Dear Mr. Clark:
On October 11, 2024, I, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy,
Mineral and Land Resources(DEMLR), conducted a Compliance Evaluation Inspection at the Preserve at
Lake Upchurch facility, located off of Waldo's Beach Road, in Fayetteville, in Cumberland County, North
Carolina. The purpose of the inspection was to ensure compliance with State Stormwater Management
Permit SW6140402 that was issued on April 25, 2014. A copy of the Compliance Inspection Report is
enclosed for your review. As a result of the inspection and subsequent file review, it has been determined
that the facility is not compliant with the conditions of the subject permit and approved plans.
The required actions that are necessary to bring this site into compliance are noted under the Inspection
Summary and Comments sections of the report. If you have any questions or this office can be of any

Inspection Summary:
The Preserve at Lake Upchurch/SW140402 was last inspected on 6/14/2024 followed by this inspection on
10/11/2024 because the permit is planned to be transferrred from Bill Clark Homes, LLC to The Preserve at
Lake Upchurch Property Owners Association. Previous maintenance issues were addressed as noted under
issued sedimentation/construction stormwater inspection reports. The following compliance issues were noted.:
1. An Engineer's certification is not on file and should be submitted.
2. The submitted Post Construction Stormwater plan does not include the information about the stormwater
measures and specifications, including the swales, inlet and outlet structures. A modified plan will need to be
submitted which includes this information.
The aforementioned issues should be addressed unless the new Permittee is willing to accept these issues with
the transfer of the permit. If so, the new Permittee will need to submit a written letter stating this and that the new
Permittee understands he/she must take responsibility for getting the permit in compliance. The written letter
would reference this permit, The Preserve at Lake Upchurch/SW6140402 and be sent to Attn: Brianna Holland,
Environmental Engineer, DEMLR Stormwater Program, 1612 MSC, Raleigh, NC 27699-1612.
