Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Fourth Street, Suite 440 Royal Oak, MI 48067-2502 Subject: Issuance of NPDES Permit NCO022675 Birmingham Place MHP WWTP Guilford County Dear Mr. Misuraca: The Division received your application for a wastewater discharge permit on January 26, 2006. Division personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 2004, and as subsequently amended. Please note the following chancres have been incorporated into the final NPDES permit: • Two (2) additional effluent parameters have been added to the monitoring and reporting requirements. The permitted facility will be required to monitor and report quarterly values detected for Total Kjeldahl Nitrogen (TKN) and Nitrate plus Nitrite Nitrogen (NO3-N and NO2-M {see Part I. A. (1.)); and A permit re -opener clause has been added that allows the Division to re -open the permit in order to incorporate or modify effluent limits, monitoring and reporting requirements, and other permit conditions when it deems such action is necessary to implement nutrient management requirements. (See Part I. A. (3.)) Please note that this facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of nutrients from all discharges to NSW waters. Facilities permitted to discharge greater than 500,000 gallons per day (and any new or expanding facilities) will be subject to nutrient limitations for total nitrogen and total phosphorus according to House Bill 515 requirements. Since modifications to treatment systems are expensive and time consuming, we strongly recommend that you begin planning for this possibility now if a future expansion is anticipated. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with.the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be •final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. WASTEWATER MANAGEMENT PLAN No later than 180 days after the effective date of this permit, the Permittee shall submit a wastewater management plan for this facility. The plan shall include, at a minimum, the following elements: • Future flows. Provide estimates of wastewater flows and characteristics for the next 10-20 years and the basis for those estimates, including assumptions and calculations. • Alternatives analysis. Conduct a technical and economic evaluation of wastewater disposal alternatives, specifically including at least the following alternatives: • connection to the City of Greensboro wastewater collection system • conversion to a spray irrigation system • any combination of the above options The analysis and report should be consistent with the EAA guidance document provided by the Division. • Facilities assessment. Describe deficiencies and operational difficulties in the existing collection and treatment systems which affect performance or permit compliance. Identify potential improvements to correct those deficiencies. At a minimum, evaluate the following considerations: • inflow and infiltration, • equipment repairs and preventative maintenance, • removal of accumulated solids, wastes, other debris • Optimization plan. Develop a plan for optimization, rehabilitation, expansion and/or replacement of the collection and treatment systems to achieve optimum performance. Identify specific measures and key tasks, including those in the above facilities assessment, and provide an estimated schedule for completion of each. • Biosolids management plan. Develop an operations plan to be used (and describe the procedures currently used) for managing septage / biomass in the treatment system, including associated solids wasting and disposal, to promote optimum treatment system performance. Identify operating parameters to be used and target values or ranges of values where appropriate. ' • Communications plan.. Describe a plan for informing customers served by this facility of their potential impacts on treatment system performance and appropriate practices for minimizing those impacts, including a schedule for implementation of the plan. At a minimum, include the following elements: • oil and grease contributions to the collection and treatment system, • introductory material for new tenants, describing acceptable waste disposal practices • common practices that adversely affect the collection/treatment system • notification procedures in case of emergencies. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday. excluding State Holidays. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified water pollution control treatment system operator to be in responsible charge (ORC) of the water pollution control treatment system. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the water pollution control treatment system by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A. Chapter 8G, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class 11, 111, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions outlined in Title 15A, Chapter SG, .0204. Once the facility is classified, the Permittee must submit a letter to the Certification Commission which designates the operator in responsible charge within: (A) Sixty calendar days prior to wastewater being introduced into a new system or (B) within 120 calendar days of the following. (I) after receiving notification of a change in the classification of the system requiring the designation of a new ORC and back-up ORC or (it) a vacancy in the position of ORC or back-up ORC. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. Power, a consultant from Chesapeake, VA. Several of his facilities have had compliance problems. The WSRO has reported that Mr. Power is extremely difficult to deal with — he either is unwilling to follow the Water Quality Rules or simply ignores them. Mr. Power attempted to get the name & ownership of the subject facility changed from Gary Hedrick (the previous owner) in April 1999. I returned Power's request as incomplete on 4/22/99; he did not submit a deed or any other documentation showing he owned the facility. He never resubmitted the request, and I'm not certain that he does own the facility — he may only be the operator. However, someone changed IMS such that the mailing address for the facility became Power's old mailing address in Michigan. A renewal notice dated December 4, 2000 (267 days prior to permit expiration) was sent to Gary Hedrick (the former owner, who lives in Greensboro) at the Michigan address. No permit application was received in response to the initial mailing. A Notice of Violation (NOV) dated March 27, 2001 was then sent to Hedrick at the same Michigan address. The "green card" from the certified mailing indicates the NOV was received on April 2, 2001. To date, no application has been submitted. Neither letter helped the situation, given the addressing error. I don't know if an enforcement against Hedrick would help, unless he is the real owner. The subject permit will expire on June 30, 2001. I need your help to determine who owns this facility, and why that owner (Hedrick or Power) hasn't submitted a renewal request: ➢ If Power did take ownership, he should be chastised for not completing the name & ownership change by submitting the necessary documentation. He's also unacceptably late with a permit renewal application. ➢ If Hedrick didn't sell the place and simply hired Power as the owner, he should be chastised for not sending in his permit renewal. In accordance with the internal policies of the Point Source Branch regarding delinquent permit renewals, the NPDES Unit requests that this matter be reviewed by the Compliance Enforcement Unit, and that the appropriate action be taken against the permittee. Coleen S. believes they did a low flow study to prove that this site was not a zeroflow system. The remaining sticking issue is whether we waived the requirement to do an alternatives analysis. ENGINEERING ALTERNATIVES ANALYSIS For what I could determine, the alternatives analysis requirement was not waived. As of Sept. 4, 1996 no alternatives analysis has been submitted. In a Nov. 1993 memo, the, region requested that the facility get an indefinite extension for the analysis if they provided written documentation that they intend to connect to the Greensboro sewer. I could not find any evidence that this offer was extended to the permittee. More recently, the region has reiterated their desire to have the permittee connect to the city sewer instead of having the permittee investigate any alternatives. SEWER LINE CONNECTION Larry Harwell of Guilford County Planning and Development office (910) 373-3394, stated that the MHP can connect to the Youngs Mill Road Ext. once construction is complete. This project is now under contract, and he estimates completion in 12 to 18 months. Connection will require them to install approximately 3,800 LF of gravity line from the Country Club MHP. In the last decade, EPA assessed the potential adverse effects of chlorine to the aquatic environment and has taken steps to reduce the impacts through the development of federal criteria. In 1986, EPA recommended that all states have a chlorine standard by their next triennial review of water quality standards. In revising its water quality standards in 1989, North Carolina developed an action level for chlorine of 17 ug/1(freshwater classes only). In addition, the fecal coliform limit was reduced from 1000 colonies/100 nil to 200 colonies/100 ml. Under a new DEM procedure, dechlorination and chlorine limits are now recommended for all new or expanding dischargers proposing the use chlorine for effluent disinfection. The Division is reviewing chlorine levels from all existing dischargers as part of their NPDES permit renewal process. Our records indicate that chlorine from your facility's effluent discharge is considered toxic to the receiving stream under low flow conditions, i.e., the amount of chlorine discharged causes a violation of the instream action level for chlorine (17 ug/1) under 7Q10 conditions (the lowest average daily flow for seven (7) consecutive days during a ten (10) year period). Action should be taken to reduce the effluent concentration of chlorine to an acceptable level. Based on your instream waste concentration of 100%, an acceptable level of chlorine in your effluent is 17 ug/l or 0.017 mg/l. If this level is not feasible, you should consider dechlorination or alternate methods of disinfection for your facility to ensure that both chlorine and bacterial limits are met. However, please note that an authorization to construct must be obtained from this Division prior to any alteration to your treatment plant. The Division is currently reviewing its water quality regulations pertaining to chlorine.
