NORTH CAROLINA Director Environmental Quality October 14, 2024 Kimberly T Pickett, Manager Town Town of Benson PO Box 69 Benson, NC 27504-0069 SUBJECT: NOTICE OF VIOLATION Tracking Number: NOV-2024-DV-0396 Sanitary Sewer Overflows - August 2024 Collection System Permit No. WQCS00109 Benson Collection System Johnston County Dear Permittee: A review has been conducted of the self reported Sanitary Sewer Overflows (SSO's), and a 5 Day Report/s has not been submitted by Town of Benson for the incidents indicated below. The Division's Raleigh Regional Office concludes that Town of Benson violated Permit Condition IV (2) of Permit No. WQCS00109 by failing to file a 5-Day spill report. Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143 215.1(a)(1), for which a permit is required. Please submit a written response to this Notice of Violation. Your response is to be received by the regional office within 15 business days following receipt of this violation. Please include any additional documentation about this incident(s) in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for the cited violations.
