(Page 4, section 4.0). Response: A clarification note has been added which also applies to Comment 6 and 7 below. It reads: “Credit variance from the approved BPDP is based on two factors. First, DWR provided clarification regarding the method of credit calculation in the time between BPDP submittal and As-Built submittal. This clarification provided guidance pertaining to perpendicular distances and feature type breakdowns which had a slight impact on credits. Second, the BPDP figures are created through GIS which requires good faith reliance on published geospatial data and preliminary field measurements. It is effectively a close estimate. The As-Built figures and numbers are generated from precise survey data which are much more accurate and reflect the reality of the recorded conservation easement and the surveyed top of bank.” 2.This is not what was approved in the plan. Please revise to what was approved. species, height, planting and volunteer date, and vigor will need to be reported for all 5 years. (Page 5, section 5.1) Response:This section has been revised to match the approved BPDP. 3.Survey needs to be signed as well. (Appendix A, Stamped As-Built Survey, page 1 of 2). Response: Signed survey has been included in the final version. 4.add stream/ditch non credit area. (Appendix A, Stamped As-Built Survey, page 1 of 2). Per phone conversation on 9/18, this comment is requesting the area below top of bank. Response: Guidance for the survey is provided in Section VI Paragraph C of the UMB which states “2. Boundary Survey of the conservation easement area, signed and sealed by a licensed surveyor, including an inventory of the final nutrient offset areas in both square feet and acres.” Areas below top of bank are by definition not part of the nutrient offset areas so have not been included. However, the recorded conservation easement plat lists the easement at 38.40 acres. This is 1.06 acres greater than the sum of the categories listed on the As-Built Survey as nutrient offset areas. This difference is attributed to areas beyond 200’ as well as areas below top of bank. 5.Confirm that the overlapping 200ft width is not being double counted. (Appendix A, Stamped As- Built Survey, page 2 of 2). Response: This has been confirmed, all areas are singly counted. 6.Please explain the substantial differences of these numbers from as built compared to the approved mitigation plan (for example UT5 101-200 was 53,047 in mit plan compared to 103,207 in as built, please explain the shift in these numbers.) Restoration Systems, LLC (RS), acting as Bank Sponsor (Sponsor), proposed the Parcel under the conditions of the Restoration Systems Neuse 04 Nutrient Offset Umbrella Banking Instrument (UBI) and Saints Delight Bank Parcel Development Package (BPDP), which was approved by NCDWR on February 24, 2023. The Parcel was planned and designed according to the UBI, 15A NCAC 02B .0703, and the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295. This document details the riparian area restoration activities, monitoring efforts, and the final mitigation potential of the Parcel. Measuring 38.40 acres, the Parcel is designed to provide mitigation credits for unavoidable impacts due to development within the Neuse River Basin. NCDWR representatives conducted an onsite determination for parcel applicability and suitability of Site Features on October 15, 2021. A Site Viability letter for Buffer & Nutrient Offset was provided by the Division on December 1, 2021. Restoration Systems (RS) was granted a Conservation Easement by the Anderson family on August 24, 2023. The final conservation easement was recorded at the Craven County Register of Deeds on August 24, 2023; Book No. 3784, Page 2069 - 2076. A Conservation Easement Plat was also recorded; Plat Book J, Page 64-D. RS marked the easement at every corner with an iron, CE cap, and t-post wrapped in PVC and high-visibility tape. Additionally, conservation easement signs were placed on each corner. The Site was planted on January 24, 2024. Riparian buffer restoration activities included the removal of four (4) culverts, bare-root planting, and broadcast application of a permanent seed mix (Figure 2, Appendix A). During February 12-16, 2024, Davey Resource Group installed thirty-one (31) Carolina Vegetation Survey (CVS) monitoring plots and collected as-built data (Appendix B). bare-root planting, and broadcast application of a permanent seed mix (Figure 2, Appendix A). 2.0 Parcel Location The Parcel is located approximately 4.5 miles north of the town of Bridgeton in Craven County, NC. The Parcel is within the Neuse River Basin 14- digit USGS Cataloging Unit 03020204030020 of the Upper Broad Creek Headwaters (North Carolina Division of Water Quality [NCDWQ] Sub-basin Number 03- 04-10) (Figure 1, Appendix A). Parcel Location: (35.172480°, -76.985773°) Directions to Parcel from Raleigh: - Get on I-40 E from N Blount St and Hammond Rd (2.5 mi) - Continue on I-40 E. Take US-70 E, US-70 BYP E and US-70 E to NC-55 E in Craven County (112.6 mi) - Take the NC-55 E exit (3.4 mi) - Turn left onto Sand Hill Rd (2.0 mi) - Turn right onto King Neck Rd (1.8 mi) - Turn right onto Stapleford Rd and destination is on the left (1.0 mi) 2.1 Parcel Background The Parcel encompasses 38.40 acres of land over one tract of historical agricultural fields. Prior to Parcel development, land use is described as agricultural row crop production including cotton, corn, and peanuts. The landowners regularly applied fertilizers and herbicides to the fields. Streams and ditches on Saints Delight Nutrient Offset and Buffer Mitigation Bank Parcel DWR Project # 2021-1037 V2 As-built & Baseline Monitoring Report – May 2024 Page 2 the parcel had no existing riparian buffer. Site Features are devoid of woody vegetation outside of forested areas due to historic and agricultural practices. The Parcel is comprised of one tract with hydrological features that drain to Morgan Swamp, a tributary of the Upper Broad Creek. There were no existing structures in the project area or on the larger tract of land. 2.2 Parcel Objectives The primary goals associated with the restoration of riparian areas within the Bank Parcel focused on providing ecological and water quality enhancements to the Neuse River Basin by restoring the riparian area to create a functional riparian corridor. Goals were accomplished as outlined in the following table. Table A – Parcel Objectives Goal Objective Decrease nutrient levels Nutrient input will be decreased by filtering runoff from the agricultural fields through restored native buffer zones. The off-site nutrient input will also be absorbed on-site by filtering flood flows through restored floodplain areas, where flood flows can disperse through native vegetation. Decrease sediment input Sediment from off-site sources will be captured by deposition on restored floodplain areas where native vegetation will slow overland flow velocities. Decrease water temperature and increase dissolved oxygen concentrations Planted riparian trees will shade the streams as they mature reducing thermal pollution. Create appropriate terrestrial habitat Riparian areas adjacent to ditches and streams will be restored by planting native vegetation. Permanently protect the project Parcel from harmful uses A conservation easement will be recorded on the Parcel. 3.0 Restoration Activities Riparian area restoration involved planting appropriate native tree species along the riparian corridor. Vegetation management and herbicide applications may be needed over the first few years of tree establishment in the riparian restoration areas to prevent encroachment of undesirable species that may out-compete the planted native vegetation. Tree species planted across the Parcel included the species and percentages listed in Table B. Bareroot stems were well mixed prior to planting to ensure diversity of bare roots across planted areas and monitoring plots. In addition, no one tree species will be greater than 50% of the established stems. An appropriate seed mix of annual and perennial species listed below in Table C has also been applied to provide temporary and permanent ground cover for soil stabilization and reduction of sediment loss during rain events in areas without existing herbaceous cover. Saints Delight Nutrient Offset and Buffer Mitigation Bank Parcel DWR Project # 2021-1037 V2 As-built & Baseline Monitoring Report – May 2024 Page 3 3.1 Parcel Preparation: Historically, agricultural fields slated for restoration were in no-till agriculture and good condition. Typical field treatments were continued through the end of 2023. Four (4) culverts were removed in late November 2023. After removal, feature banks were stabilized to prevent erosion. 3.2 Riparian Area Restoration Activities Riparian area restoration involved planting appropriate native tree species along the riparian corridor. Vegetation management and herbicide applications may be needed over the first few years of tree establishment in the riparian restoration areas to prevent encroachment of undesirable species that may out-compete the planted native vegetation. The Site was planted with bareroot hardwood species on January 24, 2024. Approximately 37.46 acres were planted at an average density of 672 stems per acre on approximately 8’ x 8’ spacing. The tree species planted were proposed in the Bank Parcel Development Plan (BPDP) and are listed below in Table B. White oak (Quercus alba), referenced in Table 6 under “Proposed Substitutes” of the BPBP, was substituted for Willow oak (Quercus phellos) and is added to Table B in red. A photo log of planting efforts is provided in Appendix D. In addition to planting bareroot hardwoods, the Site was seeded with a mix of native annual and perennial herbaceous cover, Table C. Species not initially reported in the approved BPDP have been added in red. Seeding was completed in February 2024. The bare root planting list is provided in Table B followed by the permanent seed mix in Table C. As-built baseline vegetation data is provided in Appendix B. Baseline data was collected in February 2024 by Davey Resource Group and derived an average planted stem density of 607 stems per acre (Table 5: Saints Delight CVS Baseline Vegetation Data). The As-Built figures and numbers are generated from precise survey data which are much more accurate and reflect the reality of the recorded conservation easement and the surveyed top of bank. 5.0 Monitoring Protocol & Success Criteria Per the UBI, the Sponsor shall monitor the Site, in its entirety, as described in the BPDP until such time as DWR determines that the performance standards described below have been met. The monitoring period shall be a minimum of five (5) consecutive years. 5.1 Monitoring Protocol Restoration monitoring procedures for vegetation will monitor plant survival and species diversity. Quantitative sampling will include thirty-one (31) permanent 10 x 10-meter vegetation plots as outlined in the CVS Level 1-2 Protocol for Recording Vegetation, Version 4.2 (Lee et al. 2008) and will occur no earlier than Fall of each year (Figure 2, Appendix A). Vegetation plot placement will adequately represent riparian buffer credit and nutrient offset credit areas. A reference photo will be taken from the origin point of each plot. All planted stems in the plots will be marked with flagging tape and recorded. Data collected will include species, height, planting type (planted stem and/or volunteer). Total and planted stem density by plot and species will be reported during monitoring years 0-5, including height and vigor data (Table 5, Appendix B). Monitoring of the restoration efforts will be performed for five years or until success criteria are fulfilled. Restoration Systems shall submit to NCDWR annual monitoring reports no later than December 31st of each year. Each report will document the success of the vegetation and any maintenance, supplemental planting, or encroachment within the easement areas. Success criteria within the buffer will be based on the survival of planted species at a density of 260 stems per acre after five years of monitoring. The first annual monitoring activities will commence at the end of the first growing season, at least six months after planting has been completed. 5.2 Parcel Maintenance If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in Section 5.1, adaptive measures will be developed and/ or appropriate remedial actions will be implemented. Site maintenance will be performed to correct any identified problems on the Parcel that have a high likelihood of affecting the project success. Such items include, but are not limited to, fire, flooding, drought, or insects that cause excess tree mortality. Any actions implemented will be designed to achieve the success criteria and will include a work schedule and updated monitoring criteria. Any parcel maintenance performed will be included in the monitoring report for that year. A rigorous herbicide schedule may need to be implemented in the first few years of tree establishment in the restoration areas to prevent the establishment of invasive species that may out-compete the planted native vegetation. The only herbicides used on the Parcel will be aquatic approved herbicides that will be applied in accordance with North Carolina Department of Agriculture rules and regulations. Easement boundary conditions and any maintenance performed will be reported in the annual monitoring reports to DWR. If mowing is deemed necessary by the Sponsor during the monitoring period, the Sponsor must receive approval from DWR prior to conducting any mowing within Neuse Buffer Zones 1 and 2 to ensure that no buffer violations have occurred. 5.3 Long Term Management Plan The conservation easement will preserve all areas and prohibit all use of the property inconsistent with its use as a nutrient offset and riparian buffer mitigation property, including any activity that would materially alter the biological integrity of the Site/Parcel. RS assigned the Deed of Conservation Easement to North Carolina Wildlife Habitat Foundation, INC. on November 29th; Bk 3784, Ph 2063-2082. Easement corners are currently marked with t-post wrapped in PVC and high-visibility tape. 6.0 Financial Assurance RS will secure all financial assurances according to the approved UBI. No bond shall be less than $100,000 initially, to cover monitoring expenses. Performance bonds for monitoring shall be renewed at least annually to cover the next years monitoring period, with confirmation of renewal provided to DWR with each annual monitoring report when applicable. Site cannot be a Preservation Only site to comply with this rule. 3NC Division of Water Resources - Methodology and Calculations for determining Nutrient Reductions associated with Riparian Buffer Establishment 4 Determinations made for this Site are determined based on the proposal provided in maps and figures submitted with the request and assessed according to the definitions in 15A NCAC 02B .0295 (b). 5 All features proposed for buffer mitigation or nutrient offset, must have a planted conservation easement established that includes the tops of channel banks when being measured perpendicular and landward from the banks, even if no credit is viable within that riparian area. 6The area of the mitigation site on ephemeral channels shall comprise no more than 25 percent (25%) of the total area of buffer mitigation per 15A NCAC 02B .0295 (o)(7). Determinations provided in the table above were made using a proposed easement boundary showing proposed mitigation areas shown in Figure 1. The maps representing the proposal for the site are attached to this letter and initialed by Ms. Merritt on December 1, 2021. Substantial changes to the proposed easement boundary as well as any site constraints identified in this letter , could affect the Site’s potential to generate buffer mitigation and nutrient offset credits. This letter does not constitute an approval of this Site to generate buffer and nutrient offset credits. Pursuant to 15A NCAC 02B .0295, a mitigation proposal and a mitigation plan shall be submitted to DWR for written approval prior to conducting any mitigation activities in riparian areas and/or surface waters for buffer mitigation credit. Pursuant to 15A NCAC 02B .0703, a proposal regarding a proposed nutrient load-reducing measure for nutrient offset credit shall be submitted to DWR for approval prior to any mitigation activities in riparian areas and/or surface waters. All vegetative plantings, performance criteria and other mitigation requirements for riparian restoration, enhancement and preservation must follow the requirements in 15A NCAC 02B .0295 to be eligible for buffer and/or nutrient offset mitigation credits. For any areas depicted as not being viable for nutrient offset credit above, one could propose a different measure, along with supporting calculations and sufficient detail to support estimates of load reduction, for review by the DWR to determine viability for nutrient offset in accordance with 15A NCAC 02B .0703.
