Stevens, Director Division of Water Quality April 27, 2001 Subject: Issuance of NPDES Permit NCO038156 Northeast Guilford Senior High WWTP Guilford County Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). The limits and requirements in this permit will take effect on July 1, 2001. The subject facility is discharging excessive amounts of total residual chlorine (TRC). The average TRC concentration in the effluent should be below 28 µg/L. This facility discharged an average of 904.1 µg/L per month in 1999 and 315.15 µg/L per month in 2000. However, the NPDES Unit has reviewed the Special Order by Consent (SOC) for several Guilford County Schools, including Northeast Guilford Senior High. If the schedule in the SOC is successfully met, no TRC limit should be necessary for this permit. However, if the SOC schedule is not met, the Division may reopen this permit and install a TRC limit. Please be aware that Reedy Fork Creek is listed as an impaired stream on North Carolina's 303(d) list. This means that the stream does not meet all water quality standards. The Division is working toward the improvement of water quality in Reedy Fork Creek. If the Division's current initiatives do not result in improved water quality, removal of discharges to Reedy Fork Creek may be necessary for the health of the stream. Although the Division believes larger discharges and urban runoff are the primary causes of degradation to Reedy Fork Creek, we will continue to monitor compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a direct cause of stream degradation, the Division will recommend removal of your facility's discharge. Your facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of nutrients from all discharges to NSW waters. Facilities permitted to discharge greater than 500,000 gallons per day (and any new or expanding facilities) will be subject to nutrient limitations for total nitrogen and total phosphorus according to House Bill 515 requirements. Since modifications to treatment systems are expensive and time consuming, it is highly recommended that you begin planning for this possibility now if a future expansion is anticipated at your facility. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). An examination of the Cape Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for NPDES permits in the Cape Fear river basin.
