Therefore, in accordance with your request, NCG510191 is rescinded, effective immediately. If in the future your company wishes to discharge wastewater to the State's surface waters, they must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. (Progress) has prepared this appeal of the annual delinquent fees assessed to Mr. Sugg. A previous consultant applied for the permit in 1994 and failed to implement a groundwater remediation system that would have utilized the discharge permit. Mr. Sugg was not aware that a permit was in -place for the site for discharging recovered groundwater at the site as corrective action was not undertaken at the site until 2009, therefore he was not aware of the annual fees required by the North Carolina Department of Environment and Natural Resources to maintain the permit. Mr. Sugg apologizes for this miscommunication and requests annual delinquent fees assessed for the subject site be waived. Mr. Sugg also respectfully requests that the permit be rescinded such that he will not incur future costs associated with a discharge permit that is not being utilized. During the conversation, he said that you had told him there was "absolutely no way" to get his permit rescinded. If that's what you told him, let me clarify things a bit: If the UST Section decides that no further remediation is necessary at the site [GW Incident 9575 / ranked H235D in 2006], Mr. Sugg can have his Certificate of Coverage (CoQ rescinded. You can request that on his behalf, as he's notified me that you his Authorized Representative. OR If the UST Section believes that further remediation will be required, Mr. Sugg must pay the annual fee each year, and must pay the overdue fees promptly.
