PROJECT SUMMARY: ,The applicant is proposing new bulkhead that will tota11,825' in length. Field Investigation Report: Mill Creek Phase II Page 02 9. Narrative Description: The property is a separate 121-acre parcel located off of Burton Farm Road near Arapahoe, Pamlico County. Burton Farm Development Company, LLC, wishes to construct a vinyl bulkhead and is applying for a permit to do so. The property is known as Mill Creek Phase II and is on Neuse River, next to Mill Creek. There is 4,625' of shoreline on this property. The current vegetation on the tract mainly consists of upland grasses, pine trees, and a fringe of coastal wetlands. None of the project area has submerged aquatic vegetation. The elevation of the tract is +16' nwl. Existing man-made features on the property include infrastructure needed to support the 144-lot subdivision. The Pamlico County Land Use Plan classifies the project area as Rural with Services, with CAMA AEC's classified as Conservation. The waters of Neuse River are not designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SB. The bottom substrate is firm without shell. 10. Proposed Development: The request is for two new sections of vinyl bulkhead totaling 1,825 linear feet. One bulkhead will be 1,168' long and the other will be 657' long. The purpose of this bulkhead is to stabilize these sections of shoreline along the high erosion escarpment of this new subdivision. None of the proposal is to be waterward of nwl. It will require backfill to obtain a 3:1 slope using existing material on site. 11. Anticipated Impacts: As proposed, the shoreline stabilization will incorporate 1,825 linear feet of estuarine shoreline. The project is to serve the Mill Creek Phase II subdivision. All of the bulkhead is to be along the erosion escarpment and landward of all coastal and Section 404 wetlands. It will result in the filling of 32,850 square feet of backfill, landward of the bulkhead. Ross Jr., Secretary MEMORANDUM DATE: November 26, 2007 TO: Doug Huggett THRU: Tere Barrett FROM: Brad Connell ~G SUBJECT: Comments and Recommendations - CAMA Major Permit -Mill Creek Phase 11, Pamlico County The following is my assessment and consequent recommendations of the above referenced proposal: The project, as proposed, will have minimal environmental impacts. The proposed bulkhead is landward of all coastal and Section 404 Wetlands. This proposal is not in conflict with the current usage of Neuse River, and should not conflict with NCDWQ Neuse River buffer rules. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1 The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2 The bulkhead must be constructed prior to any backfilling activities. 3 The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 4 The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 5 The bulkhead must be landward of all coastal and Section 404 Wetlands. 6 The fill material will be clean and free of any pollutants except in trace quantities. The permittee must receive a Water Quality Certification from DWQ prior to the initiation of any construction activities.. 11 Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 12 A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30 calendar days of completion of any phase of grading on cut or filled slopes. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Mill Creek Phase II Shoreline Stabilization CAMA Major Permit Application November 19, 2007 PROPOSED PROJECT DESCRIPTION Site Location The site is an approximately 121 acre parcel located along the Neuse River and accessed via Burton Farm Road (NCSR 1120). The site is approximately centered around latitude 34.9881863°N and longitude 76.8467657°W. The tract is part of the larger Burton Farm Development, LLC property which has been subdivided into three separate projects; Mill Creek Phase I and Phase II (this project) and Arlington Place. Proposed Work The applicants propose to install 1,825 linear feet of retaining wall along the shoreline at the Mill Creek Phase II subdivision. The proposed retaining wall will be installed landward of the existing Section 404 and coastal wetlands. Stormwater Management A Division of Water Quality Stormwater Management Permit (SW7070602) has been issued for the infrastructure and all of the lots associated with the development. A copy of the Stormwater permit has been included with this permit application. The stormwater permit specifically addresses all future development associated with the residential development. The proposed work is not considered to be impervious and therefore, will not require a modification of the existing permit. Water and Sewer All lots associated with the development will be served by on site septic and potable water service will be provided by Pamlico County.
