Dear Mr. Tuvia:
Two Rivers Utilities received the above referenced Notice of Violation regarding exceedances of the Long Creek WWTP effluent
BOD limits during April 2022.
The weekly average violation for the week of 4/2/2022 is was determined differently from previous instruction provided to
Two Rivers Utilities. Earlier direction from NCDEQ was that weekly averages would be calculated using the full week of data
and when two different weekly limits were in effect that week, the average would be evaluated against the limit in effect for
the majority of the week. Since the majority of the week ending 4/2/2022 fell in March, should Long Creek WWTP's March
weekly BOD limit of 15 mg/L be utilized for that week? If NCDEQ's method for determining weekly average limit exceedances
has changed, please detail how compliance with weekly limits are to be determined in weeks that include months with different
permit limits.
The other weekly and monthly limit exceedances are in agreement with what was self -reported by Two Rivers Utilities.
As was earlier communicated to NCDEQ, the conditions that resulted in these non -compliances were due to an accidental
discharge from one of Two Rivers Utilities' industrial customers. A civil penalty has been issued to the industry and corrective
actions are being taken by the industry to prevent reoccurrence. Please advise if NCDEQ wishes to receive any additional
information regarding these actions.
