moore (Aquatic Toxicology Unit Supervisor) and Dana Satterwhite (Unit Supervisor, Laboratory Certification Section); they both agreed that the wording was correct. “Part II Standard Conditions Section B, General Conditions • #1 .g - USC is incorrect, it is not 1219 but 1319 »>Thaf s correct. They typo will be fixed at the next boilerplate revision. The CFR notation is correct. 1 2 Section C, Municipal Control of Pollutants from IU • #2.c - A requirement has been placed in there that the POTW will verbally inform DWQ within 24 hours if there is a user that discharges a slug or unusual discharge. POTW will then be required to submit a written 5 day report. Question: Shall this be reported following the same protocol as a SSO? Don’t mind reporting, but additional requirement, see comment following for Section D. »>Many of the changes in Section IV were done at the direction of David Phillips in Region 4. Deborah Gore [who supervises our PERCS Unit) can answer your question on this particular topic. This is not our comprehensive review of the draft boilerplate. There are several parties in Durham County which will need to review and comment on the new boilerplate, and therefore, it is appropriate that the full comment period be provided. Durham County had previously provided a “no comment" on the permit based on the previous boilerplate and does not wish to delay to implementation of the Jordan Rules, but we cannot simply accept new permit requirements without thorough review. »>Progress Energy follows a similar procedure. It buys them time, but doesn't result in changes to the boilerplate. Section D, Pretreatment Programs • #10.a, d, e and #11 - Currently in the 0900 rules, this only applies to SIU’s. This is one of the changes that PERCS is trying to get incorporated into the modification of the rules. Parts II through V. Therefore, in order to allow a full and proper review of the draft permit, I am forwarding a copy of the current standard conditions for your review and extending the comment period to allow time for that review. To simplify your review of the standard conditions, I am providing them in an underline/ strikethrough format that highlights differences between the 10/10/2007 version you received in November and the current 7/2009 version. Text that is underlined is new in the 2009 version, strikethrough text has been deleted from the 2007 version. Aside from replacing 'Clean Water Act' with 'CWA,' there are few changes in Part II and none in Part III. Most of the revisions are in Parts IV and V, which deal with municipal dischargers and pretreatment requirements (these parts do not apply to privately owned and operated treatment facilities). Please provide any comments you have regarding the draft permit and these standard conditions to this office, in writing, no later than January 15, 2010. It is not necessary to re-submit comments already made regarding the permit; they will be taken into consideration as part of the public record. While we are inviting conunent on the standard conditions, be aware that we do not expect to modify them as part of this permit modification. The NPDES unit does revise the conditions from time to time, but, for the sake of consistency, does not do so on a frequent basis. Subject: comment period extension In talking with Martie Groome yesterday (about a comment she made on Greensboro's permits), I realized that the Jordan Lake draft permit mods went out with an older copy of the permit boilerplate. So I sent a letter to all of the permittees today, providing a copy of the current boilerplate and extending the comment period to January 15. Martie has already notified the Haw partners, and I am giving you this heads-up in case she didn't contact you, too. This is a quick 'heads up' in the hope I can catch you before (or during) the holiday. It will require your attention in the next week or so. I am attaching a preview copy of the boilerplate that I sent with the letters. It highlights the changes between the 2009 version and the 2007 version you got in November. Most of the changes are in Parts IV and V and deal with municipal and pretreatment requirements, so you'll probably want to look through the document to see what they look like now. As I note in the letter, we probably won't make any changes in the b-p right now unless someone find a critical error; instead, we will consider any suggestions at the next revision. There is part of the EPA report form which I would really like to have corrected on future inspection reports. On Page 1 of EPA Form 3560-3 it lists Marvin Bernard Carter as the Responsible Official. Marvin was never employed by the County. I am the POTW Director and please put my contact information in this cell. If I need to send some form to EPA to get this fixed please let me know. Subject: Previous email change Hi again Tony, Just realized I termed the sludge lagoon "digester" which may not be the way you needed it to be worded...if so, here it is with "sludge lagoon" After our conversation on Tuesday, June 16th and the site evaluation during the CEI on Thursday, June 17th and 18th, the RRO (Raleigh Regional Office) feels it appropriate to add the sludge lagoon decant/supernatant to the older and empty aeration units as temporary storage in order to slowly dose the decant/supernatant to the headworks of the facility. We understand the operational challenges in sending the decant/supernatant back through the plant with the higher nutrient concentrations and the impacts to the facility and feel this will help the process. Please keep the RRO apprised of any additional treatment or chemical additions that may occur, as a result. If the Recipient does not maintain the court-sanctioned schedules which extended the compliance date for complying with the final effluent limits established in the NPDES Permit, then project costs incurred will not be eligible for Revolving Loan payments. By this, you are required on the date one year after the completion of construction and initial operation of the subject treatment facilities, to certify, based on your consulting engineer's advisement, whether or not such treatment works meet the design performance, specifications and the permit conditions and effluent limitations. In accordance with the Federal Regulations, the Recipient is required to assure compliance with the OSHA safety regulations on the subject project. In complying with this regulatory responsibility, the Recipient should, by letter, invite the Bureau Chief, Education Training and Technical Assistance Unit, NC OSHA Division, 1101 Mail Service Center, Raleigh, NC 27699- 1101 at (919) 807-2890, to participate in the Preconstruction Conference to assure that proper emphasis is given on understanding and adhering to the OSHA regulations. The administrative review and approval of these plans and specifications, and any Issuance of this approval letter does not imply availability of funding. Please note that CG&L is moving the CWSRF program to a priority based system away from the readiness-to- proceed model that we have been operating under. Part of this program change includes adhering to a schedule for submittal of applications through contracting. This approach will hopefully move projects much quicker from an application for funding through contracting. Part of this program change is moving existing projects, including the subject project, to this same type schedule. In order to maintain assurance of funding an Authority to Award must be obtained by August 1, 2011 and all contracts must be executed by September 1, 2011. If any of these milestones are not met, you must reapply under the new, competitive priority system if you wish to seek SRF funding for this project. The new priority system accepts applications twice per year and projects will be funded based on priority and availability of funds. We encourage you to try to complete these milestones well before the due date to build in contingency time. Neither the State nor Federal Government, nor any of its departments, agencies or employees is or will be a party to the invitation to bids, addenda, any resulting contracts or contract negotiations/changes. A goal of 8% of the contract price is established for Minority Business Enterprise (MBE) participation in this project, and a goal of 5% of the contract price is established for Women's Business Enterprise (WBE) participation in this project. The Recipient and Bidders shall make a good-faith effort to assure that MBE's and WBE's are utilized, when possible, as sources of goods and services. The good-faith effort must include the following affirmative steps: (a) including small, minority, and women's businesses on solicitation lists; (b) assuring that small, minority, and women's businesses are solicited whenever they are potential sources; (c) dividing total requirements, when economically feasible, into small tasks or quantities to permit maximum participation by small, minority, and women's businesses; (d) establishing delivery schedules, and (e) using the sendees of the Small Business Administration and the Minority Business Development Agency of the U.S. Department of Commerce. Prior to entering into any contract(s) for construction, the recipient must have obtained all applicable project Permits from the State, including an Authorization to Construct and/or Non­ Discharge Permit. While rejection of all bids is possible, such action may be taken only with prior State concurrence, and only for good cause. The Recipient shall comply with the provisions of 40 CFR. Part 7, Subpart C - Discrimination Prohibited on the Basis of Handicap. Attached is one (1) copy of the Project Bid Information which is to be completed within 21 days after bids have been received, and submitted to the State for review. Upon review and approval of this information, the State will authorize the Recipient to make the proposed award. Do not proceed with construction until the Authority to Award package and the EEO and MBE documentation/certification have been reviewed, and you are in receipt of our approval, if a Federal loan is desired for project construction. The effluent line was heat traced, but due to extremely low temperatures, the failure still occurred. One of the operators discovered the problem this morning during his rounds and the main valve was shut immediately to stop the flow. I estimate that 10 gallons of effluent spilled onto the ground, but did not reach any surface waters. The valve will remain shut until repairs are made. We are keeping a close eye on all of the effluent water lines throughout the plant to ensure compliance.
