The purpose of this application is to request a Department of the Army Permit to authorize impacts to X06 linear feet of an unnamed tributary to the Deep River/High Point Lake. The impacts are described in this letter and in the attached permit application. Pennybyrn at Maryfield is expanding their .High Point can~pus with the construction of an Independent Living & Community Center and associated parking lots and roadways. An unnamed tributary to the Deep River originates at a spring house on the site and flows to the north, northwest toward High Point Lake. Wetlands and streams were delineated at the site by Timmons in 2001. Representatives of the U.S. Anny Corps of Engineers (Action ID: 200120668) and the North Carolina Division of Water Quality (NCDWQ) have visited the site and determined that the stream has important aquatic function and that impacts to it will require mitigation. Approximately 506 linear feet of stream channel will be impacted by this development. The stream will relocated in a pipe and discharged into the proposed stonnwater management system. Impacts to the stream have been reduced with the use of 3:1 side slopes and the proposed construction of an underground parking garage. Mitigation is proposed by payment to the NC EEP at a 1:1.5 ratio. A letter from the NC EEP indicating their willingness to mitigate the stream impacts associated with this project is included with this application. An unnamed tributary to the Deep River originates at a spring house on the site and flows to the north, northwest toward High Point Lake. The site is located at 1315 Greensboro Road in High Point and is being evaluated for development with an assisted living facility. The site is located adjacent to High Point Lake in the Randleman Lake Watershed. Wetlands and streams were delineated at the site by Timmons in 2001. Representatives of the U.S. Army Corps of Engineers (Action ID: 200120668) and the North Carolina Division of Water Quality (NCDWQ) have visited the site and determined that the stream has important aquatic function and that impacts to it will require mitigation. Approximately 506 linear feet of stream channel will be impacted by this development. The stream will relocated in a pipe and discharged into the proposed storniwater management system. Tlie relocated stream and stormwater management system are illustrated on Figure 6 of 6. The stream channel will then be filled by the controlled placement of structural fill. The structural fill will be obtained from cut areas of the project. The fill will be placed using grading equipment including pans, bulldozers, dump trucks and backhoes. Some areas may be bridged with the placement of four foot deep lifts as recommended by the Owner's geoteclmical engineer. Otherwise, fill will be placed in eight inch lifts and compacted to a minimum 95% density. The low end of the stream and the wetlands near the lake will be protected by sedimentation fencing, diversion ditches and sediment traps. Approximately 66 linear feet of stream will be impacted by the construction of the Independent Living & Community Center. The east wing of the Independent Living and Community Center is approximately 65 feet wide where it crosses the stream. The east wing of the Independent Living & Community Center will be approximately 24 feet above the elevation of the stream channel. Approximately 220 linear feet of stream channel will be impacted by parking lots and access drives. The parking lots and access drives will be placed on approximately 9 to 18 feet of structural fill. Approximately 220 linear feet of stream will be impacted by fill slopes and yard areas. Stornnvaler Management The stream will be relocated by piping the flow into the proposed stonnwater system. This system will carry the flow northwest around the Independent Living & Community Center building. The stormwater system will discharge into a stormwater management pond, which meets the City of High Point's stonmvater management requirements. The pond will be located on the west side of the Independent Living & Community Center building. Site = 70.19 Acres Existing Built Upon Area = 9.14 Acres Proposed Built Upon Area = 11.46 Acres Total Site Built Upon Area = 20.60 Acres Impervious Area Percentage = 29.3% All of the proposed built upon area will be routed through the stormwater management pond; additionally, portions of the existing built upon area will be routed through the stormwater pond. Block 18. Nature of Activity (p.2) The pond has a surface area of 19,200 square feet or 0.44 acres with a maximum depth of 12 feet. A total of ?3.40 acres shall be treated by stormwater management. Avoidance and A1ir~imi~atron The Independent Living & Community Center building was originally to be located on the northwest side of the site on a peninsula that projects into City Lake. This area was above the 100 year flood plain and offered wonderful views of the lake. The cut and fill required to build the building almost balanced within the northwest portion of the site. However, a perennial stream is located on this part of the site. The perennial stream flows from off-site on the southwest side to the lake on the west side going northeast across the peninsula. This would have required filling approximately 800 feet of perennial stream. This part of the site is now designated as open space to protect the stream and surrounding area. The Independent Living & Community Center building was then located approximately in its current position on the site. This requires filling 506 linear feet of stream channel. This stream originates at a spring on-site and is approximately 800 feet long. Li order to avoid additional impacts to the stream, fill slopes were increased to 3:1 instead of the original 5:1. The 5:1 slope was preferred to create paths near the lake and also takes into account the ability of the senior citizens to negotiate around the grounds. A lower level was added to the building to decrease the amount of fill and the fill slopes around the building. An underground parking deck was also added to reduce the size of the parking lot and to slide the building south and away from City Lake. It is also important to note that Maryfield has owned this land since 1947. The land was not purchased to build new facilities. Land has been purchased around Maryfield in order to add assisted living cottages. However, the stream being disturbed is located on the original property. Also, there were once a few buildings located at the head of spring and along the first 50 feet of stream channel. The stream was routed thru manmade channels in these areas and piped for crossing. This length is included in the 506 linear feet of stream channel affected by the project. Mitigaliort In order to mitigate for the proposed impact to 506 linear feet of stream channel, the applicant proposes payment to the NC EEP on a 1:1.5 basis. A letter from the NC EEP indicating their acceptance of the mitigation requirements of the project is included with this application. Bloch 19. Proposed Project Purpose Pennybyrn at Maryfield was founded in 1947 as a nonprofit corporation to provide housing and long terns care for the elderly. It currently operates a continuing care retirement community (CCRC) on its 71 acre campus in High Point. The facility includes 115 nursing beds, 10 homes for the aged beds, 29 independent living (single family) housing units and a convent that houses members of the sponsor congregation. Recognizing the challenges of contemporary care-giving at its aging campus and the tlu-eats of new competition, the non profit corporation completed a strategic plan. The plan confirmed that the long term viability of the campus was threatened in the absence of proving a more robust, contemporary continuum of care and updating existing facilities and services to better serve current and prospective residents. The Owner undertook a comprehensive market study 'and hired a development team. The resulting expansion and renovation program will include the construction of 131 new independent living apartments, 18 additional single family cottages, a community center, dining facilities, business and recreational facilities and a reconfiguration, expansion and renovation of the existing Health Care Center which houses assisted living, dementia and skilled nursing residents. The site plan and organization of the proposed buildings on the property reflect the `best use' and programmatic adjacencies necessary for the effective operation of the CCRC. It should be noted that when the property was purchased in 1947, this area was set aside for future expansion needs. The Owner does not have additional properties that would allow for an alternative location to provide for this urgent need for adequate housing for the aging population of the community. Since it is not practical to pipe the stream under the building, it will be diverted as shown on Figures 6 and 7. It is our opinion that the wetland located in the lake at the end of the stream channel will not be impacted by this diversion. The wetland is essentially at the same elevation as the lake and its hydrology appears to be controlled by the lake rather than the stream channel. However, as shown on Figure 8, this wetland is 0.091 acres in area. Since the USACE feels that the hydrology of the wetland will be impaired by the stream diversion, we propose mitigation by payment to EEP on a 1:1 basis.
