Therefore, in accordance with the request submitted by your Authorized Representative (Michael
Jones of Pyramid Environmental), NCG510228 is rescinded, effective immediately.
If in the future your company wishes to discharge wastewater to the State's surface waters, they
must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day.

The Division received your request for renewal of the subject Certificate of Coverage (CoC) on April
3, 2006. The revised General Permit was signed on September 20t", 2006 and takes effect October 1, 2006.
Accordingly, we are forwarding the attached CoC to discharge under NCG510000. This CoC is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated May 9, 1994.
A copy of the renewed General Permit is enclosed, as well as an updated Technical Bulletin. The
Technical Bulletin summarizes the changes from the previous version of NCG510000. If any parts,
measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this Certificate of Coverage shall be final and binding.
The CoC is not transferable except after notice to the Division. You must notify the Division if you
sell or otherwise transfer ownership of the permitted facility. The Division may require modification or
reissuance of the CoC.
If your facility ceases discharge of wastewater before the expiration date of this permit, contact the
Regional Office listed below. Once discharge from your facility has ceased, this permit may be rescinded.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality, the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local government. If you have any questions concerning this permit, please contact Charles

All discharges shall be in accordance with the effluent limitations, monitoring requirements, and

This certificate of coverage shall become effective October 1, 2006.

Mr. Jones, we have received a renewal application for remediation site NCG510240
(Berico Fuels / Talbert's Grocery).
The new owner name is recorded as 'IT. A.C., Inc.", with Thomas Berry still the primary
contact. Issuing the renewal to T.A.C. should not be a problem. However, does Berico
Fuels no longer exist? If Mr. Berry has merged Berico with a larger company, we need
documentation showing when the sale took place. If Berico Fuels has simply been
renamed, no other information is required.
We have not received a renewal or rescission request for the other Berico site:
Whitsett MiniMart (NCG510228). I responded to your first e-mail on February 16th,
but have heard nothing further. Has a decision been reached regarding renewal or
rescission?

If the site ranking does not require remediation in the future, there's no need to retain this permit.
Please confirm the permit renewal amount ( ? $ 80 ??? ), as it was not stated on the February 10th
letter.
The annual fee of $80 is billed separately each year - there is no fee for the renewal application.

In accordance with your application for permit renewal, the Division is forwarding the subject NPDES general
permit for petroleum contaminated groundwater remediation systems. This General Permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated December 6,1983 and as subsequently amended.
The Certificate of Coverage previously issued to your facility is now valid under the revised General Permit for
discharges associated with groundwater remediation systems (NCG510000 - issued August 22,1996). The new General
Permit is more comprehensive, in that it covers remediation of groundwater contaminated with heavier fuels (such as
diesel, fuel oil, and kerosene) as well as gasoline contamination. Please note that the permit has three effluent
limitations pages. The type of contamination at your site (gasoline only, heavy fuels only, or gasoline and heavy
fuels) will determine the effluent limitations for your discharge.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to request an individual permit by submitting an individual permit application. Please take notice
that the previously issued Certificate of Coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the Certificate of
Coverage.

In accordance with your application for an NPDES discharge permit received October 14, 1994 by
the Division, we are herewith forwarding the subject Certificate of Coverage under the state-NPDES
general permit for groundwater remediation facilities and one set of final approved plans and
specifications. Authorization is hereby granted for the construction and operation of a 7.5 GPM
groundwater remediation facility consisting of an oil/water separator, a 100 gallon equalization tank, a tray
type air stripping unit, a 100 gallon effluent tank, an activated carbon unit with dual carbon units in series,
and associated pumps, blowers, piping, etc. with discharge of treated wastewater into an unnamed
tributary to Back Creek. This Certificate of Coverage is issued pursuant to the requirements of North
Carolina and the US Environmental Protection Agency Memorandum of Agreement dated December 6,
1983 and as subsequently amended.
Prior to initiation of discharge the Permittee must either create a pronounced and confining drainage
way that will insure the wastewater reaches the unnamed tributary to Back Creek or must relocate the
discharge point down slope to a point where a pronounced and confining drainage way exists. All
necessary easements or written permission of property owners should be obtained prior to any ,
construction on non -owned property. The. engineer's certification (required below) should include
documentation on compliance with these requirements.
If any parts, measurement frequencies or sampling requirements contained in this general permit
are unacceptable to you, you have the right to submit an individual permit application and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and
binding. Please take notice this permit is not transferable. Part II, EA. addresses the requirements to be
followed in case of change of ownership or control of this discharge.
The Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES
Permit No. NCG510000, and shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in Permit No. NCG510000.

In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Winston-Salem Regional Office, telephone number (910)771-4600, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00

Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, the Certificate of Coverage, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box
29535, Raleigh, NC 27626-0535.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be required by the Division of Environmental
Management or permits required by the Division of Land Resources, the Coastal Area Management Act or
any Federal or Local other governmental permit that may be required.

Spray Irrigation: Limited area and most of project site has
concrete/asphalt cover. Also, the consulting firm expects
low soil hydraulic conductivity and permeability at the
site.
Connection to Regional Sewer System: the closest sanitary
sewer line is tied to the City of Burlington POTW, and is
located approximately one mile east of the subject facility.
Subsurface: Based on current operating conditions reported
by Soil & Material Engineers (S&ME)and Huffman Oil Company
who operate a groundwater recovery and treatment system on
the adjacent property, re -infiltration rates into the
shallow aquifer are relatively low and currently limit the
demand for increased groundwater recovery rate.

PART IV - EVALUATION AND RECOMMENDATIONS
This application for coverage under General Permit NCG510000
is for a groundwater remediation project at Whitsett Mini -Mart in
Guilford County. Design details of the proposed system are given
above in the staff report. The proposed discharge point is to a
U.T to Back Creek which is classified as C NSW.
At the time of the site visit on November 29, 1994, it was
determined that at the discharge point specified in the
application package does not have positive flow and this point is
at the very head of a drainage area above a small pond where a
pronounced and confining drainage way does not exist. Discharge
here would create nuisance conditions for the property owner at
this point and the down slope property owner. Therefore, WSRO
recommends approval of the discharge be granted in accordance
with current Division policy with the following stipulations:
written permission and any necessary easements which may be
required are obtained from the appropriate land owners so that
the discharge is either piped to an existing, pronounced and
confining drainage way further down slope; or that such a
drainage way is created at the presently proposed point of
discharge which will convey the water to insure that the
discharge reaches the UT without creating nuisance conditions for
the property owner at the discharge point and the down slope
property owner.
