Division staff has confirmed that the subject Certificate of Coverage is no longer required.
Therefore, in accordance with your request, NCG510191 is rescinded, effective immediately.
If in the future your company wishes to discharge wastewater to the State's surface waters, they
must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day.

Dear Mr. Weaver:
In response to your July 7, 2009 letter regarding Annual Compliance Monitoring fees for the
annual NPDES permit issued for the subject site and on behalf of our client Mr. Joe Sugg,
Progress Environmental, Inc. (Progress) has prepared this appeal of the annual delinquent fees
assessed to Mr. Sugg. A previous consultant applied for the permit in 1994 and failed to
implement a groundwater remediation system that would have utilized the discharge permit. Mr.
Sugg was not aware that a permit was in -place for the site for discharging recovered groundwater
at the site as corrective action was not undertaken at the site until 2009, therefore he was not
aware of the annual fees required by the North Carolina Department of Environment and Natural
Resources to maintain the permit. Mr. Sugg apologizes for this miscommunication and requests
annual delinquent fees assessed for the subject site be waived.
Mr. Sugg also respectfully requests that the permit be rescinded such that he will not incur future
costs associated with a discharge permit that is not being utilized.

Jeff - Mr. Sugg called yesterday, quite put out about the Certified Mail I sent him regarding his overdue annual fees [a
copy of the letter is attached].
During the conversation, he said that you had told him there was "absolutely no way" to get his permit rescinded.
If that's what you told him, let me clarify things a bit:
If the UST Section decides that no further remediation is necessary at the site [GW Incident 9575 / ranked H235D in
2006], Mr. Sugg can have his Certificate of Coverage (CoQ rescinded. You can request that on his behalf, as he's notified
me that you his Authorized Representative.
OR
If the UST Section believes that further remediation will be required, Mr. Sugg must pay the annual fee each year, and
must pay the overdue fees promptly.
The UST section personnel in the Winston-Salem Regional Office can assist you regarding the need for future
remediation at the site. Contact either Cindy Rintoul or Michael Phelps at 336 771-5000.
Once you've determined which path to take, please call Mr. Sugg and let him know.

your current permit at Part II B. lb. The 2007, 2008 and 2009 fees for the former Sugg's Auto remediation
site have not been paid. The total amount owed is $170.00; a copy of the invoices previously sent to you are
attached.
Failure to pay the annual fee is grounds for revocation of your permit, as documented in Part II
B. 15. This letter serves as final notice that the Division will refer the fees noted above to the
North Carolina Attorney General's Office for collection through the courts unless payment in the
amount of $170,00 is received by July 21. 2009.
Make checks payable to NC DENR; include the CoC number and invoice numbers on the check. Send the fee

The Division received your request for renewal of the subject Certificate of Coverage (CoC) on
February 26, 2006. The revised General Permit was signed on September 20th, 2006 and takes effect October
1, 2006. Accordingly, we are forwarding the attached CoC to discharge under NCG510000. This CoC is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated May 9, 1994.
A copy of the renewed General Permit is enclosed, as well as an updated Technical Bulletin. The
Technical Bulletin summarizes the changes from the previous version of NCG510000. If any parts,
measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this Certificate of Coverage shall be final and binding.
The CoC is not transferable except after notice to the Division. You must notify the Division if you
sell or otherwise transfer ownership of the permitted facility. The Division may require modification or
reissuance of the CoC.
If your facility ceases discharge of wastewater before the expiration date of this permit, contact the
Regional Office listed below. Once discharge from your facility has ceased, this permit may be rescinded.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality, the Division of Land Resources, Coastal Area Management Act or any other

In accordance with your application for an NPDES discharge permit received on February 4, 1994
by the Division, we are herewith forwarding the subject Certificate of Coverage under the state-NPDES
general permit for a groundwater treatment system and one set of final approved plans and specifications.
Authorization is hereby granted for the construction and operation of a groundwater treatment system with
discharge of treated wastewater into North Prong Stinking Quarter Creek. The treatment system shall
consist of a DP-8 Hydro -Flo Oil/Water Separator, a 38DA1T7.5 Low Profile Aeration System, and three
HP-95 High Pressure GAC Vessels. This Certificate of Coverage is issued pursuant to the requirements
of North Carolina and the US Environmental Protection Agency Memorandum of Agreement dated
December 6, 1983 and as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit
are unacceptable to you, you have the right to submit an individual permit application and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and
binding. Please take notice this permit is not transferable. Part II, EA. addresses the requirements to be
followed in case of change of ownership or control of this discharge.
The Authorization to Construct is issued in accordance with Part Ill, Paragraph 2 of NPDES
Permit No. NCG510000, and shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in Permit No. NCG510000.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Winston-Salem Regional Office, telephone number 910/896-7007 shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.

Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, the Certificate of Coverage, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box
29535, Raleigh, NC 27626-0535.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be required by the Division of Environmental
Management or permits required by the Division of Land Resources, the Coastal Area Management Act or
any Federal or Local other governmental permit that may be required.

Approximately two acres, partially paved. The site was a
former service station. There appears to be adequate space
for the planned GW rehabilitation system.
