Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. I did an inspection up there in May 2005, the building is vacant. No discharge from the wwtp. They do have an active Pump & Haul permit with us - they send in monthly reports on those activities, which there have been none as of late. No problems on my end with rescinding NC0001210. Klimek, P.E., Director Division of Water Quality Subject: Waiver of Monthly Reporting Requirement Monarch Hosiery Mills, Inc. — Altamahaw Plant NPDES Permit NC0001210 Alamance County Dear Mr. Keziah Title 15A of the North Carolina Administrative Code, Subchapter 2B, Section .0506 enumerates specific reporting requirements applicable to holders of NPDES permits issued by the State of North Carolina. 15A NCAC 2B .0506 (a)(1)(E) states that permittees must continue to submit monthly discharge monitoring reports (DMRs) to the Division of Water Quality, even when there is no discharge from the facility during the reporting period. This requirement may be waived by the Director of the Division of Water Quality during extended periods of no discharge. I have reviewed your correspondence of June 8, 2004, which describes the unfortunate ceasing of manufacturing operations at Monarch Hosiery Mills' Altamahaw Plant and requests a suspension of NPDES reporting requirements for the facility's wastewater treatment plant (WWTP). You state that due to the plant shut down, the WWTP receives no influent from manufacturing processes. However, the WWTP will continue to serve a small office staff working on the site. This small volume of domestic flow to the WWTP is planned to be pumped and hauled from the facility for treatment and disposal. A pump and haul permit was secured on May 24, 2004 so you could perform this activity. After reviewing your letter and considering the recommendation of the staff of the Winston- Salem Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective June 1, 2004. The DMRs for September 2003, December 2003, and May 2004 should be submitted, and include a summary report on progress made in implementing those actions that will preclude the WWTP from discharging. Please note that the issuance of this waiver is conditional upon your compliance with all terms and conditions of the pump and haul permit. Please be further advised that if and when a discharge resumes, the discharge must be monitored as per the terms of the NPDES permit and other applicable rules or statutes. Please keep the Winston-Salem Regional Office apprised of any pertinent developments that arise regarding wastewater treatment at this facility, especially if plant operations resume and the WWTP is again activated. Accordingly, the Division is forwarding the subject NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). The final permit includes the following changes from the draft permit as a result of comments provided by the Environmental Protection Agency during the review of the draft permit and the effluent testing submitted to the Division on June 21, 2002: BOD, COD and TSS limits: The daily maximum and monthly average limitations for BOD, COD and TSS were modified. A sock production of 3690 pounds per day and 3657 pounds per month were used to derive the daily maximum and monthly average limits. These limits are based on production figures from 1999 and 2000. If these production figures are expected to increase during the permit cycle you should request a permit modification to revise the limits prior to the production increase;. Total Copper: Monthly monitoring for total copper was added to the permit. Copper was detected in the effluent above the allowable concentration. Ready Fork Creek is listed as an impaired stream on North Carolina's 303(d) list. This means that the stream does not meet all water quality standards. Although no particular sources are identified as the cause for this degradation, the Division will continue to monitor compliance at your facility. A plan is in place to develop a nutrient fate -and -transport model for the Jordan/Haw River watershed to better identify point and non -point source impacts. Ultimately, more stringent limits may be included in your permit as a result of the modeling efforts. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. The findings of a study by the Division determine nutrient control is necessary. 2. Local actions do not successfully reduce the nutrient loading on the receiving stream. 3. (3) ACUTE TOXICITY PERMIT LIMIT (Quarterly) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of March, June, September and December. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The format for these is: 1. The NC Std. Form C was used - only sulfides, chromium, and phenols were marked as "present". This application and its data are insufficient. If this concern is not addressed, it would be a basis for an EPA objection, per 40 CFR 122.21(e)(1). If NC does have analytical data for this facility for the parameters/fractions specified below, EPA would accept that data. -• My interpretation of the requirements of the EPA Form 2C is that because this facility is a textile facility and hence a primary industry, at least one analysis should be conducted and submitted for 1) the volatile, acid, and base/neutral GC/MS fractions, per 40 CFR 122, Appendix D, last Table 1 and 40 CFR 122.21(g)(7)(v)(A); 2) all total metals, cyanide, and total phenols, per 40 CFR 122.21(g)(7)(v)(B); and 3) BOD5, COD, TOC, TSS,.NH3, temp (both winter and summer), and pH, per 40 CFR 122.21(g)(7)(iii). Also, the permittee must address the requirements of conventional and nonconventional pollutants at 40 CFR 122.21(g)(7)(vi)(A). EPA would accept a condition in the draft permit to require this monitoring and submittal to NC within the first 6 months of permit issuance. The permit should also include a specific reopener if the results indicate the need for permit modification. I agree that they have to do the pollutants analysis specified in 122.21 Appendix D. I have already told the facility that they need to perform these analysis. As soon as I get the information I will forward it. Thanks. Will permit issuance be held up until these data are received and reviewed by NC and EPA? If not, you could issue this permit with specific requirements re its submittal and a reopener based on what the data may show. What do you plan to do? Depending on your answer, looks like this issue is resolved. 2. Because this facility is covered by an effluent guideline that is production -based, 40 CFR 122.21(g)(5) applies. This section requires that the permittee include in its application a reasonable measure of its actual production. Based on the fact sheet, you apparently had this data available to you. Please make sure that in such future draft permits that are sent here for review, those data are submitted to us since they don't seem to be required by NC Std. Form C. The production data is in the file attached (1210 limits calculations). This is a spreadsheet with the production data and the calculations for the limits. Are the specific effluent guidelines that apply to this facility 40 CFR 410.52(a) and 410.53(a)? The fact sheet doesn't specify and it does make a difference for what COD limits apply. The applicable guidelines are 410.52(a) and 410.53(a) and (b). They are also specified in the attached file. Comment resolved. 4. The fact sheet seems to indicate that the max annual avg production(of 4770# socks/day) from the years 1998, 1999, and 2000 were used, as well as the max monthly (from that period) of 3974 # socks/day). It seems strange that the max monthly from this period is lower than the max annual avg prod - can you explain? I do understand that the production from these years is less than typical. However, 40 CFR 122.45(b)(2)(i) requires that permit limits be based on "a reasonable measure of actual production". EPA does not believe that the use of the max annual or max monthly average production (even from a period of less production) meets that requirement. I would like you to provide a rationale for how use of the max monthly production over this period does meet that requirement. The use of such maximums could be a basis for an EPA objection because the permit would not meet the 40 CFR cite cited above. Our interpretation of the reasonable measure of actual production is the highest daily maximum and the highest monthly average for a recent period of production. This is how this and other permit limits are being calculated. We talked over the phone about how to derive different acceptable measurements. When you look at the data attached we can talk again about your suggestions. I appreciate your sending the data and re-examining it yourself. Based on our discussion, I am comfortable with your using the 1999 and 2000 data and checking whether 2001 data are similar. I am comfortable with your using a daily max of 3690 #/day and a 95% confidence limit for the monthly avg data. If you derive limits consistent with these, my comment is resolved. Pls let me know how you derived the production values that you used. 5. It would be very useful in future fact sheets if a sample calculation of the monthly avg and daily max for at least one parameter required by an effluent guideline was provided. The fact sheet indicates that in general, production for the last 3 years is lower than the long-term production. If this is the case, why is this limit higher (less stringent) than the previous permit's daily max COD limit of 342 #/day? COD was the only parameter that was higher than the previous permit, we feel it is justified as it was calculated following the guidelines. I haven't run across a guideline like this one, where some items are in addition to others. I'm waiting for clarification from a fellow staff person here and will contact you as soon as I hear from them. 7. The previous permit contained effluent guidelines -based monthly avg and daily max limits for sulfides, total chromium, and phenols. The fact sheet says that a reasonable potential analysis was done for 1999 and 2000 data and it was concluded that there is no RP and thus, no need to include limits for these parameters in this permit. Please know that the regs only address the concept of and specify "reasonable potential" in relation to water quality -based effluent limits that are in addition to or more stringent than technology -based limits - see 40 CFR 122.44(d). The lack of RP cannot be used as a basis to delete or backslide from technology -based requirements. The permit must continue to require effluent guidelines -based limits for sulfides, total chromium, and phenols. If not corrected, this would result in an EPA objection per 40 CFR 122.44(1). I agree with you that these limits should be in the permit. At the moment that I did the permit I wasn't aware that the limits couldn't be removed based on reasonable potential. Based on your agreement to put these limits back in the permit, comment resolved. 8. Does this permit contain or require BMPs? If not, why not? This permit does not contain BMP other than what is on the general conditions because all the activities take place inside the main building. I looked at the 7/17/01 letter from Dave to Caroline that transmitted NC's boilerplate. I saw no language that specifically required BMPs be developed. I left Dave a message asking what NC does re BMPs. The seven other Region 4 states routinely require such language in their industrial permits. Instream data reviewed for 1999 and 2000 shows similar DO concentrations upstream and downstream of the facility. Only two downstream samples were below 5 mg/l. In August 1999 downstream DO was 4.8 mg/l and 4.9 mg/l upstream and in June 2000, DO was 4.95 mg/l downstream and 5.52 mg/l upstream. This facility is a small discharge with 0.16 % instream waste concentration and does not appear to contribute to the impairment of the stream. The basinwide plan recommendation is to develop a nutrient fate and transport model for the Jordan/Haw River watershed to better identify point and nonpoint source impacts. A statement will be added to the final permit cover letter explaining the strategy and the need for more stringent limits in the future depending on the results of the modeling effort in the watershed. 2. The reasonable potential analysis was inadvertently omitted when the draft permit was sent for EPA review. The file for the reasonable potential analysis is attached (Tox Spread Monarch 1210). 3. The proposed limits were established based on the production figures for the past three years and the Effluent Guidelines in 40 CFR 410.52 and 410.53. The new limits are lower than previous permit limits due to a decrease in production at the facility. The file with the production data for the facility and the calculations for the allowable concentrations is attached (Monarch limits 1210). 4. See the attached file for item #3 above which includes the calculations showing that the new limits represent BPT and BAT. 5. Monarch Hosiery has a total phosphorus limit of 2 mg/l. The basinwide plan strategy in place for nutrient sensitive waters in the Haw River watershed, which includes Reedy Fork Creek, mandated a total phosphorus limit of 2 mg/l for dischargers over 50,000 gpd. Furthermore, House Bill 515 outlines the strategy for NSW waters statewide. Limits of 2 mg/1 total phosphorus and 5.5 mg/1 total nitrogen for facilities discharging over 0.5 MOD are required under this strategy. Monarch Hosiery's discharge is 0.05 MGD, therefore, it is not subject to the total nitrogen limit requirement. 6. The limits included in the proposed permit are more stringent than the previous permit with the exception of COD. The maximum monthly average was 3974 lbs of socks/day. The calculated limits using the most recent production data are lower than existing limits due to reduced production figures in the last three years. They are projecting an increase in production of 340 lbs/day with the addition of a new customer. The facility has not finalized a contract or formal agreement for this additional production so it was not included for the calculations. Adding the 3401b/day to the daily maximum and monthly average from the most recent production figures (year 2000) will not increase their limits. • The effluent guideline that covers this facility is 40 CFR Part 410 Subpart E, Kint Fabric Finishing Subcategory, Sections 410.52 (BPT) and 410.53 (BAT). • The wastewater treatment facility consists of bar screen, aerated holding and equalization tank, Pre -aeration basin, aeration tank, clarifier, sludge holding tank and sand filter. A RPA was conducted for Sulfides, Total Chromium and Phenols using the data from 1999 and 2000. The permit limits were used as allowable concentrations as these are more restrictive than water quality standards. • Sulfides — The allowable concentration is 0.95 lbs/day. The maximum value was 0.31 lbs/day and the maximum predicted concentration was 0.65 lbs/day. • Total Chromium — The allowable concentration is 0.48 lbs/day. Dissolved Oxygen was slightly below 5 mg/l in two occasions downstream and one occasion upstream, during summer conditions. The lowest value recorded for instream DO was 4.81 mg/l. Production data from 1999 and 2000 was used to calculate the limits. As per Monarch Hosiery president, Mr. Richard Keziah, data for 2001 was not available but it was similar to 2000. The data from 1998 was not used because it was not considered to be representative of actual production. To calculate the daily maximum limits a production of 3,690 pounds per day was used. To calculate the monthly average limits a production of 3,657 pounds per month was used. These figures are the maximum values for the two years. The data for the two years does not show much variability, therefore the maximum values are an appropriate measure of production. This procedure follows the policy established by the Division in 1995. PPA A priority pollutant analysis was performed on the effluent and results were submitted to the Division on June 21, 2002. The following parameters were detected: • Copper — Copper was detected at 300 µg/1. The allowable concentration for copper is 68 µgll. Since copper is an action level standard, monitoring only will be included in the permit. Action level policy will be implemented as needed. • Aluminum, cadmium, lead, nickel and silver were detected below water quality standards. • Bis(2-ethylhexyl)phthalate was detected at 89 µg/l. The criteria for consumption of organisms is 5.9 14g/1. Since DEHP is considered a carcinogen, the average flow of the receiving stream (229 cfs) was considered to calculate the allowable concentration. The allowable concentration is 254.9 µg/1. DEHP is a component of plastic products and is a common contaminant from sampling or laboratory handling. No monitoring will be required. A Compliance Evaluation Inspection was performed on the wastewater treatment system serving Monarch Hosiery Mills by Mike Mickey and Corey Basinger of this office on September 24, 2000. This type of inspection consists of two basic parts: an in -office review of facility files and self -monitoring data; and an on -site inspection of the facility. A review of the self monitoring forms submitted for the period January 2000 through July 2000 showed that all of the required data was recorded and submitted per the frequencies specified in the permit. In regards to compliance with effluent limits, an evaluation of the effluent data for the same time period revealed complete compliance with all monthly average and daily maximum permit limits (See data summary attached). An examination of the Cape Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for NPDES permits in the Cape Fear river basin. This permit modification changes the expiration date of the subject permit in subbasin 30602 to May 31, 2001. Please find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. In accordance with the modification of the permit expiration date, the new due date for your renewal application is December 2, 2000. Renewal application forms will be sent to you approximately 6-8 weeks in advance of the new due date or you may download the forms from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.htnil. You will need to download Standard Form C. If you have already submitted a permit renewal form, there is no need to submit any other forms to the Division; the application will be processed during the renewal period for your subbasin. Nutrient Condition for Permits with Phosphorus Limits This permit may be modified, or revoked and reissued to change the effluent limitation on nutrients for this discharge depending upon the following: 1. The findings of a study by the Division of Environmental Management determine nutrient control is necessary. 2. Local actions do not successfully reduce the nutrient loading on the receiving waters. 3. The onset of problem conditions in the receiving waters. F. ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration. The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test, using effluent collected as a 24 hour composite. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the North Carolina procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The first test will be performed after thirty days from the effective date of this permit during the months of March, June, September December. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. The monitoring shall be performed as a Fathead Minnow (Pirnephalespmmelas) 24 hour static test, using effluent collected as a 24 hour composite. The effluent concentration at which there may be at no time significant acute mortality, is 90% (defined as treatment two in the North Carolina procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The first test will be performed after thirty days from issuance of this permit during the months of Mar,.-i1)A.ti St/ /CEP. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Box 27687 Raleigh, N.C. 27611 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. This increased their loading. To mitigate this situation the facility accepted the limits from their previous permit. A 2.0 mg/I Total Phosphorus limit was added to the permit during this renewal. Note: phenols was limited on the last Fad Sheet, but did not get into the final WLA or the permit. Phenols are limited per CFR's, therefore they will be recommended in this WLA. DMR's from November, 1993 through March, 1994 this facility was in violation of its BOD limit also failed COD limit for February and March, 1994 Toxics attached spreadsheet, (Toxics Spreadsheet) which calculates the concentrations of the reported discharges. Both Chromium and Sulfides indicate strong potential for concentration violations, (concentration is based on CFR mass limits - State Standard concentration limits would be much more lenient). After consultation with Golsen Sullins, (P & E) about this issue, she pointed out that these limits are much lower than the water quality concentration limits and that by limiting this facility on a concentration basis we would be discouraging any water conservation practices. Therefore, I will recommend the CFR mass loading limits. Instream Monitorinc as the BODs information is not really useful. (an ultimate BOD would be useful) 1 will drop that requirement. the percent saturation in this waterbody is poor. there is a dam downstream, (as portrayed on the topographic map) and this may be driving the velocities down and hence the DO's, (this facility constitutes only 0.16 % IWC). Basin Issues This subbasin contains a number of major facilities, industrial and municipal, and several areas where water quality is impaired due to overallocation, facility non-compliance, excessive non -point runoff, and other factors. Modeling analyses suggest that point sources are causing BOD/DO and toxicity problems, and contributing largely to nutrient related problems. Recommended allocations reflect the level of treatment necessary to reduce the magnitude and frequency of water quality standard violations. ...A QUAL2E model has been developed from Cone Mills on North Buffalo Creek and from the T.Z. Osborne WWTP on South Buffalo Creek to Reedy Fork at Ossippee in order to reallocate NPDES permit limits for the protection of water quality. In light of the extremely limited assimilative capacity for oxygen -consuming wastes in Buffalo Creek, no new wastewater outfalls should be permitted within the basin. The existing municipal facilities, should serve as regional treatment facilities to handle future wastewater needs. All remaining permitted facilities should be required to conduct an engineering alternatives and economic analysis including the feasibility of connecting to municipal sewer service. If there are no feasible alternatives, limits of BODs=5 mg/I, NH3N=1 mg/l, and DO=6 mg/I will be required and a schedule for implementation developed. It is anticipated that, through basinwide planning, all discharges within the Buffalo Creek Basin will eventually be required to implement state-of-the-art treatment technology. At this time, the technology limits are BODS=5 mgll, NH3 N-1 mg/l, and DO-6 mg/I. Future wastewater expansions will require environmental assessments.
