Box 98 Stokesdale, North Carolina 27357 Dear Mr. Harris and Ms. Harris: vs-06-01 SUBJECT: Permit Denial NPDES Permit Application NCO067539 Brock Acres Subdivision Guilford County UT 1,roweL.4006 t„re"- Your application for a NPDES Permit to discharge treated wastewater into an unnamed tributary to Troublesome Creek from a proposed wastewater treatment facility serving Brock Acres Subdivision was received on June 10, 1986. Our Winston-Salem Regional Office has performed a site investigation and the Division has completed its review of the permit application. Our review has determined that the receiving stream designated by you has no natural flow on at least seven (7) consecutive days during a ten (10) year period and on at least thirty (30) consecutive days in a two (2) year period. We refer to this stream as having a zero 7Q10 flow and a zero 30Q2 flow. The steady-state models, routinely used by the Division of Environmental Management to simulate stream reactions and calculate effluent limitations, do not apply to zero flow streams. Therefore, we have no way to establish discharge limitations that will comply with our statutes and regulations. Based on these facts, your request for a NPDES Permit is hereby denied. Several wastewater treatment and disposal alternatives may be available in order to obtain approval for this project. Locating your discharge further downstream or on a larger stream that can accept your wastewater without having to degrade water quality, utilize a ground absorption system which is handled under the jurisdiction of the local health department, or connection of your discharge to a publicly owned treatment works are alternatives which should be evaluated. We stand ready to discuss these alternatives with you in detail and to assist you in any way we can in selecting a suitable means of wastewater disposal. Continued ... This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. If you wish to have the hearing before a Hearing Officer with this Department, you must indicate in the petition that you waive the right to have the contested case conducted by a Hearing Officer in the Office of Administrative Hearings, and wish the matter conducted in the Department of Natural Resources and Community Development. Unless such a demand is made, this decision shall be final and binding.
