Based upon the above facts, 1 conclude as a matter of law that Durham Triangle WWTP
violated the terms, conditions or requirements of NPDES Permit NC0026051 and N.C.G.S. 143-
215.1(a)(6) in the manner and extent shown in Attachment A. A civil penalty may be assessed in
accordance with the maximums established by N.C.G.S. 143-215.6A(a)(2).
This letter transmits a Notice of Violation and assessment of civil penalty in the amount
of $295.27 ($250.00 civil penalty + $45.27 enforcement costs) against the Durham Triangle
WWTP.
This assessment is based upon the following facts: a review has been conducted of the
discharge monitoring report (DMR) submitted by the Durham Triangle WWTP for the month of
August 2002 for the Durham Triangle WWTP. This review has shown the subject facility to be
in violation of the discharge limitations and/or monitoring requirements found in NPDES Permit
NC0026051. The violation which occurred in August 2002 is summarized in Attachment A to
this letter.

Based upon the above findings of fact and conclusions of law, and in accordance with authority
provided by the Secretary of the Department of Environment and Natural Resources and the
Director of the Division of Water Quality, I, Kenneth Schuster P.E., Division of Water Quality
Regional Supervisor for the Raleigh Region, hereby make the following civil penalty assessment
against Durham Triangle WWTP:

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken
into account the Findings of Fact and Conclusions of Law and the factors set forth at G.S. 143B-
282.1(b), which are:
Submit a written request for remission or mitigation including a detailed
justification for such request:
The degree and extent of harm to the natural resources of the State, to the public health,
or to private property resulting from the violation;
The duration and gravity of the violation;
The effect on ground or surface water quantity or quality or on air quality;
The cost of rectifying the damage;
The amount of money saved by noncompliance;
Whether the violntion vvas committed willfully nr intentionally;
The prior record of the violator in complying or failing to comply with programs over
which the Environmental Management Commission has regulatory authority; and
The cost to the State of the enforcement procedures.
A request for remission or mitigation is limited to consideration of the reasonableness
of the amount of the penalty and is not the proper procedure for contesting the accuracy of
any of the statements contained in the assessment letter. Because a remission request
forecloses the option of an administrative hearing, such a request must be accompanied by a
waiver of your right to an administrative hearing and a stipulation that there are no factual or
legal issues in dispute. You must execute and return to this office the attached waiver and
stipulation form and a detailed statement which you believe establishes whether:

the Committee cannot consider information that was not part of the original remission request

Withers & Ravenel (W&R), Inc. has prepared this letter to report the results of
samples collected from the clay liner of the west lagoon at the above referenced site.
W&R was contracted by Woodard and Curran, the operators of the plant, to collect
three composite samples from the lagoon’s clay liner. The sampling activities were
completed concurrent with the dredging of sludge from the lagoon by another
subcontractor.
W&R used a boat to mobilize to six different locations in the lagoon on December 19,
2002. The lagoon contained approximately 4 to 5 feet of water. Woodard and Curran
requested that three composite samples of the clay liner be collected from the
lagoon. For the purposes of establishing sampling locations the lagoon was divided
into three segments. A core sampler was used to collect samples of the top six-
inches of clay at two locations within each segment of the lagoon. At each sample
location, a six to twelve-inch layer of sludge was present over the clay liner.
The results of the analyses suggests that concentrations of TCLP metals, volatiles
and semivolatiles were below practical quantitation limits (PQL) of the EPAtest
methods for each of the three composite samples with exception to barium, which
The samples of clay liner from each location were placed in clean sample jars
prepared by the laboratory, labeled with time, date and location, and transported in
a cooler with ice to Chemical & Environmental Technology (CET) in Cary, North
Carolina for analyses. The lab was instructed to composite the two grab samples
from each of the three segments of the lagoon and analyze the samples forTCLP
volatiles, semivolatiles and metals. The chain of custody is attached. Figure 1 is a
drawing that shows the configuration of the lagoon and the approximate sampling
locations. The drawing was digitized from an April 1966 drawing of the “Waste
Stabilization Lagoons” prepared by W.M. Piatt and Company and provided by
Woodard & Curran. The drawing depicts the approximate locations of the samples
and is not intended to reflect an as-built drawing of the lagoon limits.

This is to inform you of temporary shutdown of the east sand-filter sweeper bridge at the
Durham County Triangle WWTP due to bearing failure. The bearings on the bridge trolley
failed and the bridge dropped and can not be moved. The bearings have to be fabricated and are
scheduled to be delivered by Friday, February 14, 2003. The entire plant flow has been diverted
to the west filter. This filter cleaning is set to run continuous until the east bridge can be
repaired.

On March 3, 2003, Mr. Kirk Stafford of the Raleigh Regional Office conducted a
Compliance Evaluation Inspection (CEI) of the subject facility accompanied by Mr. Jerry
Rimmer, Plant Manager for Woodard & Currin who is the contract operator. His assistance and
cooperation was helpful and appreciated. As a result of the inspection, the following items were
noted.
1) The facility has a Class IV rating and according to Mr. Rimmer, Mr. Victor Cozart is Operator •
in Responsible Charge (ORC) and he has a current Class IV certification. The Technical
Assistance and Certification Unit of the Division of Water Quality has Mr. Ronald Ketterman
listed as ORC and Mr. Jerry Rimmer as Backup ORC. Please contact that unit at 919-733-0026
to confirm the ORC and Backup ORC.
2) The facility consists of a bar screen, grit removal, dual train extended aeration, dual clarifiers,
UV disinfection, tertiary filtration, and two sludge storage lagoons. It is noted that the plant is
scheduled for major upgrade due to be accomplished in three phases. Phase I, which started
March 1, 2002, consists of new influent head works with bar screens and grit removal, new UV
disinfection system, and new post aeration. Phase II will consist of a new five stage Kruger BNR
system, new tertiary filters, and four new circular clarifiers. Phase III will consist of a new
biosolids handling train. It is noted that construction is finished on the new effluent pump station,
the new UV system with post aeration, new electric switch room, and new 1000 kw generator. In

10) A review of the toxicity testing summary database for the period February 2002 through
November 2002 showed compliance for all four tests run
3) Sludge has been substantially removed from the west lagoon in preparation for construction of
the Kruger system. This sludge was belt pressed onsite and hauled to landfills in Rougemount
North Carolina and Lawrenceville Virginia. The removal was done as per the requirements of the
Ground Water Section and the Water Quality Section of the Division of Water Quality.
4) A review of laboratory data and self monitoring data revealed consistent reporting of results.
Some inconsistencies were noticed during the cast CEI and those appear to have been resolved.

5) An ORC log and a daily calibration log are kept in accordance with the requirements of 15A
NCAC 2B .0506 c(3).
6) The effluent was slightly cloudy at the time of inspection due to I&I in the system according
to Mr. Rimmer. It is requested that an updated detailed infiltration and inflow update be
submitted detailing the progress on identifying the sources and the progress made to repair same
since the last inspection.

You may consider entering into a Special Order by Consent (SOC) with DWQ. A SOC provides
regulatory relief for specific NPDES permit limit violations and, if signed, will contain a requirement to
conduct a Toxicity Reduction Evaluation The SOC will contain a compliance schedule, stipulated
penalties for failing to meet milestone activity dates and may contain upfront penalties to settle past
permit limit violations.
If the effluent is toxic, then we expect work to commence immediately with toxic effluent
samples. Failure to initiate work with toxic effluent samples during the study period is unacceptable and
will be considered a failure to make acceptable demonstration as cited above. We recommend a
minimum of three separate sampling events during the nine month period to definitively rule out copper
and/or zinc as causative effluent toxicants.

Also note that the WET limit will remain in your NPDES permit regardless of whether metals
are the source of effluent toxicity. The data resulting from your actions to disprove copper and/or zinc as
sources of effluent toxicity will determine whether NPDES Permit limits will be assigned for these
parameters. You are responsible for initiating actions to address these issues.

In 1984, North Carolina adopted Action
Level water quality standards for copper,
zinc, iron, and silver. These standards were
developed to prevent the State from having
to adopt the EP A criteria for metals, which
at the time were overly restrictive.
Action Level water quality standards are
a special category of surface water quality
standards, which are flexible, instream
criteria established for certain substances
that meet the following conditions:
=— * The chemical must— he
bioaccumulative (BCF<100);
■ The chemical must have variable
toxicity due to its chemical form,
solubility, affinity for other ligands,
or other characteristics; and
■ The aquatic species used for whole
effluent toxicity (WET) testing must
be among the most sensitive biota to
that particular chemical, based on
available toxicity data.
In the early 1980’s EPA was just
discovering the mechanisms that made these
metals toxic. One of the things that was
clear was that, in most waters, only a portion
of the total metal concentration is
bioavailable. At the time, the best method
for determining the bioavailable portion of
the metal was WET testing. Thus the
standard was written to allow a facility to
calculate a more site-specific metals limit
using a measure of bioavailability and was
implemented using WET testing.
Under the Clean Water Act, EPA must
approve all state standards and
reclassifications. In 1985, 1986 and 1990
when EPA reviewed the action level water
quality standards they only conditionally
approved them. They had concerns related
to the fate and transport of the metals in
natural systems. In order to get the
conditional approval, which prevented EPA
from promulgating standards for North
Carolina, the Division committed to
conducting fate and transport studies on
selected metals, including copper and zinc,
contingent on adequate funding. Several
study plans were developed and presented to
EPA for funding,
available.
When these standards were adopted,
..EPA. requested -information- on how -the -
Action Level standards would be
implemented. The implementation
procedure presented to EPA involved
establishing WET testing limits and
monitoring for discharges with copper or
zinc in their effluent. No permit limits for
the metals were to be given if the facility
-continued to pass their~WET limits-or-if
upon failure of the WET testing an action
level parameter was not found to be a
causative factor.
EPA was uncomfortable with this
process and, when other states began asking
about using a similar approach, they became
even more uncomfortable.
While North Carolina was
action level standards, EPA was
with metals criteria. The original national
criteria were so low that some pristine
streams had higher background
concentrations of copper and/or zinc and
would have been considered impaired. In
recent years, EPA has developed equations
and procedures for determining site-specific
metals criteria and for measuring more
precisely the bioavailable metals.
During the last Triennial Review, North
Carolina agreed to modify the action level
language to reference EPA’s guidance on
developing site-specific metals criteria and
to provide a detailed Implementation
Procedure for action level standards. Had
North Carolina not taken these actions, EPA
was ready to promulgate straight standards
for metals for North Carolina based on
perceived successes in other states. This
action would have resulted in permit limits
for copper and zinc in most NPDES permits.
The Implementation Procedure that the
Division is beginning to implement was
reviewed by EPA and reworked by the
Division several times during 1999 and 2000
before EPA finally approved it in October
2000.

North Carolina Division of Water Quality
Purpose
The purpose of this policy paper is to clarify the Division’s implementation policy
and procedures for controlling levels of copper and zinc in point source discharges.
Background
During the adoption of the National Toxics Rule in 1992, EP A did not mandate
that North Carolina promulgate new numeric criteria for copper and zinc. The Agency
recognized the extremely variable nature of the toxic effects caused by these pollutants.
North Carolina was allowed to use an action level approach to these toxicants as a result
of an extensive set of biological data, implementation of aggressive, systematic whole-
effluent toxicity (WET) testing firNPDES permits, and the overall quality of tfie^
program.
Representatives of EPA Region IV, EPA Headquarters, and North Carolina
Division of Water Quality (Division) met in Atlanta on June 2, 1998. In this meeting,
EPA stated their need to make a decision regarding the acceptability of the Division’s
approach to the use of action levels for copper and zinc. The two major concerns were:
- Understanding the Division’s implementation process, especially in terms of
permitting decisions.
- Prompt progress on toxicity identification evaluations (TIEs) and toxicity
reduction evaluations (TREs).
Implementation of Action Levels for Copper and Zinc in NPDES Permits

Current Control Methodologies
Control of copper and zinc is achieved by promoting pollution prevention,
pretreatment requirements, and through the Division’s whole-effluent toxicity testing
program. It should also be noted that limits for total residual chlorine (another action
level standard) are routinely placed in NPDES permits.
North Carolina continues to promote pollution prevention, recycle, and reuse as
positive/proactive approaches to control pollution. Emphasis has been so great in North
Carolina that a separate non-regulatory Division, the Division of Pollution Prevention and
Environmental Assistance (DPPEA), was created. DPPEA provides free consulting in the
area of waste reduction to industrial and municipal dischargers. Furthermore, the
Division of Water Quality routinely requires new and expanding discharges to assess
pollution prevention and waste minimization approaches in engineering alternatives
analyses performed to support the need for their projects.
Pretreatment permits issued by municipalities with industrial users routinely
contain restrictions on the discharge of copper and zinc. These limits are imposed to
protect inhibition of biological treatment at the wastewater treatment plant, to control
toxicity of sludge, or to control whole effluent toxicity.
Toxicity testing limits exist in over 450 permits in North Carolina. The
compliance rate of these facilities not under Special Order by Consent (SOC) is greater

WHOLE EFFLUENT TOXICITY REDUCTION GUIDANCE Rev. 10/01
This document has been prepared by the N.C. Water Quality Section’s Aquatic Toxicology Unit
to aid NPDES permittees, their consultants, and state regulatory staff with the development of
whole effluent toxicity identification and reduction plans. As has been the operating strategy of
the Water Quality Section in the past, this document will not attempt to presenta strictly defined
procedure to accomplish toxicity reduction, as such defined processes limit the ability to design
programs custom fitted to the situation of each discharge. Rather, this document will attempt to
present a series of logical steps that can be initiated to help track effluent toxicity sources, trends,

of 300 gallons per day of industrial wastewater from a pretreatment process at Cree. Inc. in Durham
County; spent process reagent from on-site treatment for ammonium ion will be pumped from a 1200
gallon tank and hauled to the Dupont Waste Treatment Plant at Chambers Works in Salem County, New-
Jersey for final treatment, pursuant to the request received on June 24. 2003.
This approval shall be subject to the following specified conditions and limitations, and shall be
in effect until June 30, 2004:
11. Cree, Inc. or its designee shall inspect the pump and haul collection facilities to prevent
malfunctions and deterioration, operator errors, and discharges that may cause or lead to the
release of wastes to the environment, a threat to human health, or a nuisance.
12. Cree. Inc. shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee.
13. Any duly authorized officer, employee, or representative of the Division of Water Quality
may, upon presentation of credentials, enter and inspect any property, premises, or place on
or related to the pump and haul collection facilities at any reasonable time for the purpose of
determining compliance with the Division's approval; may inspect or copy any records that
must be maintained under the terms and conditions of this approval; and may obtain samples.
These records shall be submitted monthly (by the 10th of the following month) to
the Raleigh Regional Water Quality Supervisor, Department of Environment
and Natural Resources, 1628 Mail Service Center, Raleigh. NC 27699-1628.

6. This approval shall be voided unless the agreement between Cree. Inc., Dupont, and Freehold
Carthage, Inc. for the collection, transportation, and ultimate disposal of the wastewater is in
full force and effect.
8. The wastewater collected by this system shall be properly treated in the Dupont Waste
Treatment Plant at Chambers Works in Salem County, New Jersey.
10. Adequate inspection, maintenance, and cleaning shall be provided by Cree. Inc. to insure
proper operation of the subject facilities.
5. No type of wastewater other than the pumped and hauled wastewater from a pretreatment
process at Cree, Inc. in Durham County, whereby spent process reagent from on-site treatment tor
ammonium ion will be pumped from a 1200 gallon tank and hauled to the Dupont Waste Treatment
Plant at Chambers Works in Salem County, New Jersey for final treatment, shall be included in
these pump and haul activities.
9. Cree. Inc. is liable for any damages caused by
operations.
7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, Cree, Inc. shall cease operation of all pump and haul activities and take such
immediate corrective actions as may be required by this Division.

Persons reporting such occurrences by telephone shall also file a written report in letter form
within fifteen (15) days following first knowledge of the occurrence. This report must
outline the actions taken or proposed to be taken to ensure that the problem does not recur

20. Upon completion of construction and prior to operation ot these pump and haul
activities, a certification must be received from a professional engineer certifying that
the facilities associated with the pump and haul operation have been installed in
accordance with this permit and the submitted information. Mail the certification to
the Raleigh Regional Water Quality Supervisor, Raleigh Regional Office, Department
of Environment and Natural Resources, 1628 Mail Service Center, Raleigh. NC 27699-
1628.
19. When these pump and haul activities are no longer necessary, please send written notification
to the Division's Raleigh Regional Water Quality Supervisor.

The P&H submittal indicates that 300 GPD of wastewater will be collected in a 1200

As you will recall, it the Division’s general policy not to require a permit for P&H of
industrial wastewater, but to issue an approval, if appropriate. They have asked and I

Please provide any comments you have regarding this draft permit modification to this office by
JANUARY 23, 2004. At this time, the Division is also publishing a notice in the newspapers of general
circulation in Durham County, inviting public comment on the draft permit. Following the 30-day
comment period, we will review all pertinent comments received and take appropriate action on the
permit renewal.
Change the effective date for annual mass limits for total nitrogen (100,452 lbs/yr) and total
phosphorus (10,204 Ibs/yr) from January 1, 2005 to May 1, 2005. As discussed in your letter
dated 10/27/2003, this additional time is needed to complete the Phase II construction, which
has been delayed several months due to wet weather and sludge removal problems. The Phase II
construction will include the installation of the biological nutrient removal facility. The TN
annual load limits were supposed to become effective 1/1/2003 based on House Bill 515
requirements: therefore, this additional 4-month compliance period puts the total compliance
schedule at 28 months. Please note that this facility must continue to comply with the current TP
concentration limits of 0.5 mg/1 (summer) and 2 mg/1 (winter).
Addition of weekly average ammonia limits to Effluent Sheets A( 1) and A(2), in addition to the
current monthly average limits. Both limits are necessary to comply with 40 CFR 122.45(d). The
weekly average limits are based on a review of performance data for several municipalities, and a
multiplier of 3 was used to derive the weekly average limit. All permits with monthly average
ammonia limits will be subject to this implementation policy. With the addition of these limits.
Special Condition A.(7)- Ammonia Reopener- has been deleted.
