Dear Mr. Barrick:
The Municipal Unit of the Division of Water Resources has reviewed the Short Term Monitoring Plan (STMP)
submitted by the Town of Rutherfordton. The Division received the submission on October 16th, 2023.
The review indicates that the STMP is adequate and meets the minimum requirements of 15A NCAC 2H
.0905 and 40 CFR 403.8(f) with the acknowledgment from the Town of Rutherfordton of addressing the
following items as requested by the Division.
The most recent Practical Quantitation Limits (PQLs) released by the Division of Water
Resources in March 2022 list the detection level for Nickel (Ni) at 0.002 mg/l. The STMP
for the Town of Rutherfordton set the detection level for Ni at 0.01 mg/l. The detection
level set by the STMP is above the limit set by the Division and it is requested that the
Town of Rutherfordton sets the detection level for Ni to 0.002 mg/l. If this is not possible
due to lab constraints or sampling methods, then the Division requests that the Town of
Rutherfordton provide documentation for this decision.
Within 180 days of the effective date of any reissued or modified NPDES permit the permittee would be
required to submit to the Division a written technical evaluation of the need to revise local limits (i.e., an
updated IWS, or documentation of why one is not needed). This action may include revising, updating, or
adding to the list of Significant Industrial Users (SIUs). Pursuant to 15A NCAC 2H .0907(b) either the Division
or the permittee may initiate pretreatment program revisions.
Federal and State pretreatment regulations require the local delegated pretreatment program to effectively
control and document the discharge of wastewater from Significant/Categorical Industrial Users to the POTW.
It is the POTW’s responsibility to ensure that these objectives are consistently met.
