The original Additional Information Request is attached. o Setbacks • The signed waiver from Daniel Olsen has been attached. o Waste Level Gauge • The transfer pipe is existing. It will remain in place. The function of the existing lagoons will not change. o Digester Waste Transfer • Section 2.8 of the Digester Permit Application has been revised to reflect a pumped transfer between Digester and Secondary Lagoon. The revised page is attached. o Digester Detail • We have revised Detail RA-STD-251-2 to clarify this corresponds to the new digester operating levels. The revised page is attached. Director Earth Right Farms, Inc Paradise Hill Farm 127 Circle Drive Kenansville, NC 23849 Dear Earth Right Farms: NORTH CAROLINA Environmental Quality September 18, 2024 Subject: Additional Information Request Application No. ADS310086 Paradise Hill Farm Duplin County The Animal Feeding Operations Program of the Division of Water Resources (Division) has completed a preliminary review of the subject application received on June 28, 2024 and additional information received on September 10, 2024, for permit coverage under Swine Farm Digester Waste Management System General Permit AWG400000 for the construction of an anaerobic digester to capture biogas as a part of the proposed farm digester system at the Paradise Hill Farm. Additional information is required before we may continue our review. Please address and submit the following item(s) within 30 (thirty) days of receipt of this letter. ❑ Setbacks — Site Layout Sheet shows that the location of the proposed digester does not meet the Siting Act requirements for: o distance from setback from the property line, which is 500 feet, G.S. §106-803(a)(3). As shown, the digester top of embankment is less than 500 feet from the nearest residence, owned by D Olsen Farming, LLC. The application cover letter indicated that a signed waiver has been obtained. Please provide a copy of signed waiver recorded with Registrar of Deeds. ❑ Waste Level Gauge — Update the compliance levels for Lagoon 27503A. Marker will need to be reset with the updated compliance level ("redline") once the crossover pipe is installed. o The design shows that waste will gravity flow from the secondary lagoon 27503B to the tertiary lagoon 27500A. If this overflow is to be installed as part of the digester system, please provide and updated lagoon storage waste level gauge information/storage volume calculations for Lagoon 27503A. Note: Both Lagoons 27503A and 27503B were built prior to 1996 and do not require the consideration of the second heavy rainfall factor. ❑ Digester Waste Transfer —page 2 of the application form states that the digester effluent will gravity flow from the digester to secondary treatment. However, the drawings and digester narrative state that the effluent will be pumped from wet well to secondary treatment in Lagoon 27503B. Please confirm transfer method. I have been informed of the desire of the Paradise Hill Farm to add a digester to their farm, increasing the treatment of manure on the farm and capturing the emissions from the breakdown of the manure for use as a renewable fuel. I understand that this will reduce emissions from the farm, and that no more animals will be added to the site or current waste treatment system. [ hereby approve the digester structure being closer to my property line than the existing lagoon on the farm by approximately 100'.
