for the subject project. The Section 4.5 Gravity Sewer project installs approximately 180 linear
feet (LF) of 18-inch ductile iron (DI) sanitary sewer pipe, 130 LF of 18-inch PVC sanitary sewer
pipe, 610 LF of 16-inch DI sanitary sewer pipe,1,100 LF of 15-inch PVC sanitary sewer pipe, 800
LF of 8-inch DI sanitary sewer pipe and 930 LF of 8-inch PVC sanitary sewer pipe.
The proposed sewer line construction and associated temporary stream impacts do not meet
any of the conditions that require written authorization from the USACE nor NCDWR and we
have developed a Non -Notifying Authorization memorandum under a Nationwide-58 permit
to reflect this.

DESIGN NARRATIVE
1.0 PROJECT DESCRIPTION
A permit application package was previously submitted to NCDEQ for approval, at which
time the Section 4.5 Gravity Sewer project was assigned a permit number but did not undergo
the review process. Per NCDEQ a new permit application package is being submitted and a
new permit number should be generated.
The Section 4.5 Gravity Sewer project installs approximately 180 linear feet (LF) of 18-inch
ductile iron (DI) sanitary sewer pipe, 130 LF of 18-inch PVC sanitary sewer pipe, 610 LF of 16-
inch DI sanitary sewer pipe, 1,100 LF of 15-inch PVC sanitary sewer pipe, 800 LF of 8-inch DI
sanitary sewer pipe and 930 LF of 8-inch PVC sanitary sewer pipe. The proposed gravity
sanitary sewer outfall is a new gravity outfall installed for future development consisting of
primarily single family residential homes. The site is located south of Moncure Pittsboro Rd
and east of US 87 S. The total project has approximately 3.13 acres of disturbed area.
2.0 EXISTING SYSTEM
The proposed gravity sanitary sewer will tie-in to the proposed wet well at Chatham Park South
Pump Station No. 2. This downstream receiving sewer is permitted under WQ0043594. The
Town of Pittsboro's existing WWTP will be converted to a regional pump station (known as the
Sanford Regional Pump Station) and a new force main to convey raw wastewater will be
constructed to discharge flow to the City of Sanford's Big Buffalo Wastewater Reclamation
Facility (NPDES Permit NC0024147). This regional pump station and force main project is in
redesign by the City of Sanford with anticipated constructed beginning in Summer 2024; no
further update is available at this time. No flow will be generated until all projects are online,
certified, and operational.
3.0 PROPOSED ADDITIONS
The proposed construction will add approximately 180 linear feet (LF) of 18-inch ductile iron
(DI) sanitary sewer pipe, 130 LF of 18-inch PVC sanitary sewer pipe, 610 LF of 16-inch DI
sanitary sewer pipe, 1,100 LF of 15-inch PVC sanitary sewer pipe, 800 LF of 8-inch DI sanitary
sewer pipe and 930 LF of 8-inch PVC sanitary sewer pipe and sixteen (16) sanitary sewer
manholes. The proposed sanitary sewer is a new gravity outfall installed for future
development that extends to a future sanitary sewer wet well and has been sized accordingly
per NCDEQ's adjusted daily sewer flow rate approval dated January 2019. The future
development that will contribute flow to the proposed gravity sewer system will consist of
primarily single-family residential areas as well as an amenity center and a park. The project
does not include the permitting of new sanitary sewer flows as no flow -generating development
will occur directly related to this project. Other consultants will provide permits for the new
flows in future projects for the development through submittal of separate Fast Track Sanitary
Sewer Permit applications for each portion of the upstream infrastructure.

Division of Water Resources INSTRUCTIONS FOR FORM: FTA 10-23 & SUPPORTING DOCUMENTATION
This application is for sewer extensions involving gravity sewers, pump stations and force mains, or any combination that has been
certified by a professional engineer and the applicant that the project meets the requirements of 15A NCAC 02T and the Division's
Minimum Design Criteria (Gravity Sewer & Pump Stations/Force Mains) and that plans, specifications and supporting documents
have been prepared in accordance with 15A NCAC 02T, 15A NCAC 02T .0300, Division policies, and good engineering practices.
While no upfront engineering design documents are required for submittal, in accordance with 15A NCAC 02T .0305(b), design
documents must be prepared prior to submittal of a fast track permit application to the Division. This would include plans, design
calculations, and project specifications referenced in 15A NCAC 02T .0305 and the applicable minimum design criteria. These
documents shall be immediately available upon request by the Division.
Projects that are deemed permitted (do not require a permit from the Division) are explained in 15A NCAC 02T.0303.
Projects not eligible for review via the fast track process (must be submitted for full technical review):
➢ Projects that do not meet any part of the minimum design criteria (MDC) documents;
➢ Projects that involve more than one variance from the requirements of 15A NCAC 02T;
➢ Pressure sewer systems utilizing simplex septic tank -effluent pumps (STEPS) or simplex grinder pumps;
➢ Simplex STEP or simplex grinder pumps connecting to pressurized systems (e.g. force mains);
➢ Vacuum sewer systems.
General — When submitting an application, please use the following instructions as a checklist in order to ensure all required items are
submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the
amount of requested additional information. Failure to submit all required items will necessitate additional processing and review
time, and may result in return of the application. Unless otherwise noted, the Applicant shall submit one original and one copy of
the application and supporting documentation.
A. One Original and One Copy (second copy may be digital) of Application and Supporting Documents
® Required unless otherwise noted. Signatures on original must be "wet ink" or secure digital signatures.
Please do not submit engineering design plans with the application unless specifically requested.
B. Cover Letter/Narrative Description (Required for All Application Packages):
® List all items included in the application package, as well as a brief description of the requested permitting action.
➢ Be specific as to the system type, number of homes served, flow allocation required, etc.
➢ Include the permit number/status of any other required sewer permits (downstream/upstream)
➢ If necessary for clarity, include attachments to the application form.
C. Application Fee (All New and Modification Application Packages):
® Submit a check or money order in the amount of $600.00, dated no more than 90 days prior to application submittal.
➢ Payable to North Carolina Department of Environmental Quality (NCDEQ)
D. Fast Track Application (Required for All Application Packages, Form FTA 10-23):
® Submit the completed and appropriately executed application.
➢ If necessary for clarity or due to space restrictions, attachments to the application may be made.
® If the Applicant Type in Item I.2 is a corporation or company, provide documentation it is registered for business with the
North Carolina Secretary of State.
❑ If the Applicant Type in Item 1.2 is a partnership or d/b/a, enclose a copy of the certificate filed with the Register of Deeds in
the county of business.
❑ The Project Name in Item II.1 shall be consistent with the project name on the flow acceptance letters, agreements, etc.
® The Professional Engineer's Certification on Page 5 of the application shall be signed, sealed and dated by a North Carolina
licensed Professional Engineer.
® The Applicant's Certification on Page 5 of the application shall be signed in accordance with 15A NCAC 02T .0106(b). Per
15A NCAC 02T .0106(c), an alternate person may be designated as the signing official if a delegation letter is provided from
a person who meets the criteria in 15A NCAC 02T .0106(b).

E. Flow Tracking/Acceptance Form (Form: FTSE 10-23) (If Applicable):
❑ Submit the completed and executed FTSE form from the owners of the downstream sewers and treatment facility.
➢ Multiple forms maybe required where the downstream sewer owner and wastewater treatment facility are different.
➢ The flow acceptance indicated in form FTSE must not expire prior to permit issuance and must be dated less than one year
prior to the application date.
➢ Submittal of this application and form FTSE indicates that owner has adequate capacity and will not violate G.S. 143-215.67(a).
➢ Intergovernmental agreements or other contracts will not be accepted in lieu of a project -specific FTSE.
F. Site Maps (All Application Packages):
® Submit an 8.5-inch x 11-inch color copy of a USGS Topographic Map of sufficient scale to identify the entire project area,
including the closest surface waters.
➢ General location of the project components (gravity sewer, pump stations, & force main)
➢ Downstream connection points and permit number (if known) for the receiving sewer
® Include an aerial location map showing general project area (such as street names or latitude/longitude) so that Division staff
can easily locate it in the field.
G. Existing Permit (Application Packages for Modifications to an Existing Permit):
❑ Submit a copy of the most recently issued existing permit.
❑ Include a descriptive and clear narrative identifying the previously permitted items to remain in the permit, items to be
added, and/or items to be modified (the application form itself should include only include items to be added/modified). The
narrative should also include whether any previously permitted items have been certified.
❑ The narrative should clearly identify the requested permitting action and accurately describe the sewers to be listed in
the final permit.
H. Power Reliability Plan (Required if portable reliability option utilized for Pump Station):
❑ Per 15A NCAC 02T .0305(h)(1), submit documentation of power reliability for pumping stations.
➢ This alternative is only available for average daily flows less than 15,000 gallons per day
➢ It shall be demonstrated to the Division that the portable source is owned or contracted by the applicant and is compatible with
the station. The Division will accept a letter signed by the applicant (see 15A NCAC 02T .0106(b)) or proposed contractor,
stating that "the portable power generation unit or portable, independently -powered pumping units, associated appurtenances
and personnel are available for distribution and operation of this pump station."
➢ If the portable power source or pump is dedicated to multiple pump stations, an evaluation of all the pump stations'
storage capacities and the rotation schedule of the portable power source or pump, including travel timeframes, shall
be provided in the case of a multiple station power outage. (Required at time of certification)
I. Certificate of Public Convenience and Necessity (All Application Packages for Privately -Owned Public Utilities):
❑ Per 15A NCAC 02T .0115(a)(1) provide the Certificate of Public Convenience and Necessity from the North Carolina Utilities
Commission demonstrating the Applicant is authorized to hold the utility franchise for the area to be served by the sewer
extension, or

for a franchise has been received and that the service area is contiguous to an existing franchised area or that franchise approval
is expected.

System Extension application for the subject project (WQ0045625). Comments issued via email
from Cheng Zhang, received on August 21, 2024, are incorporated below into the final comments.

404/401/Riparian Buffer Permitting - Non -Notifying Authorization
This memorandum is in reference the USACE 404 and NCDWR 401/Riparian Buffer permitting
requirements for this installation of gravity sewer line via open trench construction.
The proposed alignment will result in perpendicular crossings of Stream 149, Stream 147, and
Stream 54 as well as their associated riparian buffers, which are subject to Town of Pittsboro
Riparian Buffers.
USACE 404 Approval
The proposed gravity sewer line is eligible for 404 authorization under the USACE Nationwide
Permit 58 (NWP 58) for Utility Line Activities (see attached). Per the conditions requiring
notification under NWP 58, submittal of a pre -construction notification (PCN) to the USACE prior
to commencing the activity is required if:
1) A section 10 permit is required - Not applicable. There are no Section 10 waters within the
review area.
2) The discharge will result in the loss of greater than 1/10-acre of waters of the United States -
The proposed installation of the sewer line will be conducted via open trench methods. All
proposed stream impacts for installation of the sewer line, including open cutting of the
streams and construction of temporary coffer dams for bypass flow and dewatering, will
result in temporary stream impacts, which are not considered a loss of waters of the US.
Upon completion of construction, the temporarily impacted streams (bed and bank) will be
restored to pre -construction conditions (grades/elevation) and stabilized with
biodegradable matting (no riprap or hard structures). There are no proposed permanent
impacts. Therefore, the proposed project will not result in a "loss" of waters of the US.
The proposed gravity sewer line construction does not meet the NWP 58 conditions requiring
submittal of a PCN. The proposed project qualifies for a non -notifying NWP 58 and submittal of
a PCN to, or receipt of written authorization from the USACE is not required.
NCDWR 401 Approval
The proposed water line construction is eligible for 401 authorization under NCDWR Water
Quality General Certification No. 4276 (WQC 4276) for Utility Lines. Per general conditions of
WQC 4276, written authorization from NCDWR is required if the activity meets any one of the
following thresholds or circumstances:

The proposed project will result in less than 110 ft of cumulative temporary stream impacts
for all three crossings.
c) Anypermanent impacts to streams - All proposed stream impacts are temporary. There are
no proposed permanent stream impacts.
d) Total permanent impacts to wetlands or open waters equal to or greater than one -tenth (1/10)
acre within the entire utility project - Not applicable. There are no proposed permanent
impacts to wetlands or streams.
e) Any stream restoration or stream relocation - Not applicable
f) Any high -density project, as defined in 15A NCAC 02H .1003(3) and by the density thresholds
specified in 15A NCAC 02H .1017, (which meets sub -conditions i, ii, iii, iv)- Not applicable.
The proposed project is not a high -density project.
g) Any permanent impacts to waters, or wetlands adjacent to water, designated as: ORW
(including SAV), HQW (including PNA), SA, WS-1, WS-11 or North Carolina or National Wild and
Scenic River - Not Applicable. The proposed stream crossings will occur within unnamed
tributaries to Robeson Creek, which has a water quality classification of WS-IV;NSW,CA.
h) Any permanent impacts to coastal wetlands or Unique Wetlands (UWL) - Not Applicable.
j) Any impacts to subject water bodies and/or state regulated riparian buffers along subject
water bodies in the Jordan Lake Basin - The proposed stream crossings will not occur in
state -regulated riparian buffers.
The proposed sewer line construction does not meet any conditions requiring written
authorization from NCDWR, and therefore does not require submittal of a PCN to, nor receipt of
written authorization from NCDWR.
Based on the information provided above, the proposed temporary stream impacts do not require
written authorization from the USACE nor NCDWR. Therefore, construction may begin at any
time and coordination with the USACE nor NCDWR is not required prior to construction.

Utility Line Activities for Water and Other Substances

Authorities: Sections 10 and 404
Activities required forthe construction, maintenance, repair, and removal of utility lines
for water and other substances, excluding oil, natural gas, products derived from oil or
natural gas, and electricity. Oil or natural gas pipeline activities or electric utility line and
telecommunications activities may be authorized by NWPs 12 or 57, respectively. This
NWP also authorizes associated utility line facilities in waters of the United States,
provided the activity does not result in the loss of greater than 1/2-acre of waters of the
United States for each single and complete project.
Utility lines: This NWP authorizes discharges of dredged or fill material into waters of
the United States and structures or work in navigable waters for crossings of those
waters associated with the construction, maintenance, or repair of utility lines for water
and other substances, including outfall and intake structures. There must be no change
in pre -construction contours of waters of the United States. A "utility line" is defined as
any pipe or pipeline for the transportation of any gaseous, liquid, liquescent, or slurry
substance, forany purpose that is not oil, natural gas, or petrochemicals. Examples of
activities authorized by this NWP include utility lines that convey water, sewage,
stormwater, wastewater, brine, irrigation water, and industrial products that are not
petrochemicals. The term "utility line" does not include activities that drain a water of the
United States, such as drainage tile or french drains, but it does apply to pipes
conveying drainage from another area.
Material resulting from trench excavation may be temporarily sidecast into waters of the
United States for no more than three months, provided the material is not placed in such
a manner that it is dispersed by currents or other forces. The district engineer may
extend the period of temporary side casting for no more than a total of 180 days, where
appropriate. In wetlands, the top 6 to 12 inches of the trench should normally be
backfilled with topsoil from the trench. The trench cannot be constructed or backfilled in
such a manner as to drain waters of the United States (e.g., backfilling with extensive
gravel layers, creating a french drain effect). Any exposed slopes and stream banks
must be stabilized immediately upon completion of the utility line crossing of each
waterbody.
Utility line substations: This NWP authorizes the construction, maintenance, or
expansion of substation facilities associated with a utility line in non -tidal waters of the
United States, provided the activity, in combination with all other activities included in
one single and complete project, does not result in the loss of greater than 1/2-acre of
waters of the United States. This NWP does not authorize discharges of dredged or fill
material into non -tidal wetlands adjacent to tidal waters of the United States to
construct, maintain, or expand substation facilities.
Foundations for above -ground utility lines: This NWP authorizes the construction or
maintenance of foundations for above -ground utility lines in all waters of the United
States, provided the foundations are the minimum size necessary.
Access roads: This NWP authorizes the construction of access roads for the
construction and maintenance of utility lines, including utility line substations, in non -
tidal waters of the United States, provided the activity, in combination with all other
activities included in one single and complete project, does not cause the loss of greater
than 1/2-acre of non -tidal waters of the United States. This NWP does not authorize
discharges of dredged or fill material into non -tidal wetlands adjacent to tidal waters for
access roads. Access roads must be the minimum width necessary (see Note 2, below).
Access roads must be constructed so that the length of the road minimizes any adverse
effects on waters of the United States and must be as near as possible to pre -
construction contours and elevations (e.g., at grade corduroy roads or geotexti le/g ravel
roads). Access roads constructed above pre -construction contours and elevations in
waters of the United States must be properly bridged or culverted to maintain surface
f lows.
This NWP may authorize utility lines in or affecting navigable waters of the United
States even if there is no associated discharge of dredged or fill material (see 33 CFR
part 322). Overhead utility lines constructed over section 10 waters and utility lines that
are routed in or under section 10 waters without a discharge of dredged or fill material
require a section 10 permit.
This NWP authorizes, to the extent that Department of the Army authorization is
required, temporary structures, fills, and work necessary forthe remediation of
inadvertent returns of drilling fluids to waters of the United States through sub -soil
fissures or fractures that might occur during horizontal directional drilling activities
conducted for the purpose of installing or replacing utility lines. These remediation
activities must be done as soon as practicable, to restore the affected waterbody.
District engineers may add special conditions to this NWP to require a remediation plan
for addressing inadvertent returns of drilling fluids to waters of the United States during
horizontal directional drilling activities conducted for the purpose of installing or
replacing utility lines.
This NWP also authorizes temporary structures, fills, and work, including the use of
temporary mats, necessary to conduct the utility line activity. Appropriate measures
must be taken to maintain normal downstream flows and minimize flooding to the
maximum extent practicable, when temporary structures, work, and discharges of
dredged or fill material, including cofferdams, are necessary for construction activities,
access fills, or dewatering of construction sites. Temporary fills must consist of
materials, and be placed in a manner, that will not be eroded by expected high flows.
After construction, temporary fills must be removed in their entirety and the affected
areas returned to pre -construction elevations. The areas affected by temporary fills
must be revegetated, as appropriate.

Notification: The permittee must submit a pre -construction notification to the district
engineer prior to commencing the activity if: (1) a section 10 permit is required; or (2)
the discharge will result in the loss of greater than 1/10-acre of waters of the United
States. (See general condition 32.) (Authorities: Sections 10 and 404)
Note 1: Where the utility line is constructed, installed, or maintained in navigable waters
of the United States (i.e., section 10 waters) within the coastal United States, the Great
Lakes, and United States territories, a copy of the NWP verification will be sent by the
Corps to the National Oceanic and Atmospheric Administration (NOAA), National Ocean
Service (NOS), for charting the utility line to protect navigation.
Note 2: For utility line activities crossing a single waterbody more than one time at
separate and distant locations, or multiple waterbodies at separate and distant
locations, each crossing is considered a single and complete project for purposes of
NWP authorization. Utility line activities must comply with 33 CFR 330.6(d).
Note 3: Access roads used for both construction and maintenance may be authorized,
provided they meet the terms and conditions of this NWP. Access roads used solely for
construction of the utility line must be removed upon completion of the work, in
accordance with the requirements for temporary fills.
Note 4: Pipes or pipelines used to transport gaseous, liquid, liquescent, or slurry
substances over navigable waters of the United States are considered to be bridges,
not utility lines, and may require a permit from the U.S. Coast Guard pursuant to the
General Bridge Act of 1946. However, any discharges of dredged or fill material into
waters of the United States associated with such pipelines will require a section 404
permit (see NWP 15).
Note 5: This NWP authorizes utility line maintenance and repair activities that do not
qualify for the Clean Water Act section 404(f) exemption for maintenance of currently
serviceable fills or fill structures.
Note 6: For activities that require pre -construction notification, the PCN must include
any other NWP(s), regional general permit(s), or individual permit(s) used or intended to
be used to authorize any part of the proposed project or any related activity, including
other separate and distant crossings that require Department of the Army authorization
but do not require pre -construction notification (see paragraph (b)(4) of general
condition 32). The district engineer will evaluate the PCN in accordance with Section D,
"District Engineer's Decision." The district engineer may require mitigation to ensure that
the authorized activity results in no more than minimal individual and cumulative
adverse environmental effects (see general condition 23).
GENERAL CONDITIONS
Note: To qualify for NWP authorization, the prospective permittee must comply with the
following general conditions, as applicable, in addition to any regional or case -specific

conditions imposed by the division engineer or district engineer. Prospective permittees
should contact the appropriate Corps district office to determine if regional conditions
have been imposed on an NWP. Prospective permittees should also contact the
appropriate Corps district office to determine the status of Clean Water Act Section 401
water quality certification and/or Coastal Zone Management Act consistency for an
NWP. Every person who may wish to obtain permit authorization under one or more
NWPs, or who is currently relying on an existing or prior permit authorization under one
or more NWPs, has been and is on notice that all of the provisions of 33 CFR 330.1
through 330.6 apply to every NWP authorization. Note especially 33 CFR 330.5 relating
to the modification, suspension, or revocation of any NWP authorization.
1. Navigation. (a) No activity may cause more than a minimal adverse effect on
navigation.
(b) Any safety lights and signals prescribed by the U.S. Coast Guard, through
regulations or otherwise, must be installed and maintained at the permittee's expense
on authorized facilities in navigable waters of the United States.
(c) The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein
authorized, or if, in the opinion of the Secretary of the Army or his or her authorized
representative, said structure or work shall cause unreasonable obstruction to the free
navigation of the navigable waters, the permittee will be required, upon due notice from
the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions
caused thereby, without expense to the United States. No claim shall be made against
the United States on account of any such removal or alteration.
2. Aquatic Life Movements. No activity may substantially disrupt the necessary life
cycle movements of those species of aquatic life indigenous to the waterbody, including
those species that normally migrate through the area, unless the activity's primary
purpose is to impound water. All permanent and temporary crossings of waterbodies
shall be suitably culverted, bridged, or otherwise designed and constructed to maintain
low flows to sustain the movement of those aquatic species. If a bottomless culvert
cannot be used, then the crossing should be designed and constructed to minimize
adverse effects to aquatic life movements.
3. Spawning Areas. Activities in spawning areas during spawning seasons must be
avoided to the maximum extent practicable. Activities that result in the physical
destruction (e.g., through excavation, fill, or downstream smothering by substantial
turbidity) of an important spawning area are not authorized.
4. Migratory Bird Breeding Areas. Activities in waters of the United States that serve
as breeding areas for migratory birds must be avoided to the maximum extent
practicable.

GENERAL CERTIFICATION COVERAGE:
Activities that are eligible for US Army Corps of Engineers Nationwide Permit 58 qualify for
coverage under this General Certification unless they meet one of the thresholds listed
below. Activities meeting any one (1) of the thresholds or circumstances listed below are not
eligible for coverage under this General Certification and require an Individual401 Water
Quality Certification from the Division of Water Resources (DWR):
a) If any of the conditions of this General Certification cannot be met; or
b) Total temporary impacts to streams greater than 500 feet within the entire utility
project; or
c) Any permanent impacts to streams; or
d) Total permanent impacts to wetlands or open waters equal to or greater than one -tenth
(1/10) acre within the entire utility project; or
e) Any stream restoration or stream relocation; or
f) Any high -density project, as defined in 15A NCAC 02H .1003(3) and by the density
thresholds specified in 15A NCAC 02H .1017, which:
i. Disturbs one acre or more of land (including a project that disturbs less than one
acre of land that is part of a larger common plan of development or sale); and
ii. Has permanent wetland, stream or open water impacts; and
iii. Is proposing new built -upon area; and
iv. Does not have a stormwater management plan reviewed and approved under a
state stormwater program' or a state -approved local government stormwater
program2.
Projects that have vested rights, exemptions, or other legacy rights or exemptions from
state or locally -implemented stormwater programs and projects that satisfy state or
locally -implemented stormwater programs through use of community in -lieu fee
programs require an Individual 401 Certification; or
g) Any permanent impacts to waters, or to wetlands adjacent to waters, designated as:
ORW (including SAV), HQW (including PNA), SA, WS-I, WS-II, Trout, or North Carolina or
National Wild and Scenic River; or
h) Any permanent impacts to coastal wetlands [15A NCAC 07H .0205], or Unique Wetlands
(UWL) [15A NCAC 02B .0231]; or
i) Any impacts to subject water bodies and/or state regulated riparian buffers along
subject water bodies in the Neuse, Tar -Pamlico, or Catawba River Basins or in the
Randleman Lake, Jordan Lake or Goose Creek Watersheds (or any other basin or
watershed with State Regulated Riparian Area Protection Rules [Buffer Rules] in effect
at the time of application) unless:
i. The activities are listed as "EXEMPT" or "DEEMED ALLOWABLE" from these rules;
or

Management (DCM); or
iii. A Buffer Authorization Certificate, Certificate with Exception, or Minor Variance
is issued by a delegated or designated local government implementing a state
riparian buffer program pursuant to 143-215.23.
In accordance with 15A NCAC 02H .0503(f), the Director of the North Carolina Division of Water
Resources may require submission of a formal application for Individual Certification for any
project if it is deemed in the public's best interest or determined that the project is likely to
have a significant adverse effect upon water quality, including state or federally listed
endangered or threatened aquatic species, or will degrade the waters so that existing uses of
the waters or downstream waters are precluded.
This General Certification does not relieve the permittee of the responsibility to obtain all other
required Federal, State, or Local approvals before proceeding with the project, including those
required by, but not limited to, Sediment and Erosion Control, Non -Discharge, Water Supply
Watershed, and Trout Buffer regulations.
This General Certification neither grants nor affirms any property right, license, or privilege in
any waters, or any right of use in any waters. This General Certification does not authorize any
person to interfere with the riparian rights, littoral rights, or water use rights of any other
person and does not create any prescriptive right or any right of priority regarding any usage of
water. This General Certification shall not be interposed as a defense in any action respecting
the determination of riparian or littoral rights or other rights to water use. No consumptive
user is deemed by virtue of this General Certification to possess any prescriptive or other right
of priority with respect to any other consumptive user regardless of the quantity of the
withdrawal or the date on which the withdrawal was initiated or expanded.
Upon the presentation of proper credentials, DWR may inspect the property.
This General Certification shall expire on the same day as the expiration date of the
corresponding Nationwide Permit. The conditions in effect on the date of issuance of
Certification for a specific project shall remain in effect for the life of the project, regardless of
the expiration date of this General Certification. This General Certification is rescinded when
the US Army Corps of Engineers reauthorizes the corresponding Nationwide Permit or when
deemed appropriate by the Director of the Division of Water Resources.
Non-compliance with or violation of the conditions herein set forth by a specific project may
result in revocation of this General Certification for the project and may also result in criminal
and/or civil penalties.

On July 16, 2018, the Division of Water Resources (Division) received an adjusted daily sewage flow
rate (flow reduction) request that would apply to all permitted but not yet tributary residential
connections and all future residential connections within the Chatham Park Development service
area.
In accordance with 15A NCAC 02T .0114(f)(2), the Division has evaluated the request as well as
additional information received on October 15, 2018, and based on the data submitted and the
Division of Water and Infrastructure (DWI) guidance, the Division hereby approves for use by the
Chatham Park development an adjusted daily sewage design flow rate with the following
conditions:
• The flow reduction is applicable to residential single family dwellings only.
• The minimum flow for 1 and 2 bedroom dwellings shall be 120 gallons per day.
• Each additional bedroom above two bedrooms shall increase the volume by 60 gallons per
day per bedroom.
• This flow reduction shall not apply to sewer extension applications and/or permits for any
other public or private organizations whose wastewater flows are or might become
tributary to Chatham Park collection system.
Future sewer extension applications should be made using the flow reduction amount stated above.
All other aspects of the permitting process remain unchanged, and all applications must be in
compliance with the statues, rules, regulations and minimum design criteria as certified by the
owner and engineer.
Regardless of the adjusted design daily wastewater flow rate, at no time shall the wastewater flows
exceed the effluent limits defined in the NPDES Permit for the treatment facility or exceed the
capacity of the sewers downstream of any new sewer extension or service connection(s)_.,

reissuing and/or modifying the flow reduction as allowed by the laws, rules, and regulations
contained in 15A NCAC 02T, NCGS 143-215.1, or as needed to address changes in State and/or
Federal regulations with respect to wastewater collection systems, protection of surface waters
and/or wastewater treatment.

On July 2, 2020, the Division of Water Resources (Division) received a request for an adjusted daily
sewage flow rate (flow reduction) that would apply to all permitted but not yet tributary sewer
connections and all future multi -family residential connections within the Chatham Park
Development.
In accordance with 15A NCAC 02T .0114(f)(2), the Division has evaluated the request, and based on
the data submitted and the Division of Water and Infrastructure (DWI) guidance, the Division
hereby approves for use by the Chatham Park Development an adjusted daily sewage design flow
rate for the multi -family (apartment) sewer connections tributary to the Chatham Park Collection
System with the following conditions:
• The minimum flow for 1- and 2-bedroom apartment dwellings shall be 144 gallons per day.
Each additional bedroom above two bedrooms per apartment dwelling shall increase the
volume by 72 gallons per day per bedroom (e.g. three bedroom apartments shall utilize 216
gallons per day).
• This flow reduction shall not apply to sewer extension applications and/or permits for any
other public or private organizations.
Future sewer extension applications should be made using the flow reduction amount stated above.
All other aspects of the permitting process remain unchanged, and all applications must be in
compliance with the statues, rules, regulations and minimum design criteria as certified by the
owner and engineer.
