A couple of quick follow-up questions to your comment below.
1. The subject site lies in the Cape Fear River Basin. The code section you referenced (15A NCAC
02B .0714) applies to the Neuse River and would be for the 50' Riparian Buffer I believe. Since this
site is in the Cape Fear, I'm not aware of any state required vegetated setbacks for the Cape
Fear. Is there a particular setback you're referring to? Can you reference where any vegetated
setbacks are required in the code?
2. 1 believe we had the on-site determination with USACE staff and agreed upon by State staff with
the 401/404 permits. I've attached all of the permit documents for the 401/404 approvals for
reference if you didn't already have them. With the approval from the State and USACE, we were
given approval to breach the dam of the existing on-site pond and drain it. We are in the process
of getting the dam breach plans approved through the DEQ Regional Office, which would remove
the pond from the site. I believe that would alleviate the need for any setbacks as well, but can
you confirm?
Hopefully one of these two items answers the question and we can get the permit processed. Let me
know if you still need something else, and we'll jump on it!

Good evening,
The project appears to be complete except for one issue. Please provide the on-site determination performed by
Authority staff and the permit can be processed. If it is determined that Authority staff that the surface water
exists on-site, please revise the package as necessary.
1. Previous comment: Please include the required vegetated setback from the existing on-site pond
(surface water) in the main set ofplans in accordance with 15A NCAC 02H.1042(2)(g)(iii).
We use the USGS topographic map to determine if there are surface waters present on-site. We understand
that these maps may not accurately reflect existing site conditions for all sites which is why relief from the
surface water requirements can be allowed when surface waters are not present in accordance with 15A
NCAC 02B .0714(3)(a).
When a landowner or other affected party believes that the maps listed in Sub-Item (3)(a) of this
Rule have inaccurately depicted surface waters or the specific origination point of a stream, or
the specific origination point of a stream is in question or unclear, he or she shall request the
Authority to make an on-site determination. On-site determinations shall be made by Authority
staff that are certified pursuant to G.S. 143-214.25A. Registered Foresters under Chapter 89B of
the General Statutes who are employees of the North Carolina Forest Service of the Department
of Agriculture and Consumer Services can make on-site determinations for forest harvesting
operations and practices. On-site determinations shall expire five years from the date of the
determination. Any disputes over on-site determinations shall be referred to the Director in
writing within 60 calendar days of written notification from the Authority. The Director's
determination is subject to review as provided in G.S. 150B.
Barring this on-site determination, it is assumed that this surface water is present and must be accounted
for. Please either contact staff from the Fayetteville Regional Office to make a determination with regard
to this surface water or account for this surface water by showing this surface water on the plans,
excluding the surface area from the project area, and including the required vegetated setback. This on-
site determination was not provided, and USACE jurisdictional waters are distinct from water of the
state. Therefore a determination must be made by an individual named above.

a. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance
with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility
Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby
incorporated as special conditions of this permit authorization.
b. Suitable habitat for tricolored bat(Perimyotis subflavus)may be present at the site. On September 14, 2022,
the USFWS published a proposal in the Federal Register to list the tricolored bat as endangered under the
Endangered Species Act(ESA). The permittee understands and agrees that all work associated with the
clearing and removal of trees and removal or modification of culverts must be completed prior to the effective
date of the final listing in the Federal Register. Work associated with the aforementioned activities not
completed by that time must cease and the permittee must contact the Corps' (Katharine Elks, 910-251-4567,
Katharine.B.Elksgusace.army.mil)to determine if additional coordination with the United States Fish and
Wildlife Service is required under Section 7 of the Endangered Species Act prior to continuing work.

Conditions for Transfer of Compensatory Mitigation Credit:
• Once this document has been signed by the Mitigation Sponsor and the District is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only after
the District is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has accepted
responsibility for providing the mitigation requirements listed herein. When NCDMS provides mitigation for authorized
impacts conducted by the North Carolina Department of Transportation(NCDOT),construction within jurisdictional areas
may proceed upon permit issuance; however, a copy of this form signed by NCDMS must be provided to the District
within 30 days of permit issuance. NCDOT remains fully responsible for the mitigation until the District has received this

Good Afternoon,
We received your application for a new post-construction stormwater permit on 12/29/23. At this time,
the submission is not administratively complete and cannot be accepted for review in its current
condition. Please provide the following submittal items by close of business on 1/20/24 so that we may
accept the project and begin the review process, otherwise, the project will be returned as
administratively incomplete.

1. 2x hard copies of the Application with the following corrections made (These items are required
per 15A NCAC 02H .1042(2)(a) and per Section VI, 1 of the Application):
1. Section IV, 5—As this project is not in a coastal county, there should be no coastal
wetlands. Please revise this value and the total project area.
2. Section IV, 8—The percent impervious area for the project area does not appear to be
calculated correctly. Project density calculation information can be found in 15A NCAC
02H .1003(1).
As these items are minor things,the revised page of this application can be emailed and I
can add it to your existing application.
NOTE:This is an administrative completeness review, not a detailed engineering review, there may be
other issues that may be brough up during the engineering review.
If these items are received within the stipulated timeframe, we can accept the project and begin the
review process. Once accepted, reviews under the standard permitting process can take up to 90
calendar days per statute (one of our two reviewer positions is currently vacant).

number)for the property owners. A file has been attached to allow for space for all 4

3. Section VI—Please initial indicating that you have submitted all the required
information relevant to the project's application.
3. 1x hard copy of sealed, signed, and date calculations relevant to the application's project.This
item is required per 15A NCAC 02H .1040(2)(f) and per Section VI, 7 of the application.The cover
page for this is missing a seal and signature.
4. 1x hard copy of official documentation showing that the Applicant is in good standing with the
Secretary of State and showing the title and position information for the signing official (These
items are required per 15A NCAC 02H .1040(1), .1042(2)(b), and per Section VI, 11 of the
Application).
5. 2x signed &sealed hard copies of a plan sheet showing the following corrected additions:
1. Signature and seals.
2. Project boundary delineation labeled with accurate bearings and distances (Required
per Section VI, 8i of the Application and 15A NCAC 02H .1042(2)(g)(ii)).
