The facility has a permitted and as built flow rate of 0.082 MGD. INSPECTION The most recent inspection (08/21/2018) noted compliance issues with BOD, Fecal, NH3-N and TP. The report also noted composite samples being constant time/constant volume instead of flow proportional. No approval was given for the change in sampling methods. The EQ basin was noted as being full of solids and the sludge blanket in the clarifier was high. REVIEW OF PERMIT LIMITS: Flow - The facility is operating on average at around 1/4 of the flow allowed by the permit. Maximum flow noted in data was 0.18 MGD which is more than double, but this is the only flow point that exceeded the 0.082 MGD limit. Thirty-one of thirty-two (97%) monthly average values where below 0.03MGD. Ammonia Nitrogen Limits - There do not appear to be any major issues with only two DM and one MA limit violations over the permit term. The WLA spreadsheet and the 1992 WLA show more stringent limits for NH3- N. However, Division approach with treatment systems < 1 MGD is to maintain limits no more stringent than 2/4 (1999 Ammonia Policy Document). This is due to the BAT standards for these small systems. Fecal Coliform Limits - There were 5 DM exceedances over the permit term. BOD Limits - Limits violations were largely found in this parameter. Over the permit cycle there were eight (8) MA violations and eighteen (18) DM exceedances. Dissolved Oxygen Limit - While there were no limit violations for DO at the effluent, the data shows a large number of low values upstream of the treatment facility. Ninety-two (92) percent of upstream samples were below the water quality standard of 6 mg/L and the average value was 2.04 mg/L. The notices were mainly for violations of limits for BOD and Fecal as noted above and few for NH3-N and TSS. There was also an NOD issued in association with findings in the 2018 inspection report. There were nine (9) enforcement actions over the permit cycle. The total amount paid in these enforcements was $4,974.8 with $3,875 in penalties. FILE HISTORY REVIEW SUMMARY • 1976 Level B Analysis - Established for 0.082 MGD with 7Q10=0. Limits set: BOD -7; NH3-N - 2; DO -6; TSS - 30; Fecal - 200; pH 6 to 8.5 - monthly average. • 1981 Wasteload Allocation (WLA) - same as 1976 numbers. Summer 7Q10 = 0; winter 7Q10 = 0.075 and 30Q2 = 0.1. • 1987 WLA - Fecal limit is changed to 1,000. The document notes that BOD and NH3-N would change in the next permit renewal. Summer BOD-5 and NH3-N -2 and winter limits of 10 and 4. • 1992 WLA - Summer/Winter monthly average limits set as: BOD - 7/7; NH3-N - 1/2.7; DO - 6/6; TSS - 30/30; pH - 6 to 9 / 6 to 9; TP - 2/2. Monitoring included for TRC, TN and Temperature (E,U, D). at this time the permittee choose NH3-N limits over toxicity testing. Stream classification change to include the NSW supplemental classification lead to the TP limit addition. The staff report indicates that the facility will connect to city sewer when available. The NH3-N limit change discussed here does not appear to have been added to the permit. The earliest permit in the file is for 2001 so this can't be verified. It is most likely that based on Best Available technology (BAT) for these small treatment plants the limits remained at 2 and 4. A 1999 policy memo on ammonia indicated no ammonia limits more stringent than 2 and 4 for facilities less than 1 MGD due to BAT requirements. • 1996 Staff report for ATC for TP and pH controls recommended reactivation of sandfilters that were not being utilized. The report questioned if the removal of the sandfilters had been approved. • December 22, 1996 Authorization to Construct (ATC) - for addition of two chemical lines. The letter recommended activating the sandfilters. • 2001 Permit Renewal - Cover letter notes Reedy Fork as impaired. Also noted high TRC numbers that could lead to limits in the future. NSW requirements are mentioned and suggest the facility look at connection to sewer. Limits (MA/DM) set for BOD at 7/10.5 ; TSS at 30/45; Fecal at 200/400. Limits (MA only) set for DO at 6; NH3-N at 2 and 4 (S-W) and TP at 2 (quarterly average) and pH at 6-9. Monitoring included for temp (E,U,D), TN and TRC. • April 29, 2002 ATC - for EQ tank with bar screen and pumps, splitter weir, chlorine contact chamber, new effluent weir and flow meter renovations. • May 19, 2003 - Engineer's Certification for the previous ATC. • 2006 Permit Renewal - Daily Max limits for NH3-N added at 10 (S) and 20 (W). Also added a TRC limit Daily Max limit at 17 to be effective 1/1/2008. System descriptions updated to include changes from 2002 ATC. • January 9, 2008 ATC - for addition of dechlorination system using sodium sulfite. • January 25, 2009 Engineer's Certification for 2008 ATC. • September 25, 2009 - Letter to permittee on Jordan Lake Nutrient Strategy Requirements. Letter passed along allocations, but no new limits given the size of the system. • 2011 Permit Renewal - Cover letter notes Reedy Fork as impaired (continues to note Reedy Fork Creek but Creek isn't part of the name). Nutrient reopener clause is added to the permit. • 2014 - two documents outlining and ownership changes. • 2016 Permit Renewal - Because of the nutrient limit (TP) in the permit the classification is changed to Class III. There are some emails back and forth about whether or not they should be Class III since the limit is not a mass limit. With this renewal the decision was made to maintain the monitoring frequency at weekly rather than 3/week based on the discretion allowed under 15A 213.0508 (b). • March 15, 2017 - Engineer's Certification for ATC to add drum based aluminum chloride chemical feed for TP reduction. I saw that you copied Maureen Kinney on the cover letter and I saw the note in the fact sheet saying there has been some back and forth about the classification, but whatever it is, my thought is that it should be consistent between the cover letter and the permit (Grade III or "not classified"). If this is something intentional and I'm unaware of the situation, feel free to ignore! It appears that is the case with Autumn Forest as I had emailed all parties in 2016. 1 don't show that I received a response from the permittee to pursue a change despite there being some ongoing discussions about it. I am unaware of any exception to the rule as written. It's been my understanding that permits with a TN or TP limit has to be bumped up by one level of classification. If mass vs concentration limits are considered differently or should be decided case by case - this is news to me. We can't reclassify permits solely because the permittee wants less frequent monitoring, or to resolve non-compliance. BIMS is showing its current classification (WW-III). I assume the final permit went out noting the permit classification. We always consult with permitting and regional office staff during classification/reclassification to ensure we have any input that might come into play in the decision making. Short of that, we default to the rule. We wouldn't initiate a reclassification that the rule would not support. If the permittee wanted to challenge their WW-III classification they needed to submit a request to the Commission with a rationale for doing so. That doesn't mean it would be approved because we (the Commission) has to be consistent and fair in how the rule is applied. Steve — do you have any communications with permitting staff or the region that details "the case by case" approach to TN/TP limits? I have a renewal that I'm working on for the Autumn Forest WWTP in Guilford County. At the last renewal there were some questions about whether the classification should be Class -II or Class -III. The issues came up because the facility has Total Phosphorous concentration limits. It looks like we said Class -III but the issue still needed to be resolved because there were no mass limits for nutrients in the permit. I have attached a series of emails from the last renewal (2016) that might help. I was just wondering if this was ever resolved. There was no additional documentation in the file. The structures seen in the wastewater treatment system match those listed in the permit. II. Regarding the permit monitoring requirements, it was noted that all sampling was performed per the frequencies specified in the permit. Mr. Hal Young, the Back -Up ORC, does all sampling for the facility, and the laboratory analysis is performed by Statesville Analytical, Inc. III. Laboratory Mr. Montero and Mr. Young are both employees of Bell Enterprises, which holds field parameter certification #5495. Mr. Young analyzes pH, dissolved oxygen, temperature, and Total Residual Chlorine at the facility. Meter calibrations for the pH and Total Residual Chlorine meters were documented in the operator log book. All other effluent parameters, except for Fecal Coliform, are collected with a refrigerated composite sampler. The sampler was set at approximately 0 degrees Celsius on the afternoon of the inspection. The tubing appeared to be clean. The operators deliver the samples to a courier for Statesville Analytical, Inc. The composite sampler is currently set up to collect constant time/constant volume samples instead of flow proportional samples as the permit requires. Use of the constant time/constant volume method requires prior approval by the Division Director, which has not been granted to this facility, according to our files. Therefore, this inspection letter is being sent as a NOTICE OF DEFICIENCY. Please take immediate action to start collection of flow proportional samples. IV. Records/Reports The visitation log was on site showing visitation times and plant conditions. Chain of custody forms from the laboratory were available for review. Ms. Graznak noted no data transcription discrepancies from bench sheets to DMRs during her documentation review. Four months of DMRs were missing during Ms. Graznak's inspection. The operator stated that he had misplaced them, and they were made available electronically immediately following the inspection. Flow Measurement Effluent flow is measured by an ISCO ultrasonic flow meter. The flow meter was calibrated June 11, 2018 by Carolina Technical Services, and documentation of the calibration was available during the inspection. VI. Operations and Maintenance A few issues were noted during the inspection regarding operation and maintenance. The equalization basin appeared to be full of solids. Mr. Montero stated that it had not been cleaned out in recent years. The equalization basin should be on a regular cleaning schedule to avoid a buildup of solids. In addition, the sludge blanket in the clarifier appeared to be very high. Mr. Montero did not have a sludge judge available to check the depth of the sludge blanket. A sludge judge should be kept on site for process control purposes. VII. Facility Site Review Only one train of the 0.082 million gallons per day plant is currently in use. The idle side is filled with stormwater. The effluent is disinfected with calcium hypochlorite tablets and dechlorinated with sodium sulfite tablets. The effluent in the final trough appeared clear with no floating solids. The facility uses an aluminum chloride chemical feed for phosphorus reduction, as is described in the permit. VIII. Effluent/Receiving Waters The effluent from the facility was clear the day of the inspection. Effluent is discharged into an unnamed tributary to Reedy Fork, classified as Water Supply-V, Nutrient Sensitive Waters, in the Cape Fear River Basin. The effluent pipe could not be observed, because it discharges into a large stormwater pipe upstream of the tributary. No issues were noted in the receiving stream. IX. Sludge Maintenance and Handling Jenkins Waste Management pumps out the digester approximately twice per month. Records from this service were available for review. X. Requested Action In conclusion, please take immediate action to comply with your permit's requirement of flow proportional sampling. Additionally, the accumulated solids need to be removed from the equalization basin. Also, the sludge level in the clarifier should be evaluated.
