Dear Mr. Justice,
On January 7, 2008 the Division of Water Quality received the application package for stream and wetland impacts for the
above project. In accordance with Water Quality Certification 3699 for NW 12, "in accordance with North Carolina General
Stature Section 143-215.3D(e), any requirement for written approval fora 401 Water Quality Certification must include the
appropriate fee." Any modification or new permit request for a previously issued 401 requires the necessary fee.
® The fee for applications is $240 for projects impacting less than an acre of wetland and less than 150 linear feet of
streams (whether intermittent or perennial). For projects impacting one or more acres of wetland or 150 or more feet
of streams (whether intermittent or perennial) the fee is $570. Please remit $570 made payable to DWQ to initiate
the review and approval process.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ. Please call

this matter.
