Dear Mr. Wise,
This letter is in response to your permit rescission request received on September 6, 2024.
The Mooresville Regional Office has reviewed your permit rescission request and has determined
that the Permittee needs to address the following item:
1. For the Division to consider this permit rescission request, the Permittee shall demonstrate that
nitrate (NO3) in the groundwater is below the 15A NCAC 02L standard for three consecutive
quarters. Therefore, the Permittee shall sample monitoring well MW-19 for two more quarters
and then provide the results in a future permit rescission request.
Accordingly, the Division has denied your permit rescission request. Pursuant to 15A NCAC 02T
.0105(j), “the Permittee shall comply with all permit conditions and requirements until the waste treatment
systems authorized by the permit are properly closed or subsequently permitted by another permit issued
by the appropriate permitting authority for that activity.”
