The culvert was shifted to create a more stable confluence between Black Bear Creek and the swale at the outlet of the new culvert. If we kept the culvert in its existing position, Wetland
R would drain into Black Bear Creek at an outer meander which could compromise restoration structures and create bank erosion issues in the future. Adjusting the location of the culvert/swale
puts the confluence in a riffle.

This change will result in a permanent impact for Wetland R (instead of the listed W29 Temporary) as it will be filled to direct flow through the newly constructed swale. Wetland R is
a low-quality wet ditch.

Based on the Draft Mitigation plan it looks like some changes were made to that third crossing culvert design. The final plans now have the culvert bypassing Wetland R (0.01 ac). What
is the condition of this wetland and what is the reason for the design change?

Good Afternoon Emily,

Two of the three crossings (internal culvert crossing on Black Bear Creek R1 & external ford crossing on Black Bear Creek R3) are new crossings for existing agricultural activity. Based
on Section 404(f) of the CWA and previous USACE guidance, we propose that these two crossing be considered agriculturally exempt. For reference, this information is detailed in the
Bootstrap Final Mitigation Plan comment response (Emily Dunnigan/Steve Kichefski, USACE #5).

The third crossing (external culvert crossing downstream of Wetland S) will not be proposed as exempt as it was specified as a residential crossing in the Bootstrap Final Mitigation
Plan. Temporary impacts to Wetland R and Wetland S were noted in the submitted NWP27 PCN for construction access and/or culvert tie-ins, though the final culvert placement and associated
grading will fall outside of any existing jurisdictional hydrological features. The existing culvert is 26 ft long, 18” RCP and the new culvert will be 30 ft long, 30” CMP. Please let
me know if this culvert replacement would require a separate permit authorization and how you would like to proceed.

The Bootstrap ORM spreadsheet is attached to this email. The ePCN form would not accept an excel document to be uploaded. If there is a better way to get the ORM spreadsheet to the reviewer
in the future, please let me know.
