Division staff has confirmed that the subject permit is no longer required. Therefore, in
accordance with your request, NPDES Permit NCO084778 is rescinded, effective immediately.
If in the future your company wishes to discharge wastewater to the State's surface waters, you
must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit Will subject the responsible party to a civil penalty of up to $25,000 per day.

Dear Mr. Weaver:
Pumping for remediation of the soil was discontinued with the permission of
the state in March 2003, so all discharge ceased at that time. Since then
North State Pyrophyllite (our western neighbor) split their property and
sold it to Carmax Auto Superstores. This is significant since some of the
extraction wells that fed the discharge are now on both properties as well
as on our own, with the piping and wiring running under the Norfolk -Southern
rail line. Our test people are still taking samples (now on a yearly basis)
and have reported that they cannot even find many of the wellheads for the
test wells and extraction wells on the other two properties. We are trying
to get final permission to formally close the wells that we can find based
on the data that we have provided to the state but have gotten no final word
yet.
Additionally, we had some digging done along the rail line on our property
that tore the plastic piping and wiring up for all the extraction wells west
of the rail line. The system as it stands is not operable and would require
a substantial effort and investment to put back into operation, which we
certainly hope and expect we will never have to do. One of the
complications today is the addition of a main fiber optic cable right-of-way
along the rail line that would require a good portion of the excavation
around the railroad track to be dug by hand.
Because of everything cited above it is my intent to allow the permit to
expire and permanently cease any and all NPDES discharges. I honestly
believe that if we did have to resume extraction and discharge that the new
engineering and construction could change enough parameters and justify

Charles,
I received an email from Scott Lange (ORC and Company Rep) on October 28, 2005. According to him,
Harvin Reaction Technology has not discharged any water for quite some time (DMRs confirm this fact
at least back to July 2004). They hope to obtain permission from Aquifer Protection to discontinue all
remediation efforts and permanently cease any groundwater extraction, air stripping and dishcarge. He
asked at that time that they be put on the inactive list, which has taken place. I would assume that
someone in the AP section will have to confirm/deny whether or not AP has agreed to discontinue
remediation efforts and therefore allow DWQ to rescind the NPDES permit. Hope this helps.

Below is an email I received (at my request) from Harvin Reaction Technologies (NC0084778) in
Guilford Co. This is a GW remediation system that has not been operational since March 2003. It
seems a big waste of time (both theirs and mine) to inspect each year.
I don't think I have the necessary permissions to place them on the inactive list. Can you handle this
for me?

Division personnel received a request for clarification of the subject permit on April 16, 2002. Mr.
Scott Lang notified a member of the NPDES Unit that the cover letter for the subject permit (issued on
September 12, 2001) erroneously referenced Alamance County.
This letter is to clarify that permit NCO084778 is for the Harvin Reaction Technology remediation
site in Guilford County. The reference to Alamance County was a typographical error made when I was
finalizing the cover letter (using a shell document). No modification to the permit is necessary, as the
permit Cover Sheet and Supplement correctly reference Guilford County.
Please place this letter in your permit file. I apologize for any confusion this error may have caused.

Division personnel have reviewed and approved your application for renewal of the subject permit
Accordingly, we are forwarding the attached NPDES discharge permit This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Please be aware that North Buffalo Creek is listed as an impaired stream on North Carolina's 303(d) list This
means that the stream does not meet all water quality standards. The Division is working toward the improvement of
water quality in North Buffalo Creek. If the Division's current initiatives do not result in improved water quality,
removal of discharges to North Buffalo Creek may be necessary for the health of the stream.
While the Division believes many point -source discharges are causing degradation to North Buffalo Creek,
we will continue to monitor compliance at your facility. If noncompliance with your permit's effluent limits is shown
to be a direct cause of stream degradation, the Division will recommend removal of your facility's discharge.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mad Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be

A. (2.) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or
"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or
subsequent versions. The tests will be performed during the months of February, May, August and November.
Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all
treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit
Emit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as
described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998)
or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic
Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.

All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for
the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to
the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No
Flow' in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at
the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

The discharge that we generate is completely from a
groundwater remediation program to remove trichlorofluoromethane
(CC13F, "Freon" 11) contamination. Our system consists of feed
well and test wells. The feed wells provide water to an air
stripper which removes the volatile organic contaminant' by a
countercurrent of air from below while water drips through
perforated trays from above. It is only this treated water that
we discharge and there is NO sludge generated by or discharged
from this system.

1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic
Bioassay Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or
significant mortality is 90% (defined as treatment two in the North Carolina procedure document).
The permit holder shall perform quarterly monitoring using this procedure to establish compliance
with the permit condition. The first test will be performed after thirty days from the effective date
of this permit during the months of February, May, August and November. Effluent sampling for
this testing shall be performed at the NPDES permitted final effluent discharge below all treatment
processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address:

Dear Mr. Clark:
An Authorization to Construct treatment facilities at the subject facility was originally issued
August 7, 1995. Based on a request received February 26, 1996 from Mr. James Rudder, authorization
is hereby granted to substitute a six -tray air stripper with 350 efm blower for the previously appiuved
30,000 CFM cooling tower. Approval of all previously reviewed components remains in effect.
This Authorization to Construct is issued in accordance with Part Ill, Paragraph A, of NPDES
Permit No. NCO084778 issued August 7, 1995, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit
No. NC0084778.
The sludge generated from these treatment facilities must be. disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Winston-Salem Regional Office, telephone number 910-771-4600, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted factluy ilas bcou instaucd in
accordance with the NPDES Permit, this Authorization to Construct and the approved p!,M1 :ind
specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC
27626-0535.

Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and mint comnl•• ,011,
all other conditions of Title 15A, Chapter 8A, .0202. Once the facility is classified, the Penmittee must
submit a letter to the Certification Commission which designates the operator in responsible charge will["

and final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for construction of a groundwater remediation treatment system
consisting of: eight extraction wells with 3 HP submersible pumps; a cooling tower AST; connnection to
the existing 30,000 CFM cooling tower; and all associated piping, valves, controls, and appurtenances
with discharge to an unnamed tributary to North Buffalo Creek in the Cape Fear River Basin.
This Authorization to Construct is issued in accordance with Part III, Paragraph A, of NPDES
Permit No. NCO084778 issued August 7, 1995, and shall be subject to revocation unless the wastewater
