Good afternoon,
The Division of Energy, Mineral, and Land Resources (DEMLR) received a Post-Construction Stormwater
Management Permit Application for the subject project on May 10th, 2024.
15A NCAC 02H .1042(3)(c)of the North Carolina Administrative Code states that an application is considered
approved if the required response times outlined in G.S. 143-215.1 are not met, unless one of the following
exceptions applies:
i. The applicant agrees, in writing,to a longer review period.
ii. A public hearing is required for a final decision.
iii. The applicant fails to provide necessary information for the Division's review.
iv. The applicant denies the Division access to records or premises for information gathering.
As none of these exceptions were relevant to your application,SW6240704 is considered approved on August
8th, 2024 based on the aforementioned regulation (15A NCAC 02H .1042(3)(c)).
We are forwarding Permit No.SW6240201, dated August 8th, 2024,for the construction, operation and
maintenance of the built-upon areas(BUA) and vegetated conveyances or areas associated with the subject
project.This permit shall be effective from the date of issuance and shall be subject to the conditions and
Limitations as specified therein, and does not supersede any other agency permit that may be required.
The original signed permit package and approved plans are being mailed to the permittee, FD Raleigh, Inc., at the

small issue:
Please correct the following:
Please upload the electronic files for this project as requested in the 8/5/24 email.
Electronic files for all permitting documents are required per 15A NCAC 02H .1042(2).
Electronic copies should be uploaded at the following location:

Scott,
I was looking over the additional information you provided on 2/1/24. Everything looks good except for a few small
issues:
Please correct the following:
• Please upload the electronic plan sheets associated with this project to the following location, as indicated in the
2/1/24 email (https://edocs.deg.nc.gov/Forms/SW-Supplemental-Upload). Electronic files are required per 15A
NCAC 02H .1042(2).
• Per the calculations, Ditch 1 is shown to have a bottom width of 0 ft whereas the plans indicate a bottom width
of 0.5 ft (the typical swale detail shows a bottom width of 0.5 ft and there does not appear to be a note
indicating a different bottom width for this swale). Please revise as needed.
• Please correct the following with plan sheet C-3.2—Please clarify that Diches 10, 12, & 21 have bottom widths of
2 ft. It is noted that there is a note indicating this on other section of these ditches (near Ditch 11 & Ditch 22),
however it is not clear that this bottom width applies to Diches 10, 12, & 21 as well. Please revise as needed.
• Please correct the following with plan sheet C-3.3—Please label the swale located between Lots 32 &33 (It
appears to be Ditch 23). Please revise as needed.
• Please correct the following with Section IV, 10 of the Application Form—The provided receiving stream name,
classification, and index number(Johnson Branch, C, 18-20-25-1) do not appear to be correct. Please see the
surface water classification map

• Please correct the following issues with the Supplement-EZ Form, Low-Density Page:
o Line 5—This value is the largest"Vactual"value from the swale design table. Please revise.
o Line 12—This item is required per 15A NCAC 02H .1003(4)(e).
o Swale 6—The provided Vactual value (3.41 fps) differs from the value shown in the calculations (2.99 fps
(for unreinforced vegetation)). Please revise.
Please provide the following:
• 1x electronic copy of the requested files.
• 2x hard copies & 1x electronic copy of the revised plan sheets.
• 1x hard copy & 1x electronic copy of the revised calculation pages (if needed).
• 1x hard copy & 1x electronic copy of the revised pages of the Application Form.
• 1x hard copy & 1x electronic copy of the revised pages of the Supplement-EZ Form.
• 1x hard copy (2x hard copies for plans) & 1x electronic copy of any items needed to address these comments.

Hand Delivery:
Please reach out to me prior to hand delivering a submission to make sure that I (or someone else in my group)
will be able to receive the submission. Do not leave the package in the foyer with the security guard.
NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay the review process and the
submission package may be lost while being sent from the Regional Office to me in the Central Office.

Since these are really minor things, once I get the hard copies, anything else that may have changed from addressing
these issues, and the documents are uploaded to Laserfiche (Provided everything is still in order), we can issue the
permit without doing another formal review.The quickness of the next review for this project is dependent on reviewer
availability.

Standard permitting process can take up to 90 calendar days to complete. You can see where this project stands in the

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be
entered into the electronic form by clicking on the "Add Another Post-Construction File Upload" link directly below the
"State Stormwater Information Uploads" section of the form. YOU MUST CLICK ON THE"ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD"TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads)will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selecting the correct file type ensures that the files are properly named in the electronic repository and it helps

We received your application for a new post-construction stormwater permit on 1/25/24. At this time, the submission is
not administratively complete and cannot be accepted for review in its current condition. Please provide the following
submittal items within 30 calendar days (by close of business on 2/25/24) so that we may accept the project and begin
the review process, otherwise, the project will be returned as administratively incomplete.
• 2x hard copies of the Application with the following corrections made (These items are required per 15A NCAC
02H .1042(2)(a) and per Section VI, 1 of the Application):
o Section IV, 6—Please list the total surface water area of the project.
o Section IV, 10—Please use the information for the first named surface water("Black River", "C; Sw", &
"18-68-12-1")for the receiving stream name, classification and index number.
• 2x signed &sealed hard copies of a plan sheet showing the following corrected additions:
o Remaining Tract-What will happen to this remaining tract? Is it being covered by this permit? Is it
allocated any BUA?
o Vegetated setback from surface waters.This item is required per 15A NCAC 02H .1042(2)(g) &Section
VI, 8p of the Application. Vegetated setbacks are required from all surface waters (more information can
be found in 15A NCAC 02H .1003(4) & .1017(10)). Please only send in the corrected sheets.
NOTE:This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brough up during the engineering review.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process can take up to 90 calendar days per statute (one of our
two reviewer positions is currently vacant).
