Dear Mr. Sanderson:
The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Cape Side Subdivision on March 15, 2007. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 930803,
dated June 22, 2007, for the construction of the subject project.
This permit shall be effective from the date of issuance until June 22, 2017, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of an overall low density subdivision with a
bio-retention basin to treat the collected portion.of the drainage area, in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules")
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until June 22, 2017 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.7 on page 3 of this permit. The subdivision is
permitted for 77 lots, each allowed a maximum of 4,300 square feet of built-upon
area.
3. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of this permit.
4. The overall density of the subdivision shall be maintained at 30% or less.
5. A portion of the subdivision has been piped, resulting in the need for an
engineered system to treat that runoff.
6. Within the non-collected portion of the subdivision, no piping shall be allowed
except that minimum amount needed to drain runoff under a road or for a
driveway crossing.

II. SCHEDULE OF COMPLIANCE
1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division.
2. The permittee is responsible for verifying that the proposed built-upon area for
the entire lot, including driveways and sidewalks, does not exceed the allowable
built-upon area. Once the lot transfer is complete, the built-upon area may not be
revised without approval from the Division of Water Quality, and responsibility for
meeting the built-upon area limit is transferred to the individual property owner.
3. If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed
built-upon area. Any approvals given by the Board do not relieve the homeowner
of the responsibility to maintain compliance with the permitted BUA limit.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition, or sale of all or part of the project area.
The project area is defined as all property owned by the permittee, for
which Sedimentation and Erosion Control Plan approval or a CAMA Major
permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.

5. The Director may determine that other revisions to the project should require a
modification to the permit.
6. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
7. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
8. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built-upon surface.
9. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
11. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
12. Permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual.
13. The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency. The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of structures, orifice, catch basins and
piping.
g. Access to all components of the system must be available at all times.
14. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.

15. This permit shall become voidable unless the facilities are constructed in
accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
16. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 930803, as issued
by the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit.
c. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
f. The maximum built-upon area per lot is 4,300 square feet. This allotted
amount includes any built-upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line
and the edge of the pavement. Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and
parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools.
g. Built-upon area in excess of the permitted amount will require a permit
modification.
h. Each lot will maintain a 30' wide vegetated buffer between all impervious
areas and surface waters.
i. All roof drains shall terminate at least 30' from the mean high water mark.
j. Within the non-collected portion of the subdivision, filling in or piping of
any vegetated conveyances (ditches, swales, etc.) associated with the
development, except for average driveway crossings, is strictly prohibited
by any persons.
17. A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots. The recorded
copy must contain all of the statements above, the signature of the Permittee, the
deed book number and page, and the stamp/signature of the Register of Deeds.
18. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel. The facility must be in compliance with all permit conditions. Any
items not in compliance must be repaired or replaced to design condition prior to
the transfer. Records of maintenance activities performed to date will be
required.
20. Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include
raised, open wood decking, or the water surface of swimming pools.

III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity except after notice to and
approval by the Director. In the event there is either a desire for the facilities to
change ownership, or there is a name change of the Permittee, a
"Name/Ownership Change Form", signed by both parties, must be submitted to
the Division of Water Quality accompanied by appropriate documentation as
listed on page 2 of the form. The project must be in good standing with DWQ.
The approval of this request will be considered on its merits and may or may not
be approved.
2. The permittee is responsible for compliance with all of the terms and conditions
of this permit until such time as the Director approves the transfer request.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal), which have jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Permittee grants permission to staff of the DWQ to access the property for the
purposes of inspecting the stormwater facilities during normal business hours.
8. The permittee shall notify the Division in writing of any name, ownership or
mailing address changes within 30 days.
9. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.

A low density project is one that meets the appropriate criteria for built upon area and transports stormwater
runoff primarily through vegetated conveyances. Low density projects should not have a discrete stormwater
collection system as defined by 15A NCAC 2H .1002(18). Low density requirements and density factors can
be found in 15A NCAC2H .1005 through .1007.

The permittee shall be responsible for the following maintenance procedures regarding the permitted
bio-retention system.
The plant material will be watered every day for fourteen consecutive days. and after planting has
been completed.
AS NEEDED:
1. Treat all diseased trees, shrubs and vegetation.
2. Replace deficient, defective or rotted support stakes.
3. Check the entire collection system for sediment accumulation, clogging, broken pipes and
grates, leaks, etc. Repair as required.
4. Mow the grassed areas of the basin when it reaches a maximum height of 6".

A few more items to deal with in regard to the additional information received
on November 13, 2006:
1- The revised calculations do not show the calculation of the minimum 1" volume
to be provided in the bioretention system. Based on my calculations, the
minimum volume is 12,422 cubic feet. The system provides only 9,705 cubic feet.
Additional surface area may be needed to provide the necessary volume without
flooding the road.
2- Please show the calculations of how you determined the volume provided in the
system.
3- The standard in the BMP Manual is for 1000 trees and shrubs per acre of
bioretention basin. Only 13 trees and 39 shrubs have been proposed for a total

Dear Mr. Sanderson:
The Wilmington Regional Office received a Stormwater Management Permit Application for
Cape Side Subdivision on June 30, 2006. A preliminary review of that information has
determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. Please revise the larger plan sheet to include the proposed bioretention basin
and details. The plans are currently on 8.5" x 11" sheets with very small writing,
and the details are extremely difficult to read.
2. The calculation of the combined Rational runoff coefficient (Cc) appears to be
based on an assumption that the percent BUA within the 8.167 acre drainage
area of the bioretention basin is the same as the overall percent BUA of the
entire subdivision. This is not necessarily true. As with any engineered system
permitted by the Division, the percent BUA within the drainage area needs to be
calculated based on the actual BUA's within that drainage area. Using this
method, the percent BUA is a little over 40% and the required minimum surface
area jumps by 1,000 square feet to 9,122 square feet.
3. Please revise the calculations to add the minimum number of plantings (1000
plantings per acre of bioretention basin, 3 shrubs for every 1 tree), per the BMP
Manual.
4. The volume provided in the system is well below the calculated minimum 1"
volume. Please increase the depth of the bioretention basin to 12". It appears
that you could raise the flood pool elevation to 26.7 to provide more volume
without flooding the road. Please provide revised volume calculations and revise
the flood pool elevation on the outlet structure detail.
5. The calculations that were sealed on August 24, 2005, indicated that the area of
the bioretention basin was 9,961 square feet, however, the volume calculations
submitted on June 30, 2006, indicate that the flood pool area is only 4,600
square feet.
6. Please eliminate the 1.5" orifice. The drawdown for bioretention can occur only
through infiltration, evaporation and transpiration.

information. The Division is allowed 90 days from the receipt of a completed application
to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not

BLAIR, INC. (the "Surviving Corporation"), a corporation organized under the laws of
the State of North Carolina, hereby submits these Articles of Merger for the purpose of
merging SPRINGCREST DEVELOPERS, INC. (the "Merging Corporation"), a
corporation organized under the laws of the State of North Carolina, into the surviving
corporation:
I. The following Plan of Merger was duly approved in the manner prescribed
by law by the shareholders of each of the corporations participating in the merger:
PLAN OF MERGER
A. Corporations Participating in Mercier.
Springcrest Developers, Inc. (the "Merging Corporation") will be merged into
Whitney Blair, Inc., which will be the surviving corporation (the "Surviving Corporation").
B. Name of Surviving Corporation.
The business of the Surviving Corporation will be conducted under the name
"WHITNEY BLAIR, INC.".
C. Mercier.
The merger of the Merging Corporation into the Surviving Corporation will be
effected pursuant to the terms and conditions of this Plan. Upon the merger becoming
effective, the corporate existence of the Merging Corporation will cease, and the
corporate existence of the Surviving Corporation will continue. The time.when the
merger becomes effective is hereinafter referred to as the "Effective Time", and shall be
upon filing.
D. Conversion and Exchange of Shares.
At the Effective Time, the outstanding shares of the corporations participating in
the merger will be converted and exchanged as follows:
1. Surviving Corporation The outstanding shares of the Surviving
Corporation will not be converted, exchanged, or altered in any manner as a result of
the merger and will remain outstanding as shares of the Surviving Corporation.
2. Merging Corporation Each share of stock of the Merging Corporation
outstanding at the Effective Time shall be converted into one (1) share of stock of the
Surviving Corporation.
3. Fractional Sharps No fractional shares will be issued.
4. Surrender of Share Certificates Each holder of a certificate representing
shares to be converted or exchanged in the merger will surrender such certificate and
after the Effective Time will be entitled to receive in exchange therefor a certificate or
certificates representing the number of shares to which he is entitled under this Plan.
Until so surrendered, each outstanding certificate that prior to the Effective Time
represented shares of the Merging Corporation will be deemed for all purposes to
evidence ownership of the consideration to be issued for such shares under this Plan.
E. Amendments to Articles of Incorporation.
The Articles of Incorporation of the surviving Corporation will not be amended.

F. Abandonment.
After approval of this Plan by the shareholders of the Merging Corporation, and
at any time prior to the merger's becoming effective, the Board of Directors of the
Surviving Corporation may, in its discretion, abandon the merger.
II. Shareholder approval of the merger was obtained by both corporations
involved as required by Chapter 55.

Dear Phil,
As requested, our office visited the above mentioned site on June 13,2006. At that time, an
auger boring to a depth of approximately seven feet below the site grade was conducted. The site
had been recently cleared of trees and some amount of sand fill had been deposited within the
building area of the lot.
Soils encountered in the borehole consists of sandy loam to medium grade sands. The soils
exhibited dark to moderately lite colorations(Chroma values 2 -5 on the Munsell soil color
chart). Varying degrees of cementation occurred at depths greater than 18 inches. An apparent
water table was determined by allowing adequate time for adjustments in the surrounding soil to
take place,then measuring down to the water level in the borehole. The depth to the water was
measured at 74 inches. Our measurements and soil classifications are presented in Table 1.
Based on the results of our field classification and of the soils encountered, and direct
measurement of groundwater level, it is our opinion that the seasonal high water table occurs at
6.2 feet below the existing grade.

The Division received a modification to the Capeside Subdivision permit on October 7, 2005.
The application is incomplete and cannot be accepted for review until the following items are
addressed:
1. P!ease submit a plan sheet delineating the entire 355,750 fi2 drainage area to the
proposed bio-retention basin.
2. A detailed site-specific planting plan must be provided. The plan should show the
basin in detail and specify the names of the plants, how many plants will be planted
and where they will be planted within the basin. Species suitable for use in
bioretention basins are listed in the BMP document.
3. Please make the bioretention basin plan and section details specific to the proposed
basin. Please show the correct elevations, and dimension the proposed basin. The
plan view shown in the BMP manual is only an example, and is obviously not the
plan view of the basin being proposed here.
4. Please submit a soils report to support your claim of a sandy subgrade, and
therefore, use of the 5% design size factor. The soils report should also estimate
the elevation of the Seasonal High Water Table.
5. Please calculate the design volume provided in the basin between the bottom
elevation of 25.7 and the flood pool elevation of 26.2. Please revise the calculations
to include a table of elevations, areas, and volumes provided in the basin. The basin
must be sized to contain the runoff associated with a 1" rain event.
6. Please note that the approval of this basin is not intended to be a green light for
others to pipe their front yards.

August 1, 2005, sent via certified mail #7004 2890 0002 3425 1623. The Notice was returned
by the Post Office on August 23, 2005, as undeliverable because the forwarding order had
expired. I obtained your new mailing address by calling your office at the phone number you
provided to Tripp Engineering. Please note that the Division is extending the deadline for
receipt of a written Plan of Action to September 25, 2005.
On Tuesday, August 16, 2005, I met with you and your consultant, Phil Tripp, and discussed
several possible resolutions of the violations at the subject project. However, I am resending
the original August 1, 2005, Notice of Violation in order to have written confirmation that you
have indeed received it. This letter also serves as a reminder that you need to submit a written
Plan of Action, which provides information on the actions you propose to address the
violations, and the time frame for completion of those actions, before September 25, 2005.

Dear Mr. Sanderson:
On May 7, 2003, Wilmington Regional Office personnel performed a Compliance Inspection of
the subject project, located off Georgetown Road near Calabash in Brunswick County, North
Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 930803, issued to you on May 22, 2001. As a result of the
inspection, the Division issued a Notice of Violation on May 8, 2003, for the project due to the
fact that the front yards of several lots were piped and a copy of the recorded deed restrictions
had not been submitted.
The project has again been found in violation of Stormwater Permit Number SW8 930803,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section 111.5- The permit is not transferable to any person or entity except after
notice to and approval by the Director. Your request to transfer the permit was
received on April 13, 2004. The Division responded on May 19, 2004, however
the ongoing piping situation has not been resolved. Until the piping situation is
resolved, the permit cannot be transferred, unless the POA is willing to take on
the responsibility of modifying the site to comply with the stormwater permit.
2. Section 11.12- Within the time frame specified, the permittee shall submit a written
time schedule to the Director for modifying the site the meet the minimum permit
requirements. You have not responded to the Division's letter dated May 19,
2004, regarding the proposed remedy for the piping. Your consultant at the time,
Ms. Arnie Drucker, P.E., of AB Consulting Engineers, and staff met on April 13,
2004, to discuss options for obtaining compliance prior to approving the Transfer
of Ownership. To date, no proposal to deal with the existing piping has been
received.

To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take
to correct the violations and a time frame for completion of those actions,
on or before September 1, 2005.
2. Meet with the POA to determine the extent of the piping and how best to
either remove the piping and restore the permitted roadside swale system,
or modify the permit to a high density permit and provide a treatment
system for the collected runoff.
Failure to provide the "Plan of Action" by September 1, 2005, or to correct the violations
by the date designated in the "Plan of Action", are considered violations of 15A NCAC
21-1.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Brunswick County Building Inspector, this Office is
requesting that the Building Inspector consider withholding building permits and
Certificates of Occupancy for this project until this matter is satisfactorily resolved.

The nonprofit corporation is a mutual benefit corporation. Upon dissolution of
the mutual benefit corporation,the remaining assets shall be distributed to its members,
or if it has no members,to those persons to whom the corporation holds itself out as
benefiting or serving.

a. Membership. Every person or entity who is a record owner of a fee or undivided
fee interest in any Lot which is subject by covenants of record to assessment by
the Association shall be a member of the Association provided that any such
person or entity who holds such interest merely as a security for the performance
of an obligation shall not be a member.
b. Voting Rights. The Association shall have two (2)classes of voting membership.
Class I. Class I members shall be all Owners excepting Declarant. Class I
Members shall be entitled to one(1)vote for each Lot in which they hold the
interest required for membership by Section(a) above. When more than one
person holds such interest or interests in any Lot,the vote attributable to such Lot
shall be exercised as such persons mutually determine,but in no event shall more
than one (1) vote be cast with respect to any such Lot.
Class II. The sole Class II Member shall be Declarant. The Class II Member
shall be entitled to total votes in an amount equal to twice the number of the Class
I votes plus one. The Class II membership shall cease and become converted to
Class I membership upon the conveyance to Lot Owners of 80%of all Lots
subject to this Declaration, or December 31. 2015.whichever first occurs. In
addition, Declarant may terminate the Class II membership upon written notice to
the Association.
c. Meetings of Members. The By-Laws of the Association shall provide for an
annual meeting of the Voting Members, and may make provisions for regular and
special meetings of the Voting Members other than the annual meeting. Unless
otherwise stated in the By-Laws or Declaration, a quorum for the transaction of
business at any meeting of the Voting Members shall exist if fifty-one(51%)
percent of the Voting Members are present at any meeting. So long as a quorum
is present at the opening of the meeting, business may be transacted until
adjournment notwithstanding the withdrawal of enough Voting Members to leave

Dear Mr. Sanderson:
The Division of Water Quality received a request to transfer the Stormwater
Management Permit from you to the Cape Side Property Owners Association, Inc., on
April 13, 2004. The project is currently out of compliance with the permit. It is the
Division's policy not to transfer a permit unless and until the project is in compliance.
This allows the POA to begin with a system that is in.total compliance with the permit
and avoids a large initial assessment of the membership to cover the costs of bringing
the project into compliance.
Several homeowners have piped their front yards, which is a violation of the permit, and
is in conflict with Article VII, Section 26 of the covenants. As a third-party beneficiary of
the covenants, to the extent necessary to enforce the Stormwater Management permit
requirements, the Division is requesting that either the piping be removed, or an
'engineered system be designed to treat the runoff from this collection system. I met with
your consultant on April 13, 2004, to discuss the available options. To date, I have not
received a proposal to remedy this non-compliance.
As the permittee of record, you are responsible for compliance with the permit
conditions and enforcement of the covenants until such time as the permit transfer is
approved. Your request for permit transfer is on hold pending resolution of the non-

Dear Mr. Sanderson:
On May 7, 2003, Wilmington Regional Office personnel performed a Compliance
Inspection of the subject project, located off Georgetown Road near Calabash, in
Brunswick County, North Carolina. The inspection was performed to determine the
status of compliance with Stormwater Permit Number SW8 930803 Modification, issued
to you on May 22, 2001.
The project has been found in violation of Stormwater Permit Number SW8
930803 Modification, issued pursuant to the requirements of 15A NCAC 2H.1000. The
violations found are:
1. Condition 11.7- No piping shall be allowed except that minimum amount
needed to direct runoff beneath an impervious surface such as a road,
and that minimum amount needed under a driveway to provide access to
a lot. Several of the lots (including the model home & sales lot) have piped
their entire road frontages or large portions thereof, and added catch
basins.
2. Conditions 11.4 and 11.5- Deed restrictions must be recorded prior to the
sale of any lot, and a copy must be submitted within 30 days of recording.
I am unable to verify that deed restrictions have been recorded, and a
copy of the required deed restrictions has not been submitted.
To correct these violations you must :
1. Provide a written "Plan of Action" which outlines the actions you will take
to correct the violations and a time frame for completion of those actions,
on or before June 8, 2003.

2. The use of extensive piping is considered a collection system, and will
result in the subdivision being considered a high density project. A high
density project must treat runoff in an engineered system. Please either
submit a modification to this permit proposing an engineered system, or
pull out the piping and restore the vegetated roadside swale, per the
approved plans.
3. Submit a copy of the recorded deed restrictions which include all of the
statements as found in Condition 11.4 of the permit.
Failure to provide the "Plan of Action" by June 8, 2003, or to correct the violations
by the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the County Building Inspector, this Office is requesting
that the Building Inspector consider withholding building permits and Certificates of
Occupancy for this project until this matter is satisfactorily resolved.

Pursuant to a Notice of Violation issued for the above referenced project on May 8,2003,we offer the
following.
1. Unaware of who issued the violation,we spoke to Rick Shiver last week regarding the few lots
that the homeowner's have piped in the 78 lot subdivision. He indicated he would speak to you
and have you contact our office regarding a"Plan of Action"to revise the permit in order to
retain the piping that is in place and restrict any further piping of the roadside swales. The
developer has indicated the existing piping in the swales has been installed by the individual lot
owners,not the original developer. In order to prohibit piping of additional areas,the developer
has suggested including a clause in future sales agreements to make buyers aware piping swales
is not permitted.
2. Enclosed please find a copy of the""Declaration of Restrictions and Protective Covenants for
Cape Side Subdivision",recorded 6/29/01 at the Brunswick County Register of Deeds.

and Joanne Steenhuis of DWQ that concern had been raised regarding the wetland road crossing permit
at the property. Rob Moul and I have done some investigation and found that the roads had been
previously installed under a permit. I have enclosed a letter from Steve Craft of L.M. McLamb and&
Son Construction stating that the work was done for a previous landowner.
