If in the future your community wishes to discharge wastewater to the State's surface waters, it must
first apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES permit
will subject the responsible party to a civil penalty of up to $25,000 per day.

attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007
(or as subsequently amended).
This final permit contains the changes from your existing permit:

Dear Mr. Guerra:
The South Saxapahaw Homeowners Association (SSHA) has received loan and grant
funding from USDA-RD to replace the water filters and well house at our existing well.
The SSHA has been seeking solutions to eliminate our current discharge and the
significant cost of monitoring the filter backwash water discharge as required under our
permit. The Alamance County Health Department is assisting the Homeowners
Association with options for subsurface disposal of the water, and county staff have
determined that nearby soils are suitable for this purpose.
By this letter, we are hereby notifying your office of our intent to discontinue our
discharge and eliminate our NPDES permit upon completion of our non -discharge
system. The filter replacement and well house construction is underway and the
completion date for the project is December 7, 2011. We expect completion of the
subsurface system in early 2012.
Should you have any questions or need additional information regarding this matter,
please let us know as soon as possible.

Mr. Guerra,
I wanted to keep you informed of the construction activity in progress on
the South Saxapahaw Home Association (SSHA) well house and to see if you are
able to offer any additional advice on our effluent dilemma.
Construction continues to be on track for completion by Nov llth. New water
meters and greensand filters have been installed and waiting their first
test. Water tests are pending and if these are satisfactory the new system
may go on-line in a couple weeks albeit required inspections by Duke Energy
are still pending.
As you know, the original engineering plans called for a gravel/stone pit to
replace the current sand bed filter system used to filter the backwash as a
solution to eliminate and avoid the new cost -prohibitive NPDES permit testing
requirements. The backwash being only about 500 gallons a week shown to have
residue Cl levels at less than 10 ug/l appears to be fairly benign. Even so,
the county did not approve the stone pit which led to our engineering firm
drafting an additional proposal to the county for a non discharge, subsurface
type of disposal for backwash. This did not meet conceptual approval. There
was investigation of running a forced main from our existing sand bed
allowing the backwash to go directly into our current septic system. Again
this did not meet with county approval. Currently we have applied to the
county for a perc/plug test of the land around the well house area with hopes
of a subsurface discharge using a septic tank and drain field. According to
Terri Craver at Alamance County Health Dept. this testing will be completed
within the next two weeks and at that time we know if this is a solution to
our discharge although at a significant cost.
I did contact John Risgard per your instructions. He stated that we need to
know the outcome of the perc test in order to proceed with the proper permit
for a non discharge. I will let you and Mr. Risgard know the outcome of the
perc test as soon as we hear back from the county so we can determine the
viability of this last option.
The Federal USDA, SSHA, and our engineering firm have worked diligently in
trying to find a solution to meet these needs however the lack of overall
support and response from local and State agencies has eroded our optimism.
Although the Federal USDA stepped in to help provide safe drinking water to a
rural community, the State's indifference and bureaucracy may bankrupt the
effort.

I want to keep you informed of our progress regarding the SSHA well house renovation and particularly concerning
solutions for green sand filter backwash effluent. We were granted the NTP and construction began this week on Monday
July 11th.
Construction currently includes clearing land for a new addition to house the latest technology in greensand filter
systems. Once the new system is on line, the current portion of the well house will be razed and the new building walls
and roof will be constructed to provide proper storage and equipment area.
Concerning the backwash effluent, the original plans called for a stone pit discharge that has since been derailed due to
permitting. We are now considering two options. First is to consider installation of a septic tank on edge of well house
property and a drain field on adjoining property for which landowner is agreeable to give easement. A second option is to
run a 2 inch pipe into our existing community septic system main line located several hundred yards away. Our
engineering contractor, Alley Williams Carmen and King (AWCK) are planning this stage of construction with the goal of a
permanent solution to our backwash and reduce or eliminate our permitting requirements. The USDA who is financing the
project continues to provide us support and guidance.
Construction progress is expected to be fairly quick and I will continue to correspond with updates to the construction
progress as time moves on. The project is expected to be complete in 120 days to 150 days.
Please let me know if you have recommendations concerning our effluent permitting issue.

Thank you for taking my call today and speaking with me in regard to our concerns on our draft permit NC0059625. As I
explained over the telephone our concerns are that the extended permit require bi-monthly testing and this would exceed
our community's
ability to pay for testing. We are currently preparing for a complete renovation of our existing well house structure and
filtration system thanks to a USDA low interest loan and grant. The new filtration system will reduce our backwash
volume and impact greatly.
I have spoken to our engineer on the project (Mark Averette with Alley, Williams, Carmen and King, Burlington, NC) and
have been advised that construction should begin either mid/late June 2011. The construction project timeline is 120 days
with an additional
30 days to wrap up the project. This would put the project beginning Late June/early July 2011 and ending in November
2011.
We respectfully ask to maintain existing sampling frequencies quarterly until the construction project and renovation of the
filter system is complete.

Good to speak with you today, thank you for your time regarding this matter.
I am writing to acknowledge receipt of our draft NPDES Permit No. NCO059625 for our South
Saxapahaw water treatment facility dated April 13, 2011. We appreciate your office's efforts to
extend our permit. One major concern we have is that the draft permit outlines new drastic changes
in monitoring requirements for the filter backwash effluent going from quarterly to bi-monthly samples
total residual chlorine (TRC). This cost for this new requirement exceeds our community's ability to
pay for the test and may shut us down and eliminate the only drinking water supply available for our
small rural 48 household community. Thus we ask for your direct help in understanding this new
requirement and how we can work to ensure our system continues to provide quality drinking water to
our rural community.
As the smallest water utility in the State providing a critical service to lower income area, the USDA
awarded us a low interest loan and grant that is allowing us to rebuild our well house with the latest
technology filtration systems that reduces our backwash volume and impact. Construction of that
system starts in June 2011. Our past quarterly samples of have consistently shown our effluent to be
within standards and we expect that to continue and potentially improve.
We have our team of volunteers representing the SSHA community to work with agencies to help
resolve these critical issues. They are Michael Boucher, (919 951 9433) and Greg Germino, (336-
675-7544) who are trying to work with Alamance County and the State offices to determine how to
reduce the impact of our 600 gallons of filter backwash without discharging directly into a local
creek. We would appreciate any advice or help you could offer on either of these issues.
According to the Engineer the projected new system construction will take 120 days with a
further 30 days to finalize anything that needs to be done. SSHA has awarded the contract
to K & W Water Conditioning of Mt Airy, NC. Currently they are in the process of securing
the needed bonds, insurance and construction signatures. After this takes place the
executed contract documents are sent to Alan Hart, Area Specialist of the USDA and
State Engineers for review and concurrence. After this there will be a pre -construction
meeting and a NTP can be issued. It is our Engineer's estimate that construction will
begin in June and will be completed as early as Sept or at latest Oct. 2011.
If there is anyway to keep testing quarterly until construction is completed or if you have
any viable options for our community during or after construction for our backwash we
would greatly appreciate any suggestions.

We are running into roadblocks with proposed plans with our new water system/greensand filters. We will continue to
look into alternative solutions that allow us to eliminate any discharge into tributaries.
Our consultant suggested we request House Bill 683, Session Law 2010-177 for an automatic extension of our current
permit for four years. Is this a possibility?
The new greensand filters that we are looking to purchase may eliminate the need to add potassium permanganate;
therefore changing our testing requirements. Construction on the project should begin this summer.

NPDES permit application was submitted. You have requested the additional
information on our solids handling plan and a schematic flow of the facility.
I have sent your request into our new engineer's firm. We are in the process of approving
new plans for the renovation of our system. We have blue prints for our current system
plus the new system. I have asked for a PDF form, but have not received one at present.
Hopefully, after the holidays I will receive this information.
As to the solids handling plan, are system does not generate solids. I spoke with Jeff
Paupart last week and he is aware of this.
Our current engineer firm is Alley, Williams, Carmen & King, of Burlington, NC. Is
there an email that the firm could email the PDF form directly to your office?

We are requesting a renewal for our sand filtration system. Our community well of 42 households uses a
green sand filtration with a backwash. Chemicals used are chlorine and potassium permanganate.
We have two work days a year in which we clear any weeds from the sand bed and maintain proper
drainage of the bed.
Meritech Inc, visit's the site on a quarterly basis to test for total residue chlorine, PH, Iron, Manganese and
Total suspended solids. We are in compliant on all results.
Hopefully our water system will be updated by 2012. We are in the process of working with the USDA and
a local contractor. At this time no changes or updates have occurred.

been discussed internally and also with the Winston-Salem Regional Office.
The Division cannot find sufficient justification to allow your request. Total Residual Chlorine (TRC)
monitoring is an important part of NPDES permitting, serving to keep excess chlorine out of the environment.
To be fair and consistent with Division policy, we must require you to adhere to the conditions of your permit,
monitoring for TRC on a quarterly basis. You should contact certified laboratories in your area for a quote to
accomplish this task.
Please be aware that if you do not currently have a dechlorination process, this must be added in order
to achieve the permit limit of 17 micrograms per liter allowable TRC. If you show consistent compliance with
this TRC limit, you may request a permit modification for a decrease in the required frequency of monitoring.

I have discussed this with Jenny and Ijusl carat find sufficient justification for their request. I'm sure there are hundreds others out there with the 17 ug limit That would like
the same break but we have a standard, we have a policy and we thus have to be consistent (whether its right or wrong).
They do discharge to a 0 Bow stream. If they discharged to the middle of a field and had 100 yards of grass to the nearest ditch, I'd consider it, but that is not the case here.
I think to be fair and Consistent with our actions to dale, you guys need to deny her request in writing and pretty quickly and encourage her to contact multiple contract labs
to gets bids on their quarterly sampling. I think they collect the samples and take to Pace Analytical now. I do not think Pace is certified for field parameters. They probably
need to get up with R&A or other lab that is certified for their normal parameters and the field ones for a quote as well as Pace. They will have to add the de2hlor no
matter what. There are a lot of folks certified for field parameters. Might also give her the lab web site for lab certification that will have a listing of field certified labs and or

I'm looking for some advice on how to handle this request - see attached.
With their good compliance history, are we being unreasonable to require
these guys to do the low-level. Me testing? I think they could find a
spectrophotometer for cheaper than what they said, which was $E500.

Dear Mr. Weaver:
We request a waiver from performing Total Residual Chlorine test on our small nonprofit community, water
system supporting 41 moderate to low income households. We believe the evidence shows the current
system's impact is negligible on the local tributary while the cost to comply with this additional protective
testing would pose a significant burden on our community with little to no benefit.
Our water system uses a greensand filter system and then discharges the backwash from these filters into a
contained concrete sand filtration system. The sand we use is an uniformity to efficient <1.70% with an
effective size of 0.35mm to 0.55mm with a minimum dust content. Routine maintenance of the sand
filtration is done by the homeowners during our community work days. At the low end of the filtration
system is a 4 inch pipe that drains into an unnamed tributary. This maybe a slow drip to no flow most of the
time. Moreover, at the time of backwash which occurs once a week , our operator turns off the chlorine
pump to further ensure any levels are minimal.
Pace Labs collects our quarterly grab samples. The time restraint of 15 minutes with the residual chlorine
test does not allow Pace Labs to run this test. This would require our purchase of a $4500 machine to do
onsite testing. Our well operator would need to be certified plus meet the yearly competency requirements.
This additional cost would pose an enormous undo burden on our small community.
Our system has been operational for 26 years. We have not have any violation of limits. We did have a
failure to turn in the DMR on time 2 years ago. We made a corrective action plan and have been in
compliance since.
Our unnamed tributary is 1468 feet from the Haw River and the tributary shows a healthy supply of flower
and fauna growth indicating the lack of any adverse impact due our minor effluent flow.

permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9; 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on
April 26, 2006.
Be aware that the Haw River is listed as an impaired stream on North Carolina's 303(d)
list. This means that the stream does not meet all water quality standards. Although the Division
believes multiple sources are causing degradation to the Haw River, we will continue to monitor
compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a
direct cause of stream degradation, the Division will recommend removal of your plant's discharge.
Part III of your permit requires you to "continually evaluate all wastewater disposal alternatives
and pursue the most environmentally sound alternative of the reasonably cost effective
alternatives" to surface water discharge. Such an evaluation may help you find an alternative to
surface water discharge that is more appropriate for your facility.
Your facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water
Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of
nutrients from all discharges to NSW waters. Any new (or expanding) will be subject to nutrient
limitations for total nitrogen and total phosphorus according to House'Bill 515 requirements.
Since modifications to treatment systems are expensive and time consuming, it is highly
recommended that you begin planning for this possibility now if a future expansion is anticipated
at your facility.

PERMITTING STRATEGY FOR GREENSAND FILTRATION WATER TREATMENT PLANTS
January 2004
Applicability: The following permitting strategy applies to new and existing water treatment plants using
greensand filtration to generate potable water from groundwater. This permitting strategy does not apply to any
other kind of cationic exchange unit used in water treatment. If any portion of the water treatment process
includes an ion exchange/water softener unit, then the RO-IE Permitting Strategy will apply as well.
A sample effluent limits page is attached to this strategy for guidance purposes.
Description of Technology: Typically, the greensand filtration unit is preceded by the use of an aeration tower
along with potassium permanganate to oxidize dissolved iron in the ground water. The particulate ferric
hydroxide (and some minor quantities of soluble ferrous material) is then removed via filtration through a
manganese based "greensand" media. Greensand is a proprietary material that does not require sodium cycle
regeneration, only backwash with finished (potable) water. Since the discharge from such a facility is not as
saline as that from a sodium cycle cationic exchange unit, this may be considered a more environmentally -
friendly technology for the treatment of groundwater. Filter backwash water is usually collected in a settling
basin, and the supernatant is then discharged to surface waters or a regional treatment works.
Typical chemical additives to such treatment systems are an anti-scalant (such as zinc orthophosphate), fluoride
(to help prevent dental cavities), chlorine and potassium permanganate.
Application Requirements for New Permittees: In addition to the appropriate NPDES application and fee,
new Permittees should also include the following in the application package:
• Description of the proposed water treatment system with a process schematic
• Map of proposed discharge location, indicating precise latitude and longitude
• Proposed flow rate for treated potable water and filter backwash water
• List of proposed chemical additives
• Chemical analyses of the source water (most notably, heavy metals and other parameters as
described in "Assessment and Recommendations for Water Treatment Plant Permitting," an
amended version is provided in Table 1, below)
• Description of proposed treatment for filter backwash
• Residuals Management Plan
• Engineering Alternatives Analysis

If any of the above requirements are missing, the application package should be returned. Unlike other cationic
exchange systems, the filter backwash from these systems is not saline, so non -discharge options are considered
potentially viable options for the Engineering Alternatives Analysis. The Residuals Management Plan should, at
a minimum, describe the frequency with which solids will be removed from the settling basin and their ultimate
disposal method.
Permitting Requirements: Some permitting decisions may be made on a site -specific basis, but the following
provides a list of required monitoring parameters:

Flow should be monitored (as per Table 2). Intermittent dischargers should also report the duration of

Total Suspended Solids
Total Suspended Solids (TSS) is a parameter that, although a general indicator, ensures proper operation and
VZtenance are maintained. Specifically, TSS documents that the settling basin is properly designed and
erated. Moreover, if the source water well screens are not well installed, the raw water will be more turbid
V than normal, which will in turn increase the TSS in the filter backwash. TSS will be limited at a monthly
average value of 30.0 mg/L and a daily maximum value of 45.0 mg/L.
pH
So of the chemicals used in water treatment can depress or raise pH, and as such, it should be monitored and
ted. For discharges to fresh waters, pH will be limited in the range of 6-9 standard units. For salt waters,
pH should be limited between 6.8 and 8.5 standard units. This is consistent with the permitting strategies for all
other types of water treatment plants.
Iron and Manganese
Iron.4ad manganese are considered the primary pollutants of concern for such discharges. Present in the
polffidwater and removed through filtration by the greensand media, iron and manganese are ultimately
oncentrated in the filter backwash. These parameters are monitored only; see Table 2, as no standards exist for
either pollutant.
Fluoride
N11+
Since fluoride is an additive to finished water, which in turn is used for backwash water, it is considered a
pollutant of concern. The permit writer should verify the proposed dosing rate for the system in order to
determine the necessity of a limit for fluoride.
Chlorine
with fluoride, chlorine is a chemical additive to finished water and is therefore a pollutant of concern. Since
chlorine can have severe effects on instream toxicity, it must be limited, as with all other water treatment plants
in the state. Chlorine limits should be between 17-28 µg/L, as per Division of Water Quality policy.
Zinc
Zinc sho be included as a monitoring parameter with a footnote stating, "Zinc shall be monitored if the
permi a uses any zinc -based additive in the water treatment process." Since many water treatment facilities
h v,pAraditionally used zinc orthophosphate as an anti-scalant, zinc can be a pollutant of concern depending on
th selection of water treatment additives.
Additional Parameters of Concern
Additional parameters of concern, most notably metals, may be identified in the application package and source
(water data. Source water data should be entered into a Reasonable Potential Analysis (RPA) in order to assess
Athe need for limits. Such determinations are to be made on a case -by -case basis.

We continue to operate a not -for -profit homeowners' Association. At presently 42
homes are on the water system. We use green sand filters to treat our ground water with
a backwash system and discharge to an unnamed tributary to the Haw River, classified C-
NS W water in the Cape Fear River Basin.
Our system is located at 1735 Moore's Chapel Cemetery Road in Southern Alamance
County.
We collect a grab sample quarterly. Units of measurement include: flow, total suspended
residue, settleable solids, turbidity, residual chlorine, and iron. Our resident operator is

The Division is beginning the cycle of permit renewals for the Cape Fear river basin. An examination of the Cape
Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES
permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary
delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for
NPDES permits in the Cape Fear river basin.
This permit modification changes the expiration date of the subject permit in subbasin 30602 to May 31, 2001. Please
find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All
other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification
is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency.
In accordance with the modification of the permit expiration date, the new due date for your renewal application is
December 2, 2000. Renewal application forms will be sent to you approximately 6-8 weeks in advance of the new due
date or you may download the forms from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.htnil.

A letter of request for Authorization to Construct was received June
14, 1984, by the Division and final plans and specifications for the subject
project have been reviewed and found to be satisfactory. Authorization is
hereby granted for the construction of a 3,000 GPD wastewater treatment facility
consisting of a 242 square foot surface sand filter constructed with engineering
filter fabric, 12-inches of filter sand and 30-inches of freeboard, to serve
the backwash waste from the South Saxapahaw Homeowners' Association's water
treatment facility.
This Authorization to Construct is issued in accordance with Part III
paragraph C of NPDES Permit No. NCO059625 issued November 1, 1984, and shall
be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in
Permit No. NC0059625.
The sludge generated from these treatment facilities must be disposed
of in accordance with General Statutes 143-215.1 and in a manner approvable
by the North Carolina Division of Environmental Management.
In event the facilities fail to perform satisfactorily in meeting it's
NPDES permit effluent limits, the South Saxapahaw Homeowners Association shall
take such immediate corrective action as may be required by this Division,
including the construction of additional wastewater treatment and disposal
facilities,

As we discussed on the phone Tuesday, we are enclosing an application
for a discharge permit (short form D) and a portion of a USGS Quad map
which shows the location of the proposed discharge.
You will recall from our conversation that the water system improvements
includes installing green sand filters to remove small amounts of iron
and manganese in the raw ground water. The filter backwash water will
be discharged into a sand filter which will have an underdrain that
will discharge to a nearby stream. We expect that the backwash cycle
will occur twice or three times a week, and will discharge 2000 to 3000
gallons to the sand filter. We would expect an identical amount of
treated effluent to leave the sand filter and be discharged to the stream.
By copy of this letter, we are furnishing Mr. David Adkins, in Raleigh,
with all this information, and we are furnishing Mr. Randy Williams, this
same information, and are requesting that he furnish us with a waste land
allocation for the proposed discharge point.

Division staff has confirmed that the subject permit is no longer required. Therefore, in accordance with
your request, NPDES Permit NC0059625 is rescinded, effective immediately.
If in the future your community wishes to discharge wastewater to the State's surface waters, it must
first apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES permit
will subject the responsible party to a civil penalty of up to $25,000 per day.
