Re: Additional Information For Vested Rights Request For Lot 23 in Carriage Hills Subdivision, In

Dear Ms. Chapman:
Per our telephone conversation yesterday, I am submitting to you some of the additional information
that you requested for our vested rights request on the above-referenced project. As we discussed,
you would like to see some additional evidence showing that Lot 23 was the same as it was originally
approved and recorded within the original subdivision. Such evidence would help bolster our stance
regarding "Prior Government Permits° as we discussed in our initial request. Briefly, we discussed
that a copy of the original plat would be helpful in showing that Lot 23 stands today as ~ was originally
approved and recorded. This would indicate that Lot 23 has stood the same since initial recording to
be developed for residential purposes according to the initial subdivision plan. It would also be
helpful in showing that no subsequent recombinations or subdivisions or other changes to the lot
have been made, especially in recent years, that might indicated some type of different plan for this
lot. Therefore, I have obtained a copy of the original plat from our surveyor and provided it for your
review. As I had mentioned, this plat is one of those old plats that is difficult to read; however it is a
copy of the original plat on public record at the Register of Deeds, and is the best that I can provide.
Actually, I have provided 2 copies of this plat. One copy is a blown up °negative" image of the
original plat, and I think it is the best copy that shows how Lot 23 lies within the initial subdivision, as
well as the dimensions of the lot.
Additionally, you had suggested that any additional evidence showing other expenditures (such as
property taxes) could be helpful, although not necessarily required at this time. Currently the Owners
reserve the right to provide this information as it may be necessary once this request is passed up to
the Attorney General's office. As you can imagine, because the plans for this lot (and other lots in
this subdivision) have been on-going for 40 years, the Owners have progressed in their years. Such
evidence may be provided, although it may involve some digging through old files, research, or at
least a best estimate for 40 years worth of evidence.
