The Wilmington Regional Office received the Stormwater Application for Georgetowne Subdivision on July 18, 1995, with
linal information on December 18, 1995. Staff review of the plans mud specifications has determined that the project, as
proposed,will comply with the Stormwater Regulations set fords in Title 15A NCAC 21-1.1000. We are forwarding Permit No.
SW8 950109 Modification dated December 18, 1995 to Georgetown Homeowners Association,Inc.
This permit shall be effective from die date of issuance until December 18, 2005 and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish all adequate system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements,or limitations contained in this permit are wnacceptable,you have die night to request au ajudicatory
hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a
written petition, conforming to Chapter 150B of the Nordn Carolina General Statutes, and filed wide die Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit sliall be
final and binding.

plans and specifications and other supporting data as attached and on file with and approved by the Division of
Environmental Management and considered a part of this permit.
Tlus permit shall be effective from the date of issuance until December 18, 2005 and shall be subject to the following
specified conditions and limitations:
I. DESIGN STANDARDS
1.Thus permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2.Thus stormwater system has been approved for the management of stormwater runoff as described on page 3 of
this permit,the Project Data Sheet.
3.Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.

revision to the permit and receiving approval from the Division.
5.Each of the lots in the subdivision will be limited to the amount of built-upon area indicated in the supporting
calculations and per approved plans.
6.The permittee is responsible for verifying that the proposed home plans do not exceed the allowable built-upon
area. Once the lot transfer is complete, the home plan may not be revised without approval from the
permittee, and responsibility for meeting the built-upon area limit is transferred to the individual homeowner.
7.The following items will require a modification to the permit:
a.Any revision to the approved plans,regardless of size.
b.Pro.ect name change.
c.Transfer of ownership.
d.Redesign or addition to the approved amount of built-upon area.
e.Furdier subdivision of the project area.
In addition, die Director may determine that other revisions to the project should require a modification to the
permit.
8.The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying die site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.
II. SCHEDULE OF COMPLIANCE
1.The permittee will comply with the following schedule for construction and maintenance of the stormwater
management system:
a.The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended
use prior to the construction of any built-upon surfaces except roads.
b.During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
2.The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance
Plan must be followed in it's entirety and maintenance must occur at the scheduled intervals.
3.The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency including,but not limited to:
a.Semiannual scheduled inspections (every 6 months).

b.Sediment removal.
c.Mowing and revegetation of side slopes.
d.Immediate repair of eroded areas.
e.Maintenance of side slopes in accordance with approved plans and specifications.
f.Debris removal and unclogging of outlet structure,orifice device and catch basins and piping.
g.Access to the outlet structure must be available at all times.
4.Records of maintenance activities must be kept and made available upon request to authorized personnel of DEM.
The records will indicate the date, activity, name of person performing the work and what actions were
taken.
5.Deed restrictions must be recorded which limit the built-upon area per lot to the amount as shown on the Project
Data Sheet,per Part I#2.The recorded statements must follow the form:
a."The allowable built-upon area per lot is 5,000 ft2 for Lots 1-52, 100-117, 163-180, and 209-232; and 4,000 ft2 for
Lots 53-99, 118-162, and 181-208, inclusive of that portion of the right-of-way between the lot line
and the edge of pavement, structures, pavement, walkways of brick, stone, or slate, but not including
open wood decking."
b."The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the
State."
c."Alteration of die drainage as shown on the approved plan may not take place without the concurrence of the State."
6.Tlis permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.
7.Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of dhis
permitted facility, a certification must be received from an appropriate designer for the system installed
certifying that the permitted facility has been installed in accordance with dis permit, the approved plans and
specifications, and other supporting documentation. Mail die Certification to the Wilmington Regional
Office, 127 Cardinal Drive Extension,Wilmington, North Carolina, 28405, attention Water Quality Section.
8.A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1.This permit is not transferable. In the event there is a desire for die facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to die Division of Environmental
Management accompanied by an application fee, documentation from tlhe parties involved, and oilier

supporting materials as may be appropriate. The approval of this request will be considered on its merits
and may or may not be approved.
2.Failure to abide by the conditions and limitations contained in dhis permit may subject the Permittee to
enforcement action by die Division of Environmental Management, in accordance with, Nordi Carolina
General Statute 143-215.6(a) to 143-215.6(c).
3.The issuance of this permit does not preclude die Permittee from complying wide any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4.In die event that die facilities fail to perform satisfactorily, including die creation of nuisance conditions, the
Permittee shall take immediate corrective action,including those as may be required by dus Division, such as
die construction of additional or replacement stormwater management systems.
5:Flie permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification,revocation and reissuance or termination does not stay any permit condition.

Dear Linda:
In response to your review letter dated November 15, 1995, we offer the following:
1. We and Landmark agree with the approach to permitting the ultimate
project. We might suggest the following for the permit.
Project build-out requires storage of 299,493 CF. This storage requirement
will be accomplished through the design of three (3) ponds. Initially Pond
#1 will be constructed to provide storage of 86,549 CF or 35,222 SF
impervious coverage. The developer/permittee will not exceed those limits
until such time as Pond #2 and Pond #3 are constructed. Pond #2 and
Pond #3 will be constructed and outlet improvements made to handle the
balance of the development of 212,944 CF and 20,516 SF impervious
coverage.
2. Please find enclosed two (2) copies of Sheet ER-4 which shows drainage
routing to each pond.
3. Attachment A is not a part of this project. It does not even apply to the
project and you can discard it.

Dear Mr. Veenstra:
The Wilmington Regional Office received previously requested information for Georgetown
Subdivision on October 26, 1995. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
1. To keep things simple, I would like to issue the permit for the ultimate project, with the
appropriate wording that the Phase I pond will be built first, and a portion of Phase II which
originally drained into Pond 2 will be temporarily rerouted to Pond 1. This way, Landmark
avoids unnecessary permit modification fees, and the project scope is clear.
2. Please provide 2 copies of the overall ultimate (not phased) drainage plan which shows the
new lot count and the drainage areas to each pond. I do not need the temporary rerouted
pipe plans, since you already sent them.
3. I received the revised submittal form and Attachment A, however, I am confused as to the
exact built-upon area that is being requested. Attachment A only lists 53 lots, and uses a
55% built-upon limit, while the submittal form indicates that the built-upon areas are either
4,000 or 5,000 square feet. Please clarify.

The Wilmington Regional Office received a revised Stormwater Submittal for Georgetown Estates
on October 11, 1995. A preliminary review of that information has determined that the submittal for the
subject project is not complete. The following information is needed to continue the stormwater review:
1. The deed restriction lot listing is incomplete. I merely used the 112 lots as an example. The
remaining 120 lots must also be restricted in the same manner has the 112.
2. Are you requesting that DEM approve this subdivision one phase at a time? If so, a
completed permit application and $385.00 fee must be submitted. Each subsequent phase
must also fill out an application and submit the fee at the time of submittal.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to November 13, 1995, or the submittal will

Dear Linda:
Per the Owner's request, Landmark Organization would like to make a modification
to the above permit to allow construction of Phases 1 and 2 (See Sheet ER-1A)
while only building Pond No. 1. Any construction beyond Phase 2 will require the
construction of all 3 ponds as shown in the original permit.
To accomplish the above modification Landmark proposes to construct a temporary
48-inch pipe between SDMH No. 19 and Cl No. 15. This will allow the stormwater
from Phase 2 that originally went to pond No. 2 to be diverted on a temporary basis
to Pond No. 1 until more infrastructure is built. Also, Landmark will construct a
temporary outlet for Pond No. 1 which will be used only until Ponds No. 2 and No.
3 are constructed.
We have enclosed six (6) copies of the pond and storm pipe calculations for your
review. We have also enclosed six (6) copies of Sheet ER-1A and C15A showing
the proposed modifications.

In response to your review letter dated July 31, 1995 we offer the following::
1) We have enclosed a revised density limit form showing the project density
at 30%. The allowable built upon area will be composed of 112 lots at 5000
square foot per lot and 120 lots at 4000 square foot per lot.
2) The connection channel between Ponds #2 and #3 is for transfer of
stormwater only and not any storage or treatment. Therefore, this transfer
channel has not been included in the storage caaculations and as such the
7.5 foot depth is not required in this channel. We have revised the orifice
size to 6-inch and we have enclosed revised Sheet C15showing the 6-inch
orifice. We have also enclosed revised calculations.
3) We have enclosed a corrected engineer authorization submittal form.
4) We have enclosed two (2) copies each of detail Sheets D1 and D2
containing cul-de-sac and road sections.

Dear Mr. Veenstra:
The Wilmington Regional Office received a Stormwater Submittal for the Georgetown Estates on
July 18, 1995. A preliminary review of that information has determined that the submittal for the subject
project is not complete. The following information is needed to continue the stormwater review:
✓ 1. Because the revised subdivision now exceeds low density, the plans must demonstrate how
runoff from all impervious areas will be directed to the pond. This may be shown through the addition
dlz(\ Q� of graded swales along the rear property lines, or through a signed and notarized additional deed
restriction that requires one of the following:
a. That all homes utilize gutters and all the downspouts be directed to swales that are
graded to the pond or into the road.
OR
b. That all lots are graded such that 2/3rds of the lot is graded to fall toward the street.
2. The newly connected ponds must have the design depth of 7.5' available below the 15.75
contour at all locations where the surface area is counted toward the requirement. The
plans indicate that =2,620 ft2 of surface area cannot be counted because the depth is not
met at that location.
3. The storage volume provided (283,156 ft3) must be used to determine the orifice size. A
4" orifice will not draw down this volume within 5 days.
