Good morning, Brad and Ben,
This correspondence is in reference to the monitoring report and credit release request submitted for the Davey Mitigation Cape Fear 02 Umbrella Mitigation Bank, Dutch Farms Mitigation
Site, Action ID SAW-2021-01071. The purpose of this letter is to transmit comments provided by the NC Interagency Review Team (NCIRT) during the review of the monitoring report and
to confirm the annual credit release. The review of the annual monitoring report followed procedures outlined in Section 332.8(o)(9) of the Mitigation Rule. The comments listed below
were provided by the NCIRT during this process. While it is not necessary to provide a response to specific comments at this time, please be sure to address the issues raised in future
monitoring report submittals.
Maria Polizzi, NCDWR
1. DWR appreciates the aerial imagery overlay on the CCPV and other included drone imagery.
2. Please include different symbols for different types of gauges. It appears that stream flow gauges, crest gauges and wetland gauges are all shown with the same (red dot) symbol.
3. Please be sure to upload As-Built documents to Laserfiche in addition to RIBITS.
4. The final mitigation plan shows a stream flow gauge on UT7 that is not shown on the As-Built CCPV. This should be installed as soon as possible. It also appears that flow gauges on
UT5 and UT8 have moved downstream slightly from the final mitigation plan. Please either relocate these gauges to their proposed locations or confirm that they were installed per plan.
Similarly, some of the cross-section locations have changed from the approved mitigation plan. This is less of a concern to DWR than the flow gauges, but please be sure to install devices
as closely as possible to the locations shown in the plans.
5. Vegetation plots 4 and 15 both have 2 species exceeding 75-80% of the planted stems in the plot and Plot 8 already has White Oak exceeding 50% of the plot (61.5%). Please be sure
that species diversity and proper spacing are prioritized during planting and that oversight of the planting contractor is provided, as needed.
6. There are a few discrepancies between cross-section design dimensions and as-built. Commonly, bankfull width and/or depth, and associated bankfull cross-sectional area were off by
a few feet in either direction. Is this within the expected deviation from design? Is there a specific reason for these changes? A couple examples are below:
a. UT1 Cross Section 3 (Riffle): The bankfull width and bankfull cross-sectional area are smaller than designed by a few feet (13.8 to 11.4 and 16.6 to 10.31 respectively).
b. UT2 Cross Section 1 (Pool): Max depth and cross-sectional area are both almost double their design dimensions (0.91 to 1.94 and 5.7 to 10.96 respectively).
7. The red-lined plans show that rock toes were added during construction, however this structure type was not included in the final plan. Only toe wood was proposed and approved. In
the future, please inform the IRT if a new structure type is being introduced during construction.

1. Photo points of the culverts/crossings were previously requested. Please provide photographs of all crossings (outlet and inlet) in future reports.
2. Any photo points not at XS, VPs, GWs should be included on the CCPV.
3. Please breakout gauges by type on the CCPV with different colors or symbols (Flow gauge vs. wetland gauge) for future reports.
4. Please include photos of all installed gauges in the MY1 report.
5. Please label all photos in the photo log with location/direction (UT1 XS1 looking upstream, etc.).
6. Was a rain gauge installed on site? If yes, please add to the CCPV. If not, please include details of where the rainfall data will be coming from (what station, distance from site,
etc.) in the MY1 report.
7. No vegetation height data was included in the report. Please include at minimum the average height of each veg plot.
8. Please add a bankfull line to each cross-section graph for easier review.
9. A map of the different planting zones would have been helpful for review.
10. Noted that a section along the outer edge of the easement near UT4 was missed during initial planting and 20 bareroots were added on May 8. The area is relatively small, however
please be sure to monitor this area closely to help assess the survival of planted species due to late planting to determine if additional planting will be needed.
Based on our review of the monitoring report and the results of the NCIRT review, we confirm that you have satisfied requirements included in the approved banking instrument and mitigation
plan for this site. Accordingly, with this correspondence we confirm the release of credits as shown on the table below and on the attached credit release schedule. The district ledger
on the Regulatory In-lieu Fee and Bank Information Tracking System (RIBITS) has also been updated to reflect this transaction.
