The concrete is being conveyed and deposited into the above noted walls with a 42 meter concrete pump truck with long hose to extend into form for minimum segregation of the concrete when dropped into the wall form. The concrete was placed at approximately 3 feet lifts and properly mechanically consolidated with a hand held electric concrete vibrator. • Set and welded to bearing plates the steel roof joists in the proper locations as noted on the contract drawings per sheet number 14 "Roof Framing Plan" and detail sections 1 through 5. Compliance testing was performed on each load of the concrete delivered and deposited on this date by a concrete technician supplied by F & R, inc. Types of testing performed on the concrete is slump, entrained air content, concrete temperature, ambient temperature, amount of water added to mix if required and tlie making of concrete compressive strength testing cylinders. One set of 4 concrete compressive strength testing cylinders were made on this date. Poured 10 cubic yards of 4500 psi concrete for thrust blocks and anchor for the new 30" diameter pipe connection between the existing splitter box and aeration basin number 1. The contractor performed additional tightening to the bands around the pipe boot section but the seepage was not contained. The contractor elected to install Symons Water stop hydraulic cement into void between the boot and pipe level with the splitter box concrete surface. • Completed installation of truss and bridging at the sludge thickener building. Installed metal roof decking by connecting with 3/16-inch head diameter self-tapping galvanized screws 12-inches on center as per section 5300-5 paragraph 3.3 of the contract specifications. The information requested is reference to detail 4 on sheet 14, 3x5 continuous angle length of building. The top of joists is 3" above the block in which creates a discrepancy with bolting the angle to the block due to the hole is 3" to center from top angle. Once this piping was connected all bypassing was redirected through the proper piping into the splitter and bypass hoses were dissembled and removed. All dowels (vertical & horizontal) were inserted into existing concrete surface with high strength epoxy prior to the beginning of placement of wall reinforcement. • Received reply from project engineer in reference to RFI issued by contractor on Thursday, January 25 on the 3" x 5" angle plate at the sludge thickener building. The concrete was conveyed and deposited into the slab area by a concrete pump truck. The concrete was mechanically consolidated, leveled and steel trowel finished. No displacement of the forms or reinforcement noted during the placement of the concrete. • Concrete testing for slump, entrained air content, temperature and compressive strength testing cylinders were made on the concrete deposited on this date at aeration basin number 1. Field compliance testing was performed by F&R, Inc. The field testing results indicated that concrete delivered and deposited meets the project required specifications for slump, entrained air and temperature with no exceptions noted. The other ditch was 75% full and some splashing outside the ditch was noted. The ditch being cleaned should be back in operation by mid February 2007. Sludge was last hauled from the aerated digester in November 2007. Sludge will be hauled later in January 2007. Influent in the oxidation ditch was tan to light brown in color. Foam was present on approximately 10% of the surface. Effluent was clear flowing from the weirs of clarifiers. All weirs appeared lever and had even flow. A moderate amount of scum was noted on clarifier # 1, lesser amount on # 2, and lesser amount on # 3. Effluent appeared clear in the clear well downstream from the traveling bridge filters. One bank of UV bulbs was in use at the time of inspection. Both banks are used during heavy flows. The effluent discharge pipe at the Neuse River was submerged. The effluent discharging could not be seen due to high river turbidity. No foam or odor was present at the discharge point. Discharge Monitoring Reports for the period November 2005 through November 2006. The facility was compliant with permit limit and monitoring requirements during the period. Commercial lab results, chain of custody records, and bench sheets were compared with data submitted on the Discharge Monitoring Report (DMR) for the month of October 2006. No discrepancies were noted. The laboratory was checked in a cursory manner. All instrument calibration logs are being maintained. All pH buffers were within expiration date. An operator’s logbook was available and being maintained. The influent and effluent flow meters were calibrated February 07, 2006. Cell D12 (Total Permitted Flow Not Tributary) is the sum of all the permitted flows that appear in column F (Paper Flow). “Paper Flow” is just that - - it’s flow that is just on paper, NOT in your treatment facility. When we issue an extension permit, all of the permitted flow is “paper” flow. Let’s say a permit was issued for 10 homes at 360 gallons per day per home, or 3,600 gpd total. A year later, half of these homes are now occupied. The paper flow amount is then reduced by half. Each time we enter a new project, Excel recalculates all the numbers and percentages. The tracking file has two “alarm” points, the percentages for paper flow and tributary flow. The tributary flow percentage is based on the last year calendar flow, and is set to alarm at 80% or 90% to comply with the "80/90” rule given in 15A NCAC 02T .0118. We take this value from your Discharge Monitoring Reports. When reconciliation occurs, you have to make sure an engineer's certification (EC) has been received. It's a permit violation to introduce flow to a sewer system extension prior to DWQ’s receipt of the EC (permit condition 6). Because we started keeping track of the EC date in our tracking files just a few years ago, we've admittedly got some older permits which do not show an EC date. Cell D14 (Paper Flow Percentage) is the plant permit flow D6, subtract the paper flow remaining D13, and divide the result by the plant permit flow D6. You normally reconcile the file when you think it's necessary. At any time you wish to reconcile the flows, we will send you the Excel file. You then provide the build-out percentages for each project and return the file to us. We will then adjust the flows accordingly. Rows 17, 18 and 19 are the column headings for the list of permits. Column A is the permit number. Column B is the project name. Column C is the permit approved (issued) date. Column D is the flow stated in the permit. Column E is the tributary flow. We’ll explain this in the flow reconciliation discussion. Column F is the paper flow. Column G is a math check to make sure that tributary flow and paper flow equal permitted flow. Column H is for comments. Column I is the Engineer Certification (EC) received date. Reconciliation of flows moves flow from column F (paper flow) to column E (tributary flow). This reduces the paper flow percentage which is calculated using the sum of the values in column F. Here's how it works: First, you determine the build-out percentage of the projects, usually by determining how many CO's have been issued for a project. As soon as a CO is issued, we assume that the home is now occupied, and that flow now goes to the WWTP. In other words, that part of the flow is no longer on paper, it's tributary to the WWTP. Let's say that 25% of all the homes are now tributary for a given project - - that means that 25% of the permitted flow is now actually going to the WWTP, with the other 75% flow still on paper. The paper flow percentage alarm goes off at 100%. This value is met when DWQ has issued permits for flows that, when combined with the tributary flow, equal 100% of the plant’s treatment capacity. In rapidly growing areas, the paper flow percentage alarm value is reached long before the tributary alarm percentage. Once the 100% paper alarm goes off (or sooner, if necessary) the sewer extension permitting process becomes a little more complicated, but doesn’t necessarily grind to a stop. Cell D13 (Remaining Paper Flow Capacity) is calculated by taking your facility hydraulic capacity (D6), subtract from that the actual tributary flow (D7), and then subtract from that the total of all “paper” flows. This cell represents the flow amount available for permitting, provided there are no other events of concern, such as an authorization to construct. The 100% paper flow alarm begs the question of “can you adequately treat the flow.” At the same time it gives the opportunity to surpass the 100% paper barrier provided “...the unit of government has secured a grant or has otherwise secured financing for planning, design, or construction of a new or improved waste disposal system which will adequately treat the additional waste...” "No person subject to the provisions of G.S. 143-215.1, 143-215.108, or 143-215.109 shall willfully cause or allow the discharge of any wastes...in excess of the capacity of the disposal system...or any wastes...which the disposal system...cannot adequately treat.” North Carolina General Statute 143-215.67 (Acceptance of wastes to disposal systems and air-cleaning devices) in paragraph (a) states in part: “The Commission may authorize a unit of government subject to the provisions of subsection (a) of this section to accept additional wastes to its waste-disposal system upon a finding by the Commission (i) that the unit of government has secured a grant or has otherwise secured financing for planning, design, or construction of a new or improved waste disposal system which will adequately treat the additional waste, and (ii) the additional waste will not result in any significant degradation in the quality of the waters ultimately receiving the discharge. As such they have prepared detailed, point-by-point responses to the procedural and technical issues raised in the allegation. Their statements are attached herewith for your use and review. In addition I feel it is necessary for the Town to offer a plain and clearly stated response to several of the allegations. The complaint states that the original project schedule was eleven months. This statement is not accurate. The original project schedule was 450 days and was extended additional days for lost weather days, per the contract, and accommodation of executed change orders. The extended schedule was exceeded through the fault of the contractor, as documented during construction progress meetings and numerous letters of correspondence from The Wooten Company to The TARA Group. Failure to meet the schedule has subjected the contractor to substantial liquidated damages at the rate of $500 per day for each day in excess of the schedule. Furthermore, the complaint alleges the Town has been accepting of “shoddy workmanship.” Again, this statement is without merit as refuted by the fact that all construction was subject to daily, on-site professional inspection by a qualified consultant under contract to the Town. Construction activities were subject to over four hundred inspection reports, compiled on a daily basis, plus nearly 2,000 photos which document the status and quality of work in progress. The complainant illustrates a single circumstance as the basis for this allegation. As you will note, the attached information prepared by TWC definitively proves that the work, as described, was incomplete at the time it was witnessed, that it was the subject of a detailed design specification. Atchison Alex Harding Michael Grannis On November 13, 2007 the Town of Clayton received a transmittal from your office indicating that an individual has made anonymous and unsubstantiated allegations of project mismanagement and poor construction quality at the above noted project. The allegations were made in two parts, the first part was a letter sent to the Raleigh Regional Office of the Division of Water Quality and dated February 6, 2007. The second part was a note prepared by a staff person at the State Auditor’s Office based on an anonymous phone call. The second contact did not include a date, but we interpret it to have taken place some time in November 2007. If you require additional information, please let me know. C: In closing, although the noted project offered some unique challenges and frustrations with regards to untimely performance by the contractor, we feel that the final product is of quality construction and, with satisfactory attention to punch list and warranty items, performance of the Plant will meet or exceed design specifications. Finally, the complaint alleges the Town conducted or allowed “improper sludge disposal (mixing with sand and selling as top soil)” in relation to execution of the project. This statement is absurd and entirely without merit in that the Town of Clayton handles all sludge in accordance with strict rules of accountability which involve proper storage, transport, and documented disposal by approved method. At no time has the Town of Clayton disposed of sludge by mixing and selling as a product, nor have we allowed any sludge to be so handled by a third party. Typically such cracks do not compromise the integrity of the structure unless visible leakage is present. We are not aware of any significant cracking in the sludge holding/stabilization basin; however, we will monitor the structure and pursue structural repairs if warranted. On behalf of the Town of Clayton, we are writing to respond to allegations made regarding improper construction methods at the Clayton Little Creek Water Reclamation Facility. We are in receipt of a complaint placed by an anonymous caller to the Office of State Auditor’s hotline received by The Wooten Company on November 13, 2007. The complaint alleges continued mismanagement of the construction process resulting in “shoddy workmanship, poor project mismanagement, improper waste disposal and improper procurement practices”. We will provide a response to each of the allegations listed to the best of our ability as follows: The project construction period was scheduled for 450 calendar days (i.e. 15 months) and scheduled for completion by November 8, 2006. Although the contract time has been extended for some change order work and abnormal weather days, the project schedule has experienced delays and substantial completion was not achieved until late October 2007. Punch list items for outstanding work are being completed and any deficient work identified will be corrected. The Town of Clayton publicly advertised and bid the project per the formal bidding requirements set forth in the NC General Statutes. The design firm for the project was The Wooten Company of Raleigh, NC. The construction contract was awarded to The TARA Group of Lumberton, NC who was properly licensed per the General Statutes. Prior to the award of contract the Town of Clayton requested the TARA Group submit prior experience documentation along with their latest financial statements. The TARA Group identified work at the Harnett County Water Treatment Plant and Bladenboro Wastewater Treatment Plant as prior water and wastewater treatment plant experience. In addition to the Clayton project, the TARA Group has since been awarded the contract for construction of improvements to the Benson WWTP which is currently being funded through CG&L. 4. 5. 6. 7. •OTEN COMPANYt: Charles W. We are not aware of any deliberate shortcuts taken by The TARA Group on this project. Throughout the construction period we have compiled over 436 daily observation reports, conducted over 21 monthly progress meetings, and have nearly 2,000 photos of the construction work in progress. This extensive documentation along with other project correspondence collected throughout the construction period is available for review by CG&L if requested. We trust that the information given above adequately responds to the issues raised by the anonymous caller. We are not aware of any stone base required for the Clayton project being “diverted to another TARA Group project”. We interpret “code violations in oxidation and sludge process” to relate to the new aluminum guardrail provided at the anaerobic/anoxic/aerobic basins. There are some sections of the new guardrail that were provided incorrectly by the miscellaneous metals supplier thereby preventing the rail from being fully installed. Efforts have been made to temporarily protect those areas missing guardrail and we understand that the Contractor is actively pursuing corrective measures with the supplier. This item has been properly identified on the punch list prepared for the Contractor. We are not aware of an electric motor drive to “blow up” once installed. There have been some miscellaneous equipment issues (i.e. blower vibration, aerator gear box, aerator control panel a/c unit) that have occurred; however, these issues either have been or are in the process of being corrected through the warranty process. To the best of our knowledge, there has been no improper sludge disposal related to this project. The contract required removal and disposal of the residual inert solids remaining in the existing aeration basins following draining for construction of the new work. Activated sludge solids were removed from the basins through the draining process and only the inert material remained for removal and disposal. Since the removal quantities were listed as a unit price in the contract.
