This laboratory was inspected to verify its compliance with the requirements of 15A NCAC 2H .0800
for the analysis of environmental samples.
This consisted of comparing data reported on DMR's submitted to this Division with the values
obtained on laboratory bench worksheets. Data was reviewed for the month of February and June
2004. No data transcription or reporting issues were observed at this time.

NOTICE OF VIOLATION
Pretreatment Annual Report Review
Failure to Take Adequate Enforcement
Program: Durham County
Durham County NPDES Number NC0026051.
The review indicates that Durham County is in violation for failure to perform timely
compliance judgement and take appropriate enforcement actions for IUP violations as required
by the POTW’s Division approved Enforcement Response Plan (ERP) in accordance with Part
HI, B, 9., of your NPDES permit and 15A NCAC 2H .0909. Specifically, the County failed to
take appropriate escalated enforcement actions against two Significant Industrial Users in
Significant Non-Compliance (SNC) within the timeframes outlined in your ERP. Details of the
violation are listed in items 1 and 2 of the attachment, along with other concerns with the PAR.
It is requested that Durham County respond to this NOV by April 15, 2004 jointly to the Raleigh
Regional Office and the Pretreatment Unit explaining the cause of the violations and providing a
description of the corrective actions the County will take for each violation.
Please note if it is determined that this violation represents Significant Noncompliance (SNC),
the Division will place the POTW on the Quarterly Noncompliance Report (QNCR) to EPA as
of the January through March 2004 quarterly report period.

1) The Durham County Utility Division approved ERP states that for instances of SNC the
County will issue an NOV with a penalty within 30 days of receiving the applicable data.
For July through December 2003, the latest submission of data would be due to the POTW
by January 30, 2004. The PAR indicates the NOV with penalty had not been issued for
Cintas’s SNC for mercury and Oil and Grease, and for JMC’s SNC for chlorides as of the
filing of the March 1, 2004 PAR.
2) The Durham County Utility Division approved ERP states that the County will issue an
enforceable compliance order for SIUs in SNC for 2 consecutive reporting periods. Other
acceptable options for SIUs in repeat SNC include IUP modification and termination of
service. Division requirements are that the POTW must make every effort to issue the Order
or IUP before the end of the 2nd six months, but in any case issue it within 60 days after the
end of the second six months. Cintas was in SNC for Oil and Grease and mercury for both
January through June 2003 and July through December 2003, so the Order or IUP
modification should have been issued by December 31, 2003, but in no case later than March
1, 2004. The PAR indicates no Order or IUP modification had been issued as of the filing of
the March 1,2004 PAR.
4) The PAR includes only an annual TTO certification from the County’s 4 metal finishing
SIUs. This is compliant with Part III, 5, of the lUPs, however the lUPs do not comply with
40 CFR 433.12(a), in combination with 40 CFR 403.12(e), which require semi-annual
certification. We regret this problem was not discovered during our review of the lUPs.
Please review the applicable lUPs and Part III, 6-8, of the Division’s Generic IUP found in
Appendix 6-B of the Comprehensive Guidance for North Carolina Pretreatment Programs,
and submit copies of appropriate IUP modifications to the Pretreatment Unit by June 1,
2004.
3) The PAR does not include a copy of the required public notice. Please submit the affidavit or
a copy of the actual page of the paper to the Pretreatment Unit by April 1, 2004.

I asked the facility to inform us as to the status of the work being done next week.

The staff were using a portable pump to decant from the sludge lagoon back to the head
of the plant.
The Durham contacts stated they had a belt press coming in Friday of this week along
with a dredge to remove solids from the sludge lagoon. Bionomics is the contractor to
remove solids.
The upgrades to the facility appeared to be progressing well. The forms for the oxidation
ditch are in place, new electrical building is built, new filters are built, new bar screen
and grit removal are in place. A 60’' line and metering station have been put in place to
allow the upgraded facility to accept 4.0 MGD from Kit Creek pumping station.

On Wednesday March 24, 2004 I conducted a recon inspection at the subject facility.
The facility’s sludge holding lagoon was full. Solids in the aeration basin were ~ 4700-
4800 according to the ORC. Durham staff were aware they needed to lower the solids
inventory in the plant.

Your NPDES permit for a municipally owned/operated WWTP expires on April 30, 2006. This notice is being sent to
explain the requirements for your permit renewal application.
You are receiving this advance notice because your facility has a permitted flow at or above 1 MGD, or the subject
facility receives industrial [pretreatment] wastewater. If either of these criteria no longer applies, contact the NPDES
Unit before submitting a renewal application.
Federal (40 CFR 122) and state (ISA NCAC 2H.0105(e)) regulations require that permit renewal applications be filed at
least 180 days prior to expiration of the current permit. Your renewal application is due to the Division no later than
November 1, 2005. Failure to apply for renewal by the appropriate deadline may result in a civil penalty assessment or
other enforcement activity at the discretion of the Director.
These additional analyses must accompany your permit renewal application, or any request for a major permit
modification. The Division cannot draft your permit without the additional data. Any data submitted cannot be over 4
V2 years old, and must account for seasonal variation (samples cannot be collected during the same season each year

Advance Notice of Renewal Application Requirements

The U.S. EPA revised and expanded the application requirements for municipal permits, effective August 1, 2001. ERA
form 2A is attached to this Notice, and must be used for your permit renewal application. The new application
requirements mandate additional effluent testing:
Conduct three Priority Pollutant Analyses (PPAs) and submit results with your renewal application. Collect
samples for the PPAs in conjunction with sampling for your current quarterly toxicity test. The new PPA
requirements differ from previous versions. Each PPA must include:
Analyses for all total recoverable metals listed in Part D of form 2A. This includes metals that are not
normally monitored through your NPDES permit.
Analyses for total phenolic compounds and hardness.
Analyses for all of the volatile organic compounds listed in Part D.
Analyses for all of the acid-extractable compounds listed in Part D.
Analyses for all base-neutral compounds listed in Part D.
Analyses for Total Mercury must be performed using EPA Method 1631.
2. Conduct four toxicity tests for an organism other than Ceriodaphnia and submit results with your renewal
application. The tests should be conducted quarterly, with samples collected on the same day as your
current toxicity test. Call the Aquatic Toxicology Unit at (919) 733-2136 for guidance in conducting the
additional tests.

If any wastewater discharge will occur after the current permit expires, this NPDES permit must be renewed.
Discharge of wastewater without a valid permit would violate Federal and North Carolina law. Unpermitted discharges
of wastewater could result in assessment of civil penalties of up to $25,000 per day.
Use the checklist below to complete your renewal package. The checklist identifies the items you must submit
with the permit renewal application. If all wastewater discharge has ceased at this facility and you wish to rescind this
permit, please contact me. My telephone number, fax number and e-mail address are listed at the bottom of the
previous page.
The completed ERA Form 2A application (copy attached), signed by the permittee or an Authorized Representative.
Submit one signed original and two copies.
If an Authorized Representative (such as a consulting engineer or environmental consultant) prepares the renewal
package, written documentation must be provided showing the authority delegated to the Authorized
Representative (see Part II.B.ll.b of the existing NPDES permit).
