The NPW system components shall consist of a new skid-mounted packaged booster
pump station, fiberglass reinforced plastic building with concrete foundation, piping
modifications to the existing plant potable water system to fully segregate potable from
proposed non-potable sources as described above, site work, electrical and all associated
appurtenances. We understand from Susan Wilson of your office that a minor
modification to our current NPDES pennit may be sufficient to cover the proposed NPW
system improvements.

The Town of Clayton desires to construct an in-plant non-potable water (NPW) system
for plant water use at the Little Creek Water Reclamation Facility. The project consists
of segregating potable and non-potable uses such that potable water is only used at the
existing control building, hand wash sinks, and emergency eyewash/shower locations.
Non-potable water will be used for all other plant water needs such as influent bar screen
spray wash, clarifier surface spray, chemical solution make-up, sludge thickener spray
wash, process unit wash down. etc. We do not intend to utilize NPW for lawn irrigation
at this time. This project will provide significant benefit to the Town of Clayton in the
form of reduced operating cost and conservation of potable water resource.

Language regarding the nonpotable water system will be incorporated in the NPDES permit
during the next renewal cycle (during 2008).
Should the Town of Clayton wish to use the non-potable water system for on-site lawn
irrigation, the Town should contact this office for approval (along with the Division’s Raleigh
Regional Office).
The Division of Water Quality received the Town's request, dated April 27, 2004, to
construct an in-plant non-potable water system using treated wastewater effluent. Authorization
is hereby granted for the proposed system and any additional appurtenances associated with the
system. The existing potable water system shall be fully segregated from the proposed non-
potable water system.

As per our conversation on 4/26/04. this is a follow-up letter regarding a failure of our
effluent transfer pump. At 12:58 am, the CPL power supply into the Town of Clayton,
this power failure and the subsequent power surges caused our emergency generation
transfer switch number two to shut down on a ground fault alarm. The power was
restored to the switching gear and pump station at 7:50 am, once the plant staff arrived at
the scene. The final estimate of the overflow of effluent water was 273.600 gallons. The
majority of the discharge percolated and evaporated in the woods behind the station. No
environmental impacts were observed in the stream.
In order to prevent similar problems in the future a separate power loss relay was
installed on the effluent pump station. This relay will send a signal to the auto-dialer and
summon on-call personnel. I am also investigating how to tie the switchgear into the
facility’s alarm system.

As per our last inspection, I am forwarding a list of completed and future inflow &
infiltration activities.
• Rehabbed several manholes.
• Replaced 1000' of gravity sewer line.
• Town crews cleaned and visually inspected ten percent of the sewer system.
• Purchased smoke testing equipment.
• An 1 & I study has been requested in the 2004-2005 budget.
• Plans have been made to start smoke testing parts of the system this summer.
• Several manholes will also be rehabbed or replaced.
• 1000' of gravity sewer will be replaced as part of the 2004-2005 Street
Improvement Project.

I also reviewed their stormwater structures and permit NCG110080. Mr. Warren is in the
process of developing a Stormwater Management Plan. The facility has three discharge
outfalls. Gates will need to be installed to make two of the outfalls accessible, but they
are all visible from the fence now. No sampling has been done yet as permit was recently
issued.
Jerry Rimmer performed Pretreatment Compliance Inspection (PCI) at Clayton-Little
Creek WWTP facility May 24, 2004. The PCI included a site tour of the wastewater
treatment facility.
Mr. James Warren provided a tour of the facility. The site was operating properly at time
of visit. Primary clarifier and trickling filters were not in service. The influent screens
and grit chamber area was clean and no odors present. Two oxidation ditches were in
operation. Two secondary clarifiers were operating with weirs level and discharge clear.
A third clarifier was empty and ready for startup if needed. The filters were operating
adequately. The UV disinfection system was apparently operating properly. The sludge
holding tank was operating with a mixer out of service. There was a slight odor at the
tank. The new sludge was being filtered in a roll-off type filter box, which was
discharging into a sump and returning to the aeration basin feed. The discharge was clear.
The sludge was not being hauled at the time of the visit. The sludge drying beds were not
being used at this time. Clayton plans to expand both oxidation ditches to allow increased
flows and provide an anaerobic and anoxic section for treatment. McGill is to get land
application approval and begin hauling sludge. Clayton Manager has approved an
additional operator and electrician.

There is an excessive amount of scum on the number 1 secondary clarifier and to a lesser
degree on the number 2 secondary clarifier. The number 3 unit was clean. The excess of scum
does not appear to be creating system operational problems, but we are concerned that problems
could arise in the future. We recognize that nutrient removal might contribute to the scum
problem, but feel that improvements to the equipment, particularly in the scum removal system,
should at least be considered.

1. There is an excessive amount of scum on the number 1 secondary clarifier and to a lesser
degree on the number 2 secondary clarifier. The number 3 unit was clean. The excess of scum
does not appear to be creating system operational problems, but we are concerned that problems
could arise in the future. We recognize that nutrient removal might contribute to the scum
problem, but feel that improvements to the equipment, particularly in the scum removal system,
should at least be considered.

employees is or will be a party to the invitation to bids, addenda, any resulting contracts or
contract negotiations/changes.
A new 214,500 gallon anaerobic basin; one new 300,000 gallon anoxic tank, one
new 200.000 gallon anoxic tank; modifications to the existing aeration basins; a
new 360.000 gallon sludge holding/digestion tank with two blowers each having
1 100 SCFM of aeration capacity, and two 10 HP submersible mixers,
instrumentation, site work, piping, electrical work, and associated appurtenances,
pursuant to the letter of request received on December 29, 2003, and in conformity
with the project plan, specifications, and other supporting data subsequently filed
and approved by the Department of Environment and Natural Resources.

It is the responsibility of the Recipient and the Consulting Engineer to insure that the
project plan documents are in compliance with Amended N. C. G. S. 133-3 (ratified July 13,
1993). The administrative review and approval of these plans and specifications, and any
subsequent addenda or change order, do not imply approval of a restrictive specification for
bidding purposes; nor is it an authorization for noncompetitive procurement actions.
Any addenda to be issued for subject project plans and specifications must be submitted by
the Recipient such that adequate time is allowed for rcview/approval action by the State, and for
subsequent bidder action prior to receipt of bids.
Prior to entering into any contract(s) for construction, the recipient must have obtained all
applicable project Permits from the State, including an Authorization to Construct and/or Non
Discharge Permit.
While rejection of all bids is possible, such action may be taken only with prior State
concurrence, and only for good cause.
If the Recipient does not maintain the court sanctioned schedules which extended the
compliance date for complying with the final effluent limits established in the NPDES Permit,
then project costs incurred will not be eligible for Revolving Loan payments.
Your project is subject to the one-year perfonnance certification requirements. By this,
you are required on the date one year after the completion of construction and initial operation of
the subject treatment facilities, to certify, based on your consultant engineer's advisement,
whether or not such treatment works meet the design perfonnance, specifications and the permit
conditions and effluent limitations.

In accordance with the Federal Regulations, the Recipient is required to assure compliance
with the OSHA safety regulations on the subject project. In complying with this regulatory
responsibility, the Recipient should, by letter, invite the Training Officer, Education Training and
Technical Assistance Unit, NC OSHA Division, 4 W. Edenton Street, Raleigh, NC 27601
(telephone 919/807-2890), to participate in the Preconstruction Conference to assure that proper
emphasis is given on understanding and adhering to the OSHA regulations.
It is mandatory for project facilities to be constructed in accordance with the North
Carolina Sedimentation Pollution Control Act, and, when applicable, the North Carolina Dam
Safety Act. In addition, the specifications must clearly state what the contractors' responsibilities
shall be in complying with these Acts.
A goal of 8% of the contract price is established for Minority Business Enterprise (MBE)
participation in this project, and a goal of 5% of the contract price is established for Women's
Business Enterprise (WBE) participation in this project. The Recipient and Bidders shall make a
good faith effort to assure that MBE's and WBE's are utilized, when possible, as sources of
goods and services. The good faith effort must include the following affirmative steps: (a)
including small, minority, and women's businesses on solicitation lists; (b) assuring that small.
Do not proceed with construction until the Authorization-to-Award package and the EEO
and MBE documentation/certification have been reviewed, and you are in receipt of our
approval, if a Federal loan is desired for project construction.
Two (2) copies of any change order must be promptly submitted by the Recipient to the
State. If additional information is requested by the State, a response is required within two (2)
weeks, or the change order will be returned without further or final action.
Attached is one (1) copy of the Project Review and Cost Summary (Authority to Award)
which is to be completed within 21 days after bids have been received, and submitted to the State
for review. Upon review and approval of this information, the State will authorize the Recipient
to make the proposed award.

The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.O2O2. The ORC of the facility must visit each
Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.O2O2.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor’s
responsibilities shall be in complying with these Acts.

The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
A copy of the approved plans and specifications shall be maintained on file by the
Pennittee for the life of the facility.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to Cecil G. Madden, Jr., P.E.,
Construction Grants & Loans, DWQ / DENR, 1633 Mail Service Center. Raleigh, NC 27699-
1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
