GENERAL WARRANTY DEED
THIS DEED made this 30th day of April, 2007, by and between RANDY L. EDWARDS
and wife, RHONDA B. EDWARDS, Grantor, and SMITH-EDWARDS, LLC, a North Carolina
limited liability company, Grantee, whose address is 2643A Wendell Road, Wendell, North
Carolina 27591 (the designation Grantor and Grantee as used herein shall include said parties, their
heirs, successors, and assigns, and shall include singular, plural, masculine, feminine or neuter as
required by context.);
WITNES SETH:
THAT the Grantor, for a valuable consideration paid by the Grantee, the receipt of which is
hereby acknowledged, has and by these presents does give, grant, bargain, and convey unto the
Grantee, that certain lot or parcel of land situated in Marks Creek Township, Wake County, North
Carolina and more particularly described as follows:
Tract#1:
BEING all of that tract of land containing 65.126 acres, including the road right-of-way and
the power line right-of-way, but excluding the House Lot, more or less, as shown on that
map recorded in Book of Maps 2006, Pages 612-614, Wake County Registry, to which plat
reference is hereby made for a full and complete description of said tract of land.
The aforesaid real property is hereby conveyed subject to the following restrictive
covenants:
1. The aforesaid real property shall be used for residential purposes only.
2. The aforesaid real property may be developed only for single family residences and
all residences constructed west of the branch which crosses said real property shall
contain a minimum of 1,500 square feet of heated living area and all residences
constructed to the east of said branch shall contain and minimum of 1,800 square
feet of heated living area.
3. No mobile home, manufactured home or modular home shall be permitted on said
real property.
Tract #2:
BEING all of that parcel of land containing 0.516 acre, including the road right-of-way,
more or less, as shown on that map recorded in Book of Maps 2006, Pages 612-614, Wake
County Registry, to which plat reference is hereby made for a full and complete description
of said parcel of land.

SUBJECT, HOWEVER, to the following Exceptions:
l. Ad Valorem taxes for the year 2007 and thereafter;
2. Easements, Restrictions, Rights-of-Way, and other appurtenances of record in the
Wake County Registry.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
appurtenances thereto belonging to the Grantee in fee simple.
AND THE GRANTOR covenants with the Grantee, that the Grantor is seized of the
premises in fee simple, has the right to convey the same in fee simple, that title is marketable and
free of all encumbrances, and that Grantor will warrant and defend the title against the lawful
claims of all persons whomsoever except for the exceptions stated herein.
IN WITNESS WHEREOF, the Grantor has hereunto set their hands and seals, or if
corporate, has caused this instrument to be signed in the corporate name by its duly authorized
officers and its seal to be hereunto affixed by the authority of its Board of Directors, the day and
year first above written.
