Dear Mr. Meadows:
This letter transmits a FINAL NOTICE of a stipulated penalty assessed against the Town of Siler City in the
amount of $141,000.00. This assessment is based upon the violation of condition(s) stated in the existing
Special Order by Consent (SOC) WQ S22-003.
Section 2 (a) of the SOC requires the permittee to have completed the following scheduled activity by December
30, 2023: Award Construction Contract for Main Interceptor Replacement Project. At the request of the
permittee, the due date was extended to March 29, 2024.
You were notified of the violation, the Division of Water Resources' (DWR's) intent to assess stipulated penalties,
and of your right to justify the failure to meet the scheduled activity date in Notice of Violation (NOV) letter NOV-
2024-SP-0006, dated April 10, 2024. DWR did not receive a response to NOV-2024-SP-0006.
DWR was informed via email correspondence on July 17, 2024, that a construction contract for the Main
Interceptor Replacement Project was awarded on June 11, 2024.
Pursuant to Section 5 (c) of the subject SOC, the stipulated penalty for failure to complete a scheduled activity by
the date specified in Section 2 is equal to $1,000.00 per day for the first seven (7) calendar days and $2,000.00
per day thereafter. The scheduled activity Award Construction Contract for Main Interceptor Replacement Project
was completed 74 days late, therefore the stipulated penalty of $141,000.00 is now due.

penalty will not foreclose further enforcement action for any continuing or new violation(s). Please submit

days of receipt of this letter. Make checks payable to NC DEQ and include the SOC number on the check(s)
submitted.
