This letter is in response to your Request for More Information letter dated December
13, 2007 regarding the project known as Mr. Pete's Convenience Store in Henderson
County, NC. Below we have addressed the issues listed in your request. .
Information Requested:
1. Purpose of Proposed Work
In your submitted explanation of the proposed work; you state that the work was
"necessary" to protect the "building and parking lot. "
Impact Justification (Avoidance and Minimization)
Under Section Vll of your application you stated that the activity was "necessary to
stabilize the bank of a stream adjacent to a parking lot and building. Only the area
adjacent to these features was stabilized. "
At the time of the issued Notice of Violation, rip-rap extended far beyond the paved area
to beyond where the Car-Wash facility was later constructed. You must explain why
"stream bank erosion protection" was needed for a facility which did not exist.
The reach of stream bank that was stabilized with rip-rap, was eroding at the
time of stabilization. To prevent further bank erosion and stream instability

the reach was stabilized. Please see Attachment #1- Mr. Pete's Pictures.
These are before and after pictures taken from near the middle of the site.
The section in question (adjacent to the car wash) was eroding, and
threatening the structure as seen from Photo Point #2. My understanding is
this was the reach that was originally permitted.
2. stormwater
Under Section X of your application you state that the addition of rip-rap
Stabilization would only increase the impervious area by a minimal amount. As this site
is near 90% impervious some form of stormwater collection and treatment must be
retrofitted in order to protect existing surface water standards.
We are working on a plan for on site stormwater management. Because of
space constraints we could not develop this plan within the time allowed.
We would like to request an extension to prepare a plan without having to
re-apply.
