Dear Mr. Berzina:
On July 26, 2016, staff from the Wilmington Regional Office of the Division of Energy, Mineral
and Land Resources (DEMLR)reviewed the file for Georgetowne Subdivision, located in New
Hanover County to determine the status of compliance with the State Stormwater Management
Permit Number SW8 950109, originally issued on May 9, 1995 and as modified thereafter.
DEMLR file review has revealed that the site is in compliance with the terms and conditions of
this permit. Please find a copy of the completed form entitled "Compliance Inspection Report"
attached to this letter,which summarizes the findings of the recent inspection.
As indicated in the attached report,the following deficiencies have been resolved:
1. A valve was installed on the unapproved discharge pipe, which is located under the
emergency overflow riprap area of Pond#l. This gate valve was used to plug the discharge
pipe, so it should always be in the closed position and locked. However, if it needs to be
opened later for some reason(i.e.-to drain the pond or change the level), it can be done upon
approval by DEQ State Stormwater.
2. Pictures have been submitted as verification for installation of the valve described above, and
equalizer pipes, which were previously installed at an earlier date.
Please be advised that until you submit the required Name/Ownership Change Form to the
Division and receive approval from the Division to transfer the permit, you are required to
comply with the terms, conditions and limitations of the Stormwater Management Permit under
Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute
143-214.7, including the operation and maintenance of the permitted stormwater system.
Please also note that any individual or entity found to be in noncompliance with the provisions of
a stormwater management permit or the stormwater rules is subject to enforcement action as set
forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per
day.

On March 2, 2016, staff from the Wilmington Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR) inspected Georgetowne Subdivision, located in New
Hanover County to determine the status of compliance with the State Stormwater Management
Permit Number SW8 950109, originally issued on May 9, 1995 and as modified thereafter.
DEMLR file review and site inspection revealed that the site is not in compliance with the terms
and conditions of this permit. Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report,the following deficiencies must be resolved:
1. Please install a valve on the unapproved discharge pipe,which is located under the
emergency overflow riprap area of Pond#1. A die test was performed and the results
confirmed that the outlet pipe under the emergency overflow riprap is draining the pond.
This is considered short-circuiting the pond. Therefore,this pipe needs to be plugged.
Since this will change the overall performance of the pond, it has been proposed that the
pipe be plugged with a gate valve in the closed position and locked. Then, if it needs to
be opened later for some reason(i.e.- to drain the pond or change the level), it can be
done. However,please note that this will require approval by DEQ State Stormwater
first.
2. Please submit pictures of the drained pond showing the equalizer pipes installed.
The equalizer pipes could not be located in the field due to murky water.

Please be reminded that it is your responsibility as the permittee of record to submit a completed
and signed Name/Ownership Change Form to the Division of Energy, Mineral and Land F
Resources at least 30 calendar days prior to making any of the below listed changes. These forms

Comment: Pond#1 level was down from the previous inspection even with the rain last night. However, it was still
higher than the normal pool. Pond#2 level was down about the same amount.

Okay. I will try to rneet your next week at the pond, For bond 1., I thinly it will be good to check the elevation at
the overflow to see if it matches the drawing. If so, then the elevation of the pond bottom could be measured
by subtracting your depth readings. if the depth measures 12', then the elevation of the pork bottom would
be 22' (overflow elevation) - 2' (depth) = t ' elevation. This would mean that there is 2' of sediment because
it's supposed to have an ' bottom elevation.
As a general rule, the pond should be mucked out when it has 1' of sediment in it. Or, the older- rule of thumb
was to muck it out when it reached 2 gf of the depth, which would be about 2' of sediment,

The pond does draw down but slowly. I have seen it at normal pool several times. I do not have the elevation of the
emergency spillway but I can get that to you next week. I am traveling today and am out at the beginning of next week

Steve,
Attached please find the depth plots for the ponds at Georgetowne you requested. I went out to inspect
the site yesterday and decided to perform another depth plot so that you would have current numbers.
The ponds are designed to have a depth of 7.75 feet at the deepest point in each basin. Pond #1 had an
average depth of 12.72 feet less the high water level of+/- 2 feet resulted in an average depth of around
10 feet over the area designed to be the deepest portion of the basin. Pond #2 had an average depth of
9.41 feet less the high water level of+/-2 feet resulted in an average depth of around 7.5 feet over the
area designed to be the deepest portion of the basin.

yesterday and decided to perform another depth plot so that you would have current numbers.
The ponds are designed to have a depth of 7.75 feet at the deepest point in each basin. Pond#1 had an average depth
of 12.72 feet less the high water level of+/-2 feet resulted in an average depth of around 10 feet over the area designed
to be the deepest portion of the basin. Pond #2 had an average depth of 9.41 feet less the high water level of+/-2 feet
resulted in an average depth of around 7.5 feet over the area designed to be the deepest portion of the basin.
The measurements reveal that Pond #1 is around 2.25 feet deeper than designed at the deepest portion of the basin
while Pond #2 is around .25 feet shallower than designed at the deepest portion of the basin but well within the
permitted parameters.

At time of inspection,it was noticed that Pond 1 was full of water up to the emergency overflow elevation,which was the
same as during the last inspection. Previously, it was believed that the pond needed to be cleaned out. I met at the site
with Kyle Berzina of CEPCO,who stated that Retention Pond Services had completed a survey of the pond. I requested
that it be submitted as soon as possible. The survey should show an array of bottom elevations covering the surface
area of the pond. From here,it can be compared to the design condition to evaluate the volume provided.We will also
need to know the surveyed elevation of the emergency overflow and the orifice pipe(if it can be measured). The approved
drawing shows the emergency overflow at 23 feet and the permanent pool at 15.75 feet. The pond should be around 7.5
feet deep or at 8.25 feet bottom elevation. There was a pipe outlet at the bottom of the emergency overflow, not shown
on plans,apparently designed to draw down Pond 1. It is believed that it helps draw down some of the ground water
infiltrating into the pond. This needs to be verified.

Inspection Summary:
Although we have had a lot of rain recently, Pond#2 was down below the 10-year storm elevation which shows that it is
drawing down properly.
Pond#1 was full of water up to the emergency overflow elevation. This is a sign that there may not be enough volume in
the pond. Therefore,the bottom elevations of the pond should be surveyed to determine the sediment level. The pond
should be mucked out if necessary in accordance with the Operation &Maintenance Agreement.

to the public to safeguard these records and to carry out our day-to-day program obligations.

1. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment for file review so you can be accommodated.
Appointments are scheduled between 9.00 a.m. and 3�00 p.m. Viewing time ends at 4 45
p.m. Anyone arriving without an appointment may view the files to the extent that time and
staff supervision are available.
2. You.must specify files you want to review by facility name or incident number, as
appropriate. The number of files that you may review at one appointment will be limited to
five.
3 You may make copies of a file when the copier is not in use by the staff and if time permits.
There is no charge for 25 or less copies. cost per copy after the initial 25 is 2,5 per copy.
Payment is to be made by check, money order, or cash in the administrative offices.
4- Files must be kept in the order you received them. Files may not be taken from the office.
No briefcases, large totes, etc. are permitted in the file review area To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00.
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo I®, sign-in, and receive a visitor sticker prior to
reviewing files.

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater controls
conducted on August 7, 1997 to determine compliance with Stormwater Permit Number SW8 950109 issued
to you on November 27, 1996.
A summary of the findings and comments are noted under Section 6 of the report. Please inform this
Office in writing before September 8, 1997 of the specific actions that will be undertaken and the time frame
required to correct the deficiencies. Failure to provide the requested information, when required, may initiate

STORMWATER COMPLIANCE INSPECTION REPORT

2. Inspection Date: August 7, 1997
Weather Conditions: Warm, sunny
3. Comparison of Approved plans vs. As-Built: Compared well.
4. Maintenance Problems:
a. Pond could not be accessed for inspection. No clear routes to pond due to construction.
b. The phasing pattern approved as temporary routing to the first pond seems to have been
expanded without benefit of an approved plan. It appears that both the first and second roads
to the right, and the third road to the left are in, while only 100 -150 feet of each were
approved in the first phase. Per Section I, Item 2, Phase II of the pond must be complete
prior to construction beyond the temporary phase line approved.
5. PE Certification Received? 9/19/96 (Phase I only) Deed Restrictions Received? 10/21/96
6. Comments:
a. Access to the pond must be available at all times. Please indicate in your reponse the
designated route available for access.
b. Submit the Engineer's Certification for Phase II of the pond. If Phase II has not been
constructed, you are in violation of your permit.
