Dear Mr. Mazer:
The Division of Energy, Mineral and Land Resources(DEMLR) has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form,received on August 20, 2024.
The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility on September 12, 2024,Mooresville Regional Office staff found that
275-gallon plastic pallet totes containing hydraulic fluid oil were outside exposed to the elements. Additionally,
a large trash container was found containing multiple plastic products from the site's industrial activity. Trash
containers must be covered or have secondary containment to qualify for a No Exposure Certification. Please
apply for coverage under an NPDES Stormwater Permit or fix the exposure issues and re-apply for a No
Exposure Certification. Information can be found at deq.ne.gov/SW-industrial.
