Dear Ms. McEachran:
Please reference the correspondence received by the United States Army Corps of
Engineers (USACE) on May 16, 2024, regarding the proposal to modify the RES Neu-
Con, Hannah Bridge (SAW-2015-01799) Final Mitigation Plan, the correspondence
received by the USACE on September 11, 2024, providing clarification on credit totals.
Based on the information submitted with this request, the Wetland Credit Total will
change from 10.743 credits to 6.670 credits due to several wetland gauges not meeting
success criteria across the site. The submittal package requested removal of 4.073
Wetland Mitigation Credits (6.95 acres of riparian wetland) from the Hannah Bridge
Mitigation Project Credit totals as reflected in the attached Credit Release Schedule for
the Site. The wetland credit loss is associated with Wetland 1 (1.192 acres of
restoration, 1.192 Wetland Credits) and Wetland 14 (5.761 acres of enhancement,
2.881 Wetland Credits).
As bank sponsor you are required to comply with the approved RES Neu-Con UMB
Instrument and Hannah Bridge Site Final Mitigation Plan and this Modification, and the
Corps’ regulations regarding compensatory mitigation (33 CFR 332). Please note that
no credit release is approved with this correspondence. When credits are debited from
the mitigation site, the bank sponsor must provide the Corps with an updated ledger
form identifying the purchaser of the credits, the project name, the permit number, and
the number and type of credits to be debited. When all stream and/or wetland credits
have been consumed, no more credits may be sold from this mitigation site.

Wilmington District Mitigation Bank Credit Release Schedule
4 - A 15% reserve of credits to be held back until the bankfull event performance standard has been met.
1 - The first credit release milestone is based on the potential credits stated in the approved mitigation plan.
2 - The first credit release shall occur upon establishment of the mitigation bank, which includes the following criteria:
1) Execution of the MBI or UMBI by the Sponsor and the USACE;
2) Approval of the final Mitigation Plan;
3) Mitigation bank site must be secured;
4) Delivery of the financial assurances described in the Mitigation Plan;
5) Recordation of the long-term protection mechanism and title opinion acceptable to the USACE;
6) 404 permit verification for construction of the site, if required.
3 - The second credit release is based on the credit totals from the as-built survey, and may differ slightly from the credit totals stated in the mitigation plan.
Contingencies (if any): Wetland Credits are on hold until further information is provided
