E-Memorandum
To: Melanie Kemp, Department of Environmental Quality
From: Robert McGraw, Mount Mitchell State Park Superintendent
Subject: Notice of Violation, Permit Number WQ0016290
Secretary D. Reid Wilson
This memorandum's purpose is to address and identify actions needed to correct violations
related to the Mount Mitchell State Park Wastewater Treatment Facility located at the
maintenance area on May 28"', 2024 and documented on the attached Notice of Violation issued
on June 13"', 2024.
1. Operation & Maintenance Plan - The park will prepare an Operation and Maintenance Plan
using the information and data listed on plans from the systems construction.
2. Minor Modification of the system - The park has engaged a consultant to design a solution
to the backwash bypass issue. It is our understanding that the project has been designed and
submittal to NCDEQ is forthcoming. Receipt of the NOV has resulted in increased urgency
to have the consultant submit the plans as soon as possible. We will provide updates as we
progress through the design & construction process.
3. Sand Filter Cover - The Park has engaged a consultant engineer to design a fixed roof
structure to protect the sand filter from weather while allowing for air circulation to allow
the aerobic treatment process to resume. This process will follow the State Construction
Office review and approval process.

4. Totalizer — The totalizer was reset after coming out of winterization and is now functioning
5. Maintenance Log — After contacting the current ORC they have been unable to produce their
maintenance or calibration logs. Mount Mitchell State Park staff are creating new logs that
will be in place by August lst, 2024. Going forward, the maintenance log will be housed in
the septic pumphouse to include maintenance and calibration logs. Both park staff and future
ORCs will be required to fill out this log at the conclusion of any maintenance & inspection
activities.
If you have any additional questions, please contact me directly. I will keep you updated on
progress as information is received.
