Thank you for meeting with Joe Pearce on Tuesday afternoon and discussing the
temporary sludge holding proposal for the Triangle Wastewater Treatment Plant. As
discussed, the Triangle Wastewater Treatment Plant is currently holding more sludge
than we find acceptable. Therefore, we are proceeding rapidly to have sludge removed
and are proposing to use an existing unused aeration basin for sludge holding.
With continued sludge wasting, the sludge level in the lagoon will continue to rise. Also,
from now until October, there is the risk of significant rain events from hurricanes. To
minimize the risk of having to take extreme measures to ensure the environmentally safe

Durham County Engineering with the assistance of our County Attorney has drafted a
new “Request for Proposals** and will publish it very soon. If this request for proposal
and contract proceeds smoothly, sludge removal may begin in the next sixty (60) days.
For a bit of sludge history, the Triangle Wastewater Treatment Plant most recently
disposed of sludge by contract with Bionomics. Bionomics then subcontracted to
Earthtech for treatment and final disposition. By contract Bionomics was responsible for
proper disposal. However, due to concerns about the DWQ permitting of this facility,
Durham County chose to discontinue this disposal practice. Subsequently, in February.
2007, Durham County issued a “Request for Proposals” for dredging and disposal. As
there were a number of addendums issued and legal concerns the “Request for Proposals”
was withdrawn.
Our proposal is as follows:
1. Waste Activated Sludge will be directed from the clarifiers directly to the aeration
basin, labeled A, via temporary piping.
2. This basin will be used for a maximum of three months.
3. This basin will be operated without aeration similar to the operation of the
existing sludge lagoon.
4. By January 1, 2008, sludge transferred to the aeration basin shall either be
disposed off-site or transferred to the main sludge lagoon.

On July 13, 1995, the Environmental Management Commission approved the Town of
Cary's request for full delegation authority to issue sanitary sewer extension permits. In
conjunction with that delegation, this office has been allowing the Town to issue sewer
extension permits based upon a block flow approval process. Previously, the Raleigh
Regional Office has granted block flow approvals for the North Cary WWTF totaling
5,500,000 GPD. As requested in your letter dated July 15, 2007, the Raleigh Regional
Office hereby grants an additional block flow allocation of 500,000 GPD for the North Cary
WWTF yielding a total of 6,000,000 GPD granted for that facility. The North Cary WRF
has a current treatment capacity of 12.0 MGD.

This letter is in response to a request from the Durham County Engineering Department to temporarily use an
existing unused aeration basin at the Triangle Wastewater Treatment Plant for sludge holding, for a period of 90 days.
The Division of Water Quality does hereby grant your request to waste sludge to the unused aeration basins for a period
of not more than 90 days beyond the date of this letter. As required with this temporary approval the County of Durham

To keep citizens informed and to maintain compliance with State requirements and the Clean
Water Act of 1999 (House Bill 1160), Durham County has prepared this report summarizing the
peiformance of the County-owned Triangle Wastewater Treatment Plant (TWWTP) and associated
wastewater collection system. This report includes activities during the County’s fiscal year 2007-
2008 (July 1, 2007 through June 30, 2008). This report contains a System Overview, a
Performance Summary, and a Major Projects Overview.

SYSTEM OVERVIEW
Collection system operations include maintenance of the pump stations, sewer line cleaning,
easement mowing, manhole inspections, and high priority line inspections. During the year,
Durham County inspected 2195 manholes. The sewer line-cleaning requirement of 10 percent of
the system was exceeded this year. The County cleaned 57,000 linear feet of the collection system
as per permit requirement. In addition, the County exceeded the required two high priority line
inspections by completing four over the 12-month period. Over 37 miles of the County’s sewer
easements were mowed during the year to maintain access to the facilities.
The collection system consists of both public and private sewer lines and pump stations to
transport wastewater to the treatment plant. Durham County owns and maintains approximately
108 miles of sewer piping and ten pumping stations. All pump stations are equipped with
automatic dialers that will notify an operator when an alarm occurs. Nine of the ten stations have
stationary generators for emergency power. The County has two portable generators that can be
placed at the pump station without a stationary generator in case of a power failure.
Description of Collection System and Treatment Process
The Durham County wastewater collection and treatment system serves a customer base of more
than 9,300 residential, commercial, and industrial users, including the portion of Research Triangle
Park located in Durham County. During the last year, the Triangle Wastewater Treatment Plant
(TWWTP) treated an average of 4.63 million gallons per day (MOD) of wastewater. Included in
this flow is wastewater collected from the Town of Cary under an agreement between Durham
County and the Town of Cary to treat flow through 2010. This wastewater is collected,
transported, and treated to meet pennitted standards before it is released into the environment.

Pretreatment Program (IPP).
There are currently twenty-one
permitted industries in
County’s program that
monitored regularly

(SIUs).
The IPP includes a Fats, Oil, and Grease (FOG) control program to minimize the accumulation of
grease waste in the sewer system. FOG can be a frequent cause of wastewater overflows within
collection systems. The IPP monitors discharges from commonly recognized sources such as
restaurants to minimize problems associated with FOG. The FOG program teaches best practices
for FOG management to restaurant managers and kitchen staff.
In addition to restaurants, residences can be sources of FOG discharges. Everyone can help
minimize FOG issues in the sewer by choosing not to pour grease down the drain: solidify and
dispose of grease with other solid waste.

Summary of System Performance
The Triangle WWTP operated in compliance for the reporting period July 1, 2006 through June
30, 2007, satisfying all requirements of the National Pollutant Discharge Elimination System
(NPDES) permit issued by the North Carolina Division of Water Quality. More than 2800
samples were analyzed to demonstrate permit compliance.
The operation of the Biological Nutrient Removal facilities that were put into service in 2005 has
provided the County with significant reduction of nutrients discharged to Northeast Creek.
Following is a graph depicting the reductions that have been achieved. The 2004 data represents
nutrient removals prior to startup of the BNR facilities and the 2006 data represents nutrient
removal after these facilities were placed into service. The Total Nitrogen removed from 2004 to
2007 was increased by 58 percent and the Total Phosphorus removed was increased by 11 percent
while Total Nitrogen and Total Phosphorus influent loadings processed at the facility increased an
average of 155 percent.

MAJOR PROJECTS OVERVIEW

• Grit Removal - removes appropriate smaller materials prior to the beginning of the
treatment process.
• Five Stage Biological Nutrient Removal System - provides the ability to remove nitrogen
and phosphorous during treatment.
• Clarifiers - separates biosolids from the treated water after the biological process.
• Tertiary Filters - additional cleaning of the treated water prior to the disinfection process.
• Ultraviolet Disinfection - eliminated large amounts of chlorine needed for the previous
disinfection process and the dangers associated with the chlorine being stored on site.
• Chemical Feed Equipment - used to supplement the biological processes.
Triangle Wastewater Treatment Plant Improvements
Durham County continues the process of upgrading the Triangle Wastewater Treatment Plant.
Many improvements were completed during Phases 1 and 2 and are now in service, including the
following:
• Influent Pump Station - sized for 12 MGD average flow, and located above the 100-year
flood elevation to avoid flooding.
On January 12, 2007 a spill of approximately 1000 gallons occurred near the Kingsly Court
easement due to a grease blockage. The spill reached a nearby creek. The portion of the spill that
reached the creek was contained and pumped out. NCDENR was notified and the sewer lines in
the vicinity were cleaned. No detrimental environmental impacts were observed due to the spill.
On March 24, 2007, approximately 300 gallons of wastewater spilled from a manhole in
Alexander Crossing due to a grease blockage. The spill reached a nearby creek. The portion of
the spill that reached the creek was contained and pumped out. NCDENR was notified and the
sewer lines in the vicinity were cleaned. No detrimental environmental impacts were observed due
to the spill.

• Emergency Generators - to maintain service during power outages.

Phase3 Improvements
Phase 3 will provide for the treatment of the biosolids generated by the treatment processes. This
project is in the design phase and will result in the ability to treat the biosolids to a Class A
designation. The Class A designation by the U.S. Environmental Protection Agency (EPA)
indicates a highly treated product. The Phase 3 improvements are scheduled for construction in
2008. A major benefit of Phase 3 will be the ability to discontinue the use of the remaining 5-acre
lagoon on the plant site. Phase 3 will incorporate the use of concrete tanks and dewatering to
manage the biosolids treatment in a smaller area on the plant site.
Water Reclamation and Reuse

presses, nurse tank and ancillary equipment to the site and will begin sludge removal
operations on October 1, 2007. Additionally, e-mail confirmation of your office’s

In conclusion, the temporary use of the Aeration Basin #1 for sludge storage did not
result in any environmental impacts and provided Durham County sufficient time to
effectively bid and execute a contract for the proper disposal of the sludge. Durham
County appreciates the Division of Water Quality allowance for this temporary
operational change.

Sludge Removal Data:
TWWTP Sludge Removal and Hauling Project
Issue: A leak in the reuse water line that is being used for sludge removal.
Impact: Bio-Nomics cancelled their scheduled half day on Friday, October 19th. for the
repairs to be done. No impact to overall project.
Issue: Shaft to Washwater Pump 1 broke. Out for repair and cost estimate.
Impact: No impact to sludge removal project at this time.
Bio-Nomics setup their equipment which consisted of a hydraulic dredge
pumping to a 20,000 gallon mix tank, an inline grinder on the section from the
mix tank to the presses, and two belt filter presses in the assigned staging area,
the last week of September and loaded their first truck on October 2nd. Their
crew consist of two people, who is managing the press, running the dredge, and
filling the trucks.
Earth Tech is providing two trucks for daily hauling as part of their service to
Bio-Nomics. The trucks are weighed full at the site on a certified commercial
scale, and empty on return. Weigh slips are provided back to Bio-Nomics. Earth
Tech is providing manifests in triplicate thru Bio-Nomics.
The dewater sludge is being disposed of at Earth Tech remediation site in
Sanford, NC.
Bio-Nomics operating schedule is 6:00 AM to 6:00 PM Monday - Thursday and
6:00 AM tol2:00 PM on Friday.
United Water is taking grab samples from the piles drop at the presses four (4)
times per day. The test results will be averaged and used as the %Ds for loads
hauled that day.

testing calendar quarter.
Your facility is currently monitoring for copper and/or zinc and the data indicate that the levels of copper/zinc in
your effluent have the potential to cause an exceedance of the NC water quality action level for this (these) parameter(s) in
your receiving stream during low stream flow conditions. The policy states that whenever a facility experiences two or more
toxicity limit violations during a toxicity testing calendar quarter, the NPDES Permit will be modified to include numeric
limits for copper and/or zinc UNLESS the permittee provides one or more of the following:
In addition, this correspondence contains important information on the Division’s Copper and Zinc Action Level
Policy which is triggered by two or more toxicity limit violations that occur during the toxicity testing calendar quarter
specified by the toxicity testing special condition of your NPDES Permit. Attachments addressing policy implementation
and a copy of the Division's Toxicity Reduction Guidance have been included with this Notice of Violation.
1. Instream measurements of dissolved metal during low flow conditions that demonstrate compliance with
the Action Level standard
2. A revision of the prospective permit limit using improved inputs that in concert with existing or additional
monitoring data demonstrates compliance with the Action Level standard

The Division has evaluated your copper and/or zinc monitoring data. The Division has also developed a prospective
NPDES permit limit based on your facility’s instream waste concentration, the copper and/or zinc action level criterion and a
translator procedure. Based on this data your prospective copper permit limit is 18.2 pg/L and your prospective zinc permit
limit is 159.0 pg/L.
Please note that if you choose item b) above, you will be given nine months to submit documentation that eliminates
copper and/or zinc as causative effluent toxicants. Your final report should be comprehensive and include all data used to
support your conclusion(s). Should the data indicate copper and/or zinc as the source of effluent toxicity or if the data are
inconclusive as to copper and/or zinc’s role as a toxicity source, then the NPDES Permit will be reopened and the metal
limits specified above will be applied to the permit. The report is due nine months after the date of the second WET Notice
of Violation.
Failure to notify DWQ of your acceptance of a copper and/or zinc limit, failure to notify DWQ of your option
selection or failure to make acceptable demonstration to DWQ that copper and/or zinc are not causative effluent toxicants
within the stated time frames will result in reopening of the NPDES Permit to include copper and/or zinc numeric limitations,
as appropriate.

If the effluent is toxic, then we expect work to commence immediately with toxic effluent samples. Failure to
initiate work with toxic effluent samples during the study period is unacceptable and will be considered a failure to make
acceptable demonstration as cited above. We recommend a minimum of three separate sampling events during the nine
month period to definitively rule out copper and/or zinc as causative effluent toxicants.
Please note that your actions to notify DWQ of prospective limit acceptance or to notify DWQ of plan option(s) and
subsequent submission of a plan are contingent upon two or more toxicity NPDES permit limit violations occurring during a
toxicity testing calendar quarter.
Also note that the WET limit will remain in your NPDES permit regardless of whether metals are the source of
effluent toxicity. The data resulting from your actions to disprove copper and/or zinc as sources of effluent toxicity will
determine whether NPDES Permit limits will be assigned for these parameters. You are responsible for initiating actions to
address these issues.
You may consider entering into a Special Order by Consent (SOC) with DWQ. A SOC provides regulatory relief
for specific NPDES permit limit violations and, if signed, will contain a requirement to conduct a Toxicity Reduction
Evaluation. The SOC will contain a compliance schedule, stipulated penalties for failing to meet milestone activity dates and
may contain upfront penalties to settle past permit limit violations.
