If in the future you wish to again discharge wastewater to the State's surface waters from the NE
school location, you must first apply for and receive a new NPDES permit. Discharge of wastewater
without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000
per day.

Subject: Issuance of NPDES Permit NCO038156
Northeast Guilford Senior High WWTP
Guilford County
Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). The limits and requirements in
this permit will take effect on July 1, 2001.
The subject facility is discharging excessive amounts of total residual chlorine (TRC). The average TRC
concentration in the effluent should be below 28 µg/L. This facility discharged an average of 904.1 µg/L per month
in 1999 and 315.15 µg/L per month in 2000. However, the NPDES Unit has reviewed the Special Order by Consent
(SOC) for several Guilford County Schools, including Northeast Guilford Senior High. If the schedule in the SOC is
successfully met, no TRC limit should be necessary for this permit. However, if the SOC schedule is not met, the
Division may reopen this permit and install a TRC limit.
Please be aware that Reedy Fork Creek is listed as an impaired stream on North Carolina's 303(d) list. This
means that the stream does not meet all water quality standards. The Division is working toward the improvement of
water quality in Reedy Fork Creek. If the Division's current initiatives do not result in improved water quality,
removal of discharges to Reedy Fork Creek may be necessary for the health of the stream. Although the Division
believes larger discharges and urban runoff are the primary causes of degradation to Reedy Fork Creek, we will
continue to monitor compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a
direct cause of stream degradation, the Division will recommend removal of your facility's discharge.
Your facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water Responsibility Act (House
Bill 515) was enacted, with the intent to strengthen the control of nutrients from all discharges to NSW waters.
Facilities permitted to discharge greater than 500,000 gallons per day (and any new or expanding facilities) will be
subject to nutrient limitations for total nitrogen and total phosphorus according to House Bill 515 requirements.
Since modifications to treatment systems are expensive and time consuming, it is highly recommended that you begin
planning for this possibility now if a future expansion is anticipated at your facility.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

discharge permit for Northeast Junior and Senior High School NPDES Permit NC0038156. Since the
previous permit renewal the following improvements have been implemented at this facility:
In April of 1995 maintenance improvements were undertaken at this facility. The work
included removal and replacement of a portion of filter media, new filter distribution piping,
and a new chlorine contact chamber.

Dear Mr. Odell:
The Division is beginning the cycle of permit renewals for the Cape Fear river basin. An examination of the Cape
Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES
permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary
delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for
NPDES permits in the Cape Fear river basin.
This permit modification changes the expiration date of the subject permit in subbasin 30602 to June 30, 2001. Please
find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All
other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification
is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency.
In accordance with the modification of the permit expiration date, the new due date for your renewal application is
January 1, 2001. Renewal application forms will be sent to you approximately 6-8 weeks in advance of the new due date
or you may download the forms from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.htnd.
You will need to download Short Form D. If you have already submitted a permit renewal form, there is no need to
submit any other forms to the Division; the application will be processed during the renewal period for your subbasin.
If any part of this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming
to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

A letter of request for an Authorization to Construct was received November 16, 1992 by the
Division and final plans and specifications for the subject project have been reviewed and found to be
satisfactory. Authorization is hereby granted for the removal of existing terra cotta sand filter distribution
pipes to be replaced by a field drilled PVC pipe distribution network, the reworking of sand filters to
produce a level surface and minimum depth of twenty four inches, waterproofing of the sandfilter walls,
raising of the junction box tops and the installation of a concrete aeration structure with discharge of treated
wastewater into Reedy Fork Creek in the Cape Fear River Basin.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES
Permit No. NCO038156 issued February 1, 1991, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0038156.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Winston-Salem Regional Office, telephone number [phone], shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and

A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
The sand media of the sandfilter must comply with the Division's sand specifications. The
engineer's certification will be evidence that this certification has been met.
A leakage test shall be performed on the septic tank and dosing tank to insure that any exfiltration
occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hour per 1,000 gallons of
tank capacity. The engineer's certification will serve as proof of compliance with this condition.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

as needed but should be inspected no less than once every three (3) years of operation.

the Division as an acceptable source.
