Hey Chad. Hope you are doing well. My office has been reviewing a post-construction stormwater permit
application for the subject project. Part of our review included looking at a USGS topo map for the project location,
which shows a small pond.We had asked the applicant/consultant to account for the pond in their density
calculations and provide the required vegetated setback.The consultant has informed us that they received
approval from the USACOE and DWR to breach and drain the pond.They also provided documentation from the
USACOE that the feature is a pond dug in an upland area and not waters of the US/non-jurisdictional. Do you know
if DWR made the same determination that the pond is not waters of the State/non-jurisdictional?
