Since receiving your letter I was unable to travel to my property on Lake Glenville until the first week in January of 2008 to collect the additional information and photos you requested. I had made 3 phone call attempts leaving messages for Mr. Barnett during this time attempting to expiair~ that i would need a~i eziension of time to make the trip and needed some clarification as to information you were requesting. However, I trust you will receive this in a timely manner and this additional information will be sufficient. I would like to request that you continue to review this application for shoreline stabilization. Additional Information requested: 1. "Lack of practical alternatives" The shoreline on this property has never been developed and has been eroding away since the lake was formed. Due to boating activity and heavy wave action at times this shoreline has severe deterioration with a lot of exposed tree roots. A tree has already fallen due to erosion and others may fall soon if the shore is not stabilized. The shoreline has rescinded landward over 10' and has eroded away in some places causing 8' vertical drops with hallow caves forming under tree root structures. This is causing a very unstable shoreline for the trees and can be dangerous for people to be near. Natural stabilization or Bioengineering will not work due to the severity of erosion and wave action at this location. The only practical solution is to use a hardening structure like Rip Rap with dirt replacement to protect the trees, encourage their growth and prevent any trees from dying and falling in the future. 2. "Additional Photos with a Scale" Included are some additional photos showing the severe erosion at the shoreline. The photos have a measuring 2" X 4" with numbers marked at (1) foot intervals and or a person to depict scale. Also depicted is the caving of the eroded shore where the dirt has been washed out from under the trees causing instability. 3. "Description of existing vegetation" The ground vegetation within 50' of the shore is mainly compacted fallen leaves and pine needles from White Pine trees. The area is mostly shaded so virtually no plants are seen. The trees on this section of the property are comprised of Oak, White Pine, Hemlock, Maple, Elm and Mountain Laurel. There are some small saplings of these trees less than 1" in diameter as well. To complete this project properly for long term benefit to the shoreline, some small trees may have to be trimmed or cut to gain access. If vegetation has to be cut it will be done at ground level so they can grow back or will be replaced with like kind. Care will be taken to keep ground cover disturbance to a minimum. Any area where the ground cover was disturbed will be allowed to return to its natural state after project completion. Based on our review of your submitted application, the DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. 15A NCAC 02H .0506 (f) requires that "a lack of practical alternatives" be demonstrated. In accordance with meetings with Duke Power Representatives during the spring of 2004, photographs should accompany each application detailing the eroded areas, site conditions, and provide a scale from which the Division of Water Quality can determine the extent of the eroded cut bank should accompany the submitted application. The submitted documentation provides no scale nor provides a compelling justification for the requested impacts. 3. Application Item II, 8. b. asks for a description of the existing vegetation within 50 feet of the edge of water. As Lake Glenville is classed Water Supply -III, B, Trout, HQW, there is a required 25 foot wooded trout buffer (15A NCAC 04B .0125) overlaid with a 30 foot vegetated Water Supply Watershed buffer (12A NCAC 02B .0215). A discussion as to how this will be maintained, enhanced should be provided You must provide a clear and concise response to the above listed deficiencies.
