Division staff has confirmed that the subject permit is no longer required. Therefore, in
accordance with your request, NPDES Permit NCO022675 is rescinded, effective immediately.
If in the future your firm wishes to discharge wastewater to the State's surface waters, they must
first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day.

Dear Mr. Misuraca:
The Division received your application for a wastewater discharge permit on January 26, 2006. Division
personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES
discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 2004, and as subsequently amended.
Please note the following chancres have been incorporated into the final NPDES permit:
• Two (2) additional effluent parameters have been added to the monitoring and reporting requirements.
The permitted facility will be required to monitor and report quarterly values detected for Total
Kjeldahl Nitrogen (TKN) and Nitrate plus Nitrite Nitrogen (NO3-N and NO2-M {see Part I. A. (1.)); and
A permit re -opener clause has been added that allows the Division to re -open the permit in order to
incorporate or modify effluent limits, monitoring and reporting requirements, and other permit
conditions when it deems such action is necessary to implement nutrient management requirements.
(See Part I. A. (3.))
Please note that this facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water
Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of nutrients from all
discharges to NSW waters. Facilities permitted to discharge greater than 500,000 gallons per day (and any
new or expanding facilities) will be subject to nutrient limitations for total nitrogen and total phosphorus
according to House Bill 515 requirements. Since modifications to treatment systems are expensive and time
consuming, we strongly recommend that you begin planning for this possibility now if a future expansion is
anticipated.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of
the North Carolina General Statutes, and filed with.the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be •final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

A. (2.) WASTEWATER MANAGEMENT PLAN
No later than 180 days after the effective date of this permit, the Permittee shall
submit a wastewater management plan for this facility. The plan shall include, at
a minimum, the following elements:
• Future flows. Provide estimates of wastewater flows and
characteristics for the next 10-20 years and the basis for those
estimates, including assumptions and calculations.
• Alternatives analysis. Conduct a technical and economic evaluation
of wastewater disposal alternatives, specifically including at least the
following alternatives:
• connection to the City of Greensboro wastewater collection system
• conversion to a spray irrigation system
• any combination of the above options
The analysis and report should be consistent with the EAA guidance
document provided by the Division.
• Facilities assessment. Describe deficiencies and operational
difficulties in the existing collection and treatment systems which affect
performance or permit compliance. Identify potential improvements to
correct those deficiencies. At a minimum, evaluate the following
considerations:
• inflow and infiltration,
• equipment repairs and preventative maintenance,
• removal of accumulated solids, wastes, other debris
• Optimization plan. Develop a plan for optimization, rehabilitation,
expansion and/or replacement of the collection and treatment systems
to achieve optimum performance. Identify specific measures and key
tasks, including those in the above facilities assessment, and provide
an estimated schedule for completion of each.
• Biosolids management plan. Develop an operations plan to be used
(and describe the procedures currently used) for managing septage /
biomass in the treatment system, including associated solids wasting
and disposal, to promote optimum treatment system performance.
Identify operating parameters to be used and target values or ranges of
values where appropriate. '
• Communications plan.. Describe a plan for informing customers
served by this facility of their potential impacts on treatment system
performance and appropriate practices for minimizing those impacts,
including a schedule for implementation of the plan. At a minimum,
include the following elements:
• oil and grease contributions to the collection and treatment system,
• introductory material for new tenants, describing acceptable waste
disposal practices
• common practices that adversely affect the collection/treatment system
• notification procedures in case of emergencies.

A request for an Authorization to Construct (ATC) was received by the Division and final plans and
specifications for this project have been reviewed and found to be satisfactory. Authorization is hereby granted
for construction of facilities at the above referenced facility. Specifically, this Authorization to Construct permits
the construction of an equalization tank and tertiary treatment system including the following:
• 6" DIP influent line from existing bar screen to new equalization tank;
• 20'x10'x10' Equalization tank with coal tax epoxy coating:
Dual Myers MW50 influent pumps (1/2 hp, 1625 rpm, 2" discharge, 2" max solids);
Dual Myers ME317 transfer pumps (1/3 hp, 1550 rpm, 1-1/2" discharge, 3/4" max solids);
• Dual 12.57 sq.ft. sandIllters;
• A stainless steel flow splitter box;
• Dual Myers 3WHV backwash pumps (2 hp, 1750 rpm, 3" discharge, 2.5" max solids);
• Fiberglass baffled chlorine contact tank;
• 6" flltered effluent line to new Dechlorination tank;
• 6" DIP backwash return line to influent pump station:
• End of backwash return line downturn (noted on plans) at influent manhole;
• New 55 gallon storage tank and peristalic metering pump for NaHOCI feed: and
• All necessary piping and appurtenances.
This Authorization to Construct is issued in accordance with NPDES Permit No. NCO022675 issued
September 1. 2001, and shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in the permit.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-
215.1 and in a manner approved by the North Carolina Division of Water Quality.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.

The Winston-Salem Regional Office, telephone number [phone]. shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m.
until 5:00 p.m. on Monday through Friday. excluding State Holidays.
Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified
water pollution control treatment system operator to be in responsible charge (ORC) of the water pollution
control treatment system. The operator must hold a certificate of the type and grade at least equivalent to or
greater than the classification assigned to the water pollution control treatment system by the Certification
Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to
comply with the conditions of Title 15A. Chapter 8G, .0202. The ORC of the facility must visit each Class I
facility at least weekly and each Class 11, 111, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with all
other conditions outlined in Title 15A, Chapter SG, .0204. Once the facility is classified, the Permittee must
submit a letter to the Certification Commission which designates the operator in responsible charge within: (A)
Sixty calendar days prior to wastewater being introduced into a new system or (B) within 120 calendar days of
the following. (I) after receiving notification of a change in the classification of the system requiring the
designation of a new ORC and back-up ORC or (it) a vacancy in the position of ORC or back-up ORC.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life
of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General
Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
Upon completion of construction and prior to operation of this permitted facility, a certification must be
received from a professional engineer certifying that the permitted facility has been installed in accordance with
the NPDES Permit, this Authorization to Construct and the approved plans and specifications. Mail the
Certification to the NPDES Unit, Division of Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617.

Please find enclosed three copies of the plans and specifications for the construction of
improvements to the Birmingham Place (Previously Country Club) Mobile Home Park
Wastewater Treatment Plant NPDES Permit No. NC0022675. No increase in flow or
modifications to the discharge limits are being requested for this submittal.
We respectfully authorization to construct the following improvements to the Birmingham
Place Mobile Home Park wastewater treatment plant.
1. New dual sand filters consisting of two 12.57 square foot sand filters and two
backwash pumps.
2. Interconnecting piping, backwash return piping and filtered effluent piping.
3. New 15,000 gallon equalization basin with duplex influent pumps.
4. New duplex transfer pumps.
5. New sodium hypochlorite feed system.
6. Convert existing chlorine contact tank into dechlorination tank.
7. Install new magnetic flow meter ahead of the sand filters.
The design calculations are included with the specifications as well as a construction
sequence. Minimal disruption to the plant flow will occur.

Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are
forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated May 9, 1994 (or as subsequently amended).
Please note that Part I. A. (2.) has been added to the permit, requiring submission of a Wastewater Management Plan to
the NC DENR Winston-Salem Regional Office. The Plan must be submitted on or before February 28, 2002.
Be aware that Little Alamance Creek is listed as an impaired stream on North Carolina's 303(d) list. This means that the
stream does not meet all water quality standards. The Division is working toward the improvement of water quality in little
Alamance Creek. If the Division's current initiatives do not result in improved water quality, removal of discharges to Little
Alamance Creek may be necessary for the health of the stream. While the Division believes multiple point -source discharges ate
causing degradation to Little Alamance Creek, we will continue to monitor compliance at your facility. If noncompliance with
your permit's effluent limits is shown to be a direct cause of stream degradation, the Division will recommend removal of your
facility's discharge.
Little Alamance Creek is a nutrient -sensitive water (NSW). In 1997 the Clean Water Responsibility Act (House Bill 515)
was enacted, with the intent to strengthen the control of nutrients from all discharges to NSW waters. Facilities permitted to
discharge greater than 500,000 gallons per day (and any new or expanding facilities) will be subject to nutrient limitations for
total nitrogen and total phosphoms according to House Bill 515 requirements.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request
must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is
made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other
peonies which may be required by the Division of Water Quality or permits required by the Division of land Resources, the
Coastal Area Management Act or any other Federal or Local governmental permit that may be required. If you have any

A. (2.) WASTEWATER MANAGEMENT PLAN
No later than 180 days after the effective date of this permit, the Permittee shall submit a wastewater
management plan for this facility. The plan shall include, at a minimum, the following elements:
• Future flows. Provide estimates of wastewater flows and characteristics for the next 10-
20 years and the basis for those estimates, including assumptions and calculations.
• Alternatives analysis. Conduct a technical and economic evaluation of wastewater
disposal alternatives, specifically including at least the following alternatives:
• connection to the City of Greensboro wastewater collection system
• conversion to a spray irrigation system
• any combination of the above options
The analysis and report should be consistent with the EAA guidance document provided
by the Division.

• Facilities assessment. Describe deficiencies and operational difficulties in the existing
collection and treatment systems which affect performance or permit compliance. Identify
potential improvements to correct those deficiencies. At a minimum, evaluate the
following considerations:
• inflow and infiltration,
• equipment repairs and preventative maintenance,
• removal of accumulated solids, wastes, other debris
• Optimization plan. Develop a plan for optimization, rehabilitation, expansion and/or
replacement of the collection and treatment systems to achieve optimum performance.
Identify specific measures and key tasks, including those in the above facilities assessment,
and provide an estimated schedule for completion of each.
• Biosolids management plan. Develop an operations plan to be used (and describe the
procedures currently used) for managing septage / biomass in the treatment system,
including associated solids wasting and disposal, to promote optimum treatment system
performance. Identify operating parameters to be used and target values or ranges of
values where appropriate.
• Communications plan. Describe a plan for informing customers served by this facility
of their potential impacts on treatment system performance and appropriate practices for
minimizing those impacts, including a schedule for implementation of the plan. At a
minimum, include the following elements:
• oil and grease contributions to the collection and treatment system,
• introductory material for new tenants, describing acceptable waste disposal practices
• common practices that adversely affect the collection/treatment system,
• notification procedures in case of emergencies.

Marcia, this is one of several facilities either owned or operated by Michael J. Power, a consultant from Chesapeake,
VA. Several of his facilities have had compliance problems. The WSRO has reported that Mr. Power is extremely
difficult to deal with — he either is unwilling to follow the Water Quality Rules or simply ignores them.
Mr. Power attempted to get the name & ownership of the subject facility changed from Gary Hedrick (the previous
owner) in April 1999. I returned Power's request as incomplete on 4/22/99; he did not submit a deed or any other
documentation showing he owned the facility. He never resubmitted the request, and I'm not certain that he does
own the facility — he may only be the operator. However, someone changed IMS such that the mailing address for
the facility became Power's old mailing address in Michigan.
A renewal notice dated December 4, 2000 (267 days prior to permit expiration) was sent to Gary Hedrick (the former
owner, who lives in Greensboro) at the Michigan address. No permit application was received in response to the
initial mailing. A Notice of Violation (NOV) dated March 27, 2001 was then sent to Hedrick at the same Michigan
address. The "green card" from the certified mailing indicates the NOV was received on April 2, 2001. To date, no
application has been submitted. Neither letter helped the situation, given the addressing error. I don't know if an
enforcement against Hedrick would help, unless he is the real owner.
The subject permit will expire on June 30, 2001. I need your help to determine who owns this facility, and why that
owner (Hedrick or Power) hasn't submitted a renewal request:
➢ If Power did take ownership, he should be chastised for not completing the name & ownership change by
submitting the necessary documentation. He's also unacceptably late with a permit renewal application.
➢ If Hedrick didn't sell the place and simply hired Power as the owner, he should be chastised for not sending
in his permit renewal.
In accordance with the internal policies of the Point Source Branch regarding delinquent permit renewals, the
NPDES Unit requests that this matter be reviewed by the Compliance Enforcement Unit, and that the appropriate
action be taken against the permittee.

On April 13, 1999, the Division received your request to transfer ownership of the subject permit from
Hedrick Properties to Country Club, LLC. The request did not include any documentation (such as a deed or
sales agreement) showing the date on which your firm took control of the subject facility. I called and left a
message at your office on April 29, 1999, requesting the documentation. To date, the Division has received no
such documentation.
Due to the fluid nature of facility ownership changes, Division policy requires written documentation that
the new owner has taken possession of the permitted facility. In the past, ownership modifications were
erroneously issued due to delayed transfers of ownership, corporate restructuring, abandoned purchases, etc.
For compliance purposes, it is best to have an exact date on record to document when you took control of the
Country Club MHP site.
I apologize for the delay in responding to your request. The NPDES Unit currently has five vacant
positions with an additional staff member on extended medical leave. This staff shortage is delaying all of our
work. Your request is among thirty modification requests I am currently reviewing. Please submit the deed (or
other comparable documentation) and I will complete the name and ownership change modification. Due to a
change in fees for Water Quality permits effective January 1, 1999, the $100.00 fee you submitted (via check #
1523) is being returned. No fee is required for this modification.

A. (3.) POTW Connection Requirement
If this facility is non -compliant with the Effluent Limitations in this permit for a period of three
consecutive months, the permittee shall properly connect to an operational publicly owned
wastewater collection system within 180 days of its availability to the site.
A. (4.) Nutrient Limits
This permit may be modified or revoked and reissued to include an effluent limitation on
nutrients for this facility if:
1. The findings of a study by the Division of Water Quality determine nutrient control is
necessary.
2. Local actions do not successfully reduce the nutrient loading in the receiving stream
3. Problem conditions related to excessive nutrients occur in the receiving stream.

INTRODUCTION
This permit was adjudicated years ago over a requirement to do an alternatives analysis. Coleen S.
believes they did a low flow study to prove that this site was not a zeroflow system. The remaining
sticking issue is whether we waived the requirement to do an alternatives analysis.
ENGINEERING ALTERNATIVES ANALYSIS
For what I could determine, the alternatives analysis requirement was not waived. As of Sept. 4, 1996
no alternatives analysis has been submitted. In a Nov. 1993 memo, the, region requested that the facility
get an indefinite extension for the analysis if they provided written documentation that they intend to
connect to the Greensboro sewer. I could not find any evidence that this offer was extended to the
permittee. More recently, the region has reiterated their desire to have the permittee connect to the city
sewer instead of having the permittee investigate any alternatives.
SEWER LINE CONNECTION
Larry Harwell of Guilford County Planning and Development office [phone], stated that the
MHP can connect to the Youngs Mill Road Ext. once construction is complete. This project is now
under contract, and he estimates completion in 12 to 18 months. Connection will require them to install
approximately 3,800 LF of gravity line from the Country Club MHP. Dr. Tally had been in contact with
Mr. Harvell and Mr. Richard Huffman [phone] City of Greensboro Engineer, some time ago
seeking information on connection. Mr. Huffman gave him a rough cost estimate.
COMMITMENT TO CONNECT
Dr. Talley's letter of April 4, 1996 to M. Wiggins stated that the SOC was being finalized and would be
submitted that same month. However, to date, there has not been any submission or commitment on the
part of Dr. Talley to connect. The region has not pursued the securing SOC since sending their April 15,
1996 letter to the permittee.

Per Bob Sledge, the facility was assessed financial penalties amounting to $3,284 in Jan. 1995 and
$7,830.92 on June 28, 1996.
CONCLUSION
After our discussions, it was decided that this case should be left open until there is a resolution of
connection to the sewer.

Enclosed are the most recent notices of violation (NOV) for effluent limit violations that exist
in the Water Quality Section's files in Winston-Salem. Also, please find enclosed an application
for a special order by consent (SOC).
I fully understand the complexity surrounding the operation and maintenance of a waste water
treatment facility. Our office will try to work with you towards the elimination of your
discharge by connecting to the Greensboro city sewer system. Meanwhile, the continued proper
maintenance of your plant is crucial. I recommend two actions: 1) request an SOC and 2) seek
operational advice from the DEM Water Quality Certification and Training group.
An SOC could assist you by possibly relaxing the effluent limits thereby potentially reducing the
chance of continued enforcement actions. The SOC will aid DEM by establishing a defined
timetable for elimination of your discharge.
The Water Quality Certification and Training group operates a special advisory program that
offers operational assistance to plant operators. The advice of this group is strictly non -
regulatory. your operator can contact Ron Ferrell in Raleigh at [phone], Mr. Ferrell's
group helps operators maximize the efficiency of treatment facilities.
I also recommend that either you or your engineer begin to make arrangements for the approval
and construction of your proposed sewer line. I am not aware of the steps taken by you to
construct this sewer line. However, it is my understanding that you will need approval from the
Guilford County Planning and Development office. Betty Garrett is the proper contact person
(let. [phone]). Engineering plans for the sewer line must be submitted and approved
either by the City of Greensboro engineer (Richard Huffman 910-373-2055) or by DEM before
construction.

Dear Mr. Wiggins:
This letter is in response to your phone inquiry on 4-2-96 regarding the progress of our
SOC (Special Order of Consent) as this very important document will provide this Facility
interim NPDES Compliance as to Effluent Level guidelines, etc. to continue as an operating
Facility under your to -be -issued NPDES Permit. This interim operating period is projected
to be short-term until the Municipal Sewer Service tap -on is completed (December 1996)
by this Facility at its own cost.
SOC (SUBMITTAL UPDATE)
This SOC is now being finalized after much professional input and revision for submittal of
this final version to Mr. Coble and staff (Ron Linville) in your Winston Salem Regional Office
this month by our Greensboro Utility Attorney. We expect prompt approval of this SOC
based on my extended conversation and display/discussion of our SOC Draft No.1 shown
to Mr. Coble in a Raleigh Meeting (2-08-96) to his great satisfaction.
As stated, this SOC Approval will enable us to operate at an amended Compliance Level
for our WWTPlant while we are installing this new 3,800ft Main Sewer Line for attachment
(tap -on) to the Greensboro Sewer System on or before December 1996 when such Munici-
pal Sewer Service will be available to us in our general area as a major Sewer Extension
Project of the City of Greensboro/Guilford County.
TIMING (GREENSBORO SEWER TAP -ON)
The _ hedule for Work Comoleti� is contained in the SOC Form and states a 3-Phase
Work Completion Schedule to run from SOC Approval Date (from Coble office) to com-
pletion in December 1996 when Municipal Sewer Service tap -on will occur to the Greens-
boro City Sewer line (Youngs Mill Road Sewer Line Project now underway), at which time
this NPDES Permit will be canceled and our WWTPlant terminated. No delays are antici-
pated although no actual work has begun beyond our Preliminary Site Plan. The Decem-
ber 1996 Tap -On Date was given to us by the Greensboro Sewer Department Director.
Mrs. Elizabeth P. Talley (widow) appreciates your consideration of this NPDES Renewal
Application and this special circumstance (SOC) that is a full compliance of a 1995 DEM re-
quest to complete an SOC as procedurally necessary for this short-term interim operation

This letter shall serve as the second response to the above mentioned Letter (NOV/CSI of
3-11-93 / postmarked 3-16-93 / received on 3-18-93) as required by said letter by 4-19-93,
and now under the Letter of Extension to 5-18-93 from Seven Mauney. In the interim we have
been contacted by Jay Osborne with the Environmental Investigation Division of the N.C. Jus-
tice Department for settlement/payment negotiations during April and May,1993 for payment
of the $2,170 1992 NPDES Penalty Fine (assessed in D.E.M. letter of 6-22-92), This Settlement
involves also your 1993 request (letter 3-11-93, paragraph 3, copy attached) for the Engineer -
in R (Alternative Effluent Discharge Reporq as explained In the following explanation of
events of CCMHPark attempts to comply fully at this time.
ENGINEERING REPORT (Alternative Effluent Discharge Report)
A settlement amount was reached on May 10, 1993 (see Jay Osborne letter of 5-10-93) by
letter after the various departmental reviews, and the $1,220 Revised Penalty promptly paid in
full to Jay Osborne's office on 5-28-93 (see Osborne receipt of payment of $1,220 letter dated
6-02-93 attached to this effect) as required. A condition of that Penalty settlement co -Joins
your pre-existing Report requirement for the completion and submittal of the engineering -report
ofAiternative Effluent Discharge Reportrequired in the 1991 NPDES Permit Renewal (Part III, F_)
due in late 1992 under the 1-year compliance for production of this Report.
As a condition of this 1992 $2,170 Penalty Settlement, I was instructed by Jay Osborne of
the Justice Department in his Settlement Letter (5-10-93) of this $2,170 Penalty (6-22-92) to
contact Mac Wiggins at D.E.M. about completion/submittal date of this Report as the only
remaining condition of that Settlement (see letter 5-10-93 / paragraph 3). Upon calling Mae
Wiggins In mid May, 1993 he notified me that he was not the responsible person for such
determination_ I then was passed to several different administrative people repeating the
same story per Jay Osborne's directive letter (5-10-93) with no resolution of the problem.
In an effort to fully comply with the 2d t remaining Settlement condition (completion/submit-
tab of theAlternative Effluent Discharge Reportto D.E.M.) I am awaiting an a appointment with
Director C. Sullin after having been to her office on 2 occasions and she in meetings (May &

Research & Analytical Laboratories (Kernersville, NC) have continued their operation/moni-
toring Contract uninterrupted since 1980 for this Plant and continue to make standard Plant
Site visits daily in an effort to maintain this VAVTPlant at a fully compliant level continuously.

CHRONIC TOXICITY TESTING REQUIRENIEN f (Qi:TRLY)
The effluent discharge shall at no time exhibit chronic toxicity in any two consecutive toxicity tests,
using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic
Bioassay Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or
significant mortality isgA—% (defined as treatment two in the Notch Carolina procedure
document). The permit holder shall perform quarterly monitoring using this procedure to establish
compliance with the permit condition. The first test will be performed after thirty days from
issuance of this permit during the months of J Cr Effluent
sampling for this testing shall be performed at the NPDES permitted final effluent discharge below
all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge MonitoringFotm (MR-1) for the month in which it was performed, using the parameter
code TGP3B. -Additionally; DEM Form AT-1 (original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in -association with the toxicity tests, as well as all doselresponse data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in die months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Environmental Management indicate potential impacts to die receiving stream, this
permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate retesting(within 30 days of initial monitoring event). Failure to submit
suitable test results will constitute noncompliance with monitoring requirements.

Dear Dr. Talley:
Chlorine, a widely used wastewater disinfectant for the treatment of coliform organisms, often
remains instream in residual amounts that may prove to be toxic under critical low stream flow
conditions. In the last decade, EPA assessed the potential adverse effects of chlorine to the aquatic
environment and has taken steps to reduce the impacts through the development of federal criteria.
In 1986, EPA recommended that all states have a chlorine standard by their next triennial review of
water quality standards.
In revising its water quality standards in 1989, North Carolina developed an action level for
chlorine of 17 ug/1(freshwater classes only). In addition, the fecal coliform limit was reduced from
1000 colonies/100 nil to 200 colonies/100 ml. Under a new DEM procedure, dechlorination and
chlorine limits are now recommended for all new or expanding dischargers proposing the use
chlorine for effluent disinfection. The Division is reviewing chlorine levels from all existing
dischargers as part of their NPDES permit renewal process.
Our records indicate that chlorine from your facility's effluent discharge is considered toxic to the
receiving stream under low flow conditions, i.e., the amount of chlorine discharged causes a
violation of the instream action level for chlorine (17 ug/1) under 7Q10 conditions (the lowest average
daily flow for seven (7) consecutive days during a ten (10) year period). Action should be taken to
reduce the effluent concentration of chlorine to an acceptable level. Based on your instream waste
concentration of 100%, an acceptable level of chlorine in your effluent is 17 ug/l or 0.017 mg/l. If
this level is not feasible, you should consider dechlorination or alternate methods of disinfection for
your facility to ensure that both chlorine and bacterial limits are met. However, please note that an
authorization to construct must be obtained from this Division prior to any alteration to your
treatment plant.
The Division is currently reviewing its water quality regulations pertaining to chlorine. In the
future, effluent limits and/or dechlorination may be required of existing facilities with chlorine

and South and ranges from 3 to 5% unless graded. There
are erosion problems near the entrance to the plant.

PART IV - EVALUATION AND RECOMMENDATIONS
Dr. D. J. Talley, the apparent owner changes his title
every time he applies. It would seem appropriate to know
just what his true relationship with this MHP entails.
The WSRO recommends the issuance of a new Permit for
this facility reflecting the low flow of the receiving
stream. Water supply comments should be obtained. The
Permit should reflect the latest DEM Policies.
