POST OFFICE BOX 10127 BIRMINGHAM, ALABAMA 35202 Subject: Application No. WQ0035809 Additional Information Request #1 Stateside WWTP High-Rate Infiltration System Onslow County Dear Mr. McDonald, Division of Water Resources’ Central and Regional staff have reviewed the application package received on April 8, 2024. However, the Division requires additional information before completing our review. Please address the items on the attached pages no later than the close of business on August 5, 2024. Please be aware that the Applicant is responsible for meeting all requirements set forth in North Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the review of the subject application package. The Division may return the application as incomplete pursuant to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in Sections A through S or the Applicant fails to provide the additional information on or before the above- requested date. Please reference the subject application number when providing the requested information. The Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and submit an electronic response to my attention via the Non-Discharge online portal. Kegley from the Wilmington Regional Office (WiRO) reviewed the submitted application package and provided the following comments: a. The Operator in Responsible Charge (ORC) for the facility has stated that high-rate infiltration Basins 3, 4, and 5 may not be assimilating waste at the permitted loading rates. Condition III.15 of the Final Permit issued on January 30, 2023, requires the Permittee to clean the infiltration areas at least once per permit cycle to remove deposited materials that may impede the infiltration process. Please provide the cleaning records for these high-rate infiltration basins pursuant to 15A NCAC 02T .0707(h). b. The Division has only received two months (February 2023 and June 2023) of monitoring well sampling data since the Permittee constructed monitoring wells MW-4, MW-5, and MW-6 on December 5, 2018. Condition IV.13 and Attachment C of the Final Permit issued on January 30, 2023, require the Permittee to submit a Compliance Monitoring Form (GW-59) with attached copies of laboratory analyses every February, June, and October. Please provide all sampling data for these monitoring wells pursuant to 15A NCAC 02T .0105(m). B. Cover Letter: 1. No comment. C. Application Fee: 1. No comment. D. Application (Form: HRIS 06-16): 1. Item IV.9 – Pursuant to Instruction P of Form: HRIS 06-16 and 15A NCAC 02T .0105(c)(10), please provide documentation from the Department’s Natural Heritage Program demonstrating the presence or absence of threatened or endangered species within the boundary of the wastewater treatment, storage, and infiltration facilities. The Division requires this documentation for all new projects and modifications regardless of scope. 2. Item V.11.e – Please add the proposed flow equalization pumps to the table. Pursuant to Instruction D of Form: HRIS 06-16 and 15A NCAC 02T .0704(f), please provide property ownership documentation. See Comment E.2. 2. Condition II.10 of the Final Permit issued on January 30, 2023, requires the Permittee to execute and file with the Onslow County Register of Deeds (RoD) an easement running with the la nd for any land within the compliance boundary of the high-rate infiltration basins that the Permittee does not own (i.e., Basins 1 and 2). The Agreement included with the Final Permit issued on March 1, 2017, which discusses the terms between the A. Sydes Construction, Inc. and Old North State Water Company, Inc. was not filed with the Brunswick County RoD nor does it meet the requirements of 15A NCAC 02L .0107(k). Please either: a. Provide an executed easement document filed with the Onslow County RoD that meets the requirements of 15A NCAC 02L .0107(k) and, if necessary, revise the previous Agreement. b. Revise the previous Agreement to meet the requirements of 15A NCAC 02L .0107(k) and act as an easement running with the land, and file the Agreement with the Onslow County RoD. F. Setback Waivers: 1. The replacement Dosatron pump (supplying sodium hydroxide [NaOH] to the membranes) that the Engineering Plans depict is not included in Section 11-A of the Specifications. If this is not a like- for-like replacement, please include the relevant specifications for the Dosatron pump and any other related components of the membrane clean-in-place (CIP) system pursuant to Instruction J of Form: HRIS 06-16 and 15A NCAC 02T .0704(c)(2).
