NOTICE OF WITHDRAWAL-EXPRESS REVIEW PROGRAM
Dear Mr. Whitehead:
On December 19, 2007, the Division of Water Quality (DWQ) received your PCN application for the
above-referenced project. On December 21, 2007, DWQ requested additional information. On January
3, 2008, a meeting was conducted to clarify additional information requests. As a result of issues
discussed in the January meeting, it has been determined that Sierra Residential Subdivision is not an
appropriate candidate for the Express Review Program, and therefore we are withdrawing your permit
application from the Express Review Program.
The Sierra Residential Subdivision project is being transferred to the Regular 401 review program, with
no additional cost to you. Ian McMillan and Annette Lucas will be generating a Request for More
Information letter for the project. One item that will be included in the letter is a request to see designs
for all of the diffuse flow measures for the entire project, since many areas are too steep for level
spreaders.. If appropriate level spreader sites are not available on the site, then a BMP that removes 30
percent of total nitrogen will need to be provided in its place. Enough space must be allocated on the site
in order to allow for these BMPs when needed.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity
and any work done within waters of the state would be a violation of North Carolina General Statutes and
Administrative Code.
